  • PUBLIC HEARING AMENDED ORDER OF CONDITIONS SE 12 - 749; 12:30 PM
REID SILVA FOR SCHEUER FAMILY PROPERTIES, LLC; 2 Chocker’s Lane; 5 Herring Run; 267 State Rd.; AP 33 and 34 Lots 3, 5 and 4.2:  Re-open the public hearing to review an amendment to the Order of Conditions issued on October 9, 2015; DEP file # SE 12 – 749.  The applicant would like to have the existing set of beach stairs remain in place thus not requiring an extension of the walking path along a wetland edge.  A separate new set of beach stairs is proposed for Map 34 Lot 4.2.  This was approved by the Commission on 11/18/15 as an improvement and inconsequential change.

  • PUBLIC HEARING NOI SE 12 - 758; REID SILVA FOR MV SAVINGS               12:40 PM
BANK; 517 South Rd.; AP 33-96:  Abandon and fill an existing cesspool and install a septic system upgrade within the 100-foot buffer zone of a Bordering Vegetated Wetland.  The cesspool is 59 feet and new leach field 78 feet from the wetland edge.

MARDEN FOR FOOL’S HIGH TIDE, LLC; 25 East Lane; AP 32-68.1:  This is a submission of the plan for the DEP’s Superseding Order of Conditions to protect the existing single-family residence that is approximately 82 feet from the top of the coastal bank.  The proposal is intended to be a storm buffer to the coastal bank.  It adds 1600 cubic yards of cobble to construct a berm above mean high water and an additional 650 cubic yards of sand on top of the cobble.  The berm will run the entire length of the property (415 linear feet). The total project area is 17,450 sq. ft.

  • NOI George Sourati for Matthew Cestar; 11 Hill Land; AP 32-40:  renovate the single-family residence; renovate the existing garage, install 4 dry wells with required underground plumbing, install a new septic system and a new water well and remove an existing fence bordering a stream.  The resources affected are the buffer zones of a Perennial Stream, the 1st 100-feet of the Riverfront zone, Bordering Vegetated Wetland draining into a coastal pond, Coastal Bank of Stonewall Pond, 100-year flood zone for Stonewall Pond.  The closest proposed limit of work extends to the wetland edge and 5 feet from the stream.  
  • NOI Chris Alley for Beach Bluff Trust (Friedberg); 1 Azalea Lane; AP 29-5:  The applicant is re-applying to build and maintain a seasonal timber beach stairway down the Atlantic Ocean coastal bank.  The project will alter approximately 5 linear feet of Coastal Bank.  
  • NOI Tom Carberry for Carl and Martha Tack; 3 Nickerson Farm Lane (Barbara Crosby’s house); AP 21-48.2: Build a single story, 24’ X 30’ garage with a slab-on-grade foundation in the buffer zone of a Bordering Vegetated Wetland.  The closest activity is approximately seven feet from the wetland edge.  
  • RFD Joan Malkin; 10 Tilton Cove Way; AP 25-125: Install a deck-level hot tub on the existing rear deck.  The hot tub will have a sonotube support system and will be drained to daylight outside the 100-foot buffer zone of a Bordering Vegetated Wetland that drains into a Coastal Pond.  The hot tub will be approximately 70 feet from the wetland edge.  
  • RFD Jimmy Morgan for Larsen Lane, LLC; 19 Larsen lane; AP 27.1-57:  Brush cut the rear property to the lot lines; remove dead trees and vines and spread seed.  The root structure for the brush will remain intact as no tilling will be done.  The closest activity is approximately 15 feet from the wetland edge.
