MINUTES OF MEETING
DECEMBER 2, 1999

PRESENT:  Chairman Tracy Scott, Ted Bailey, Skip Lawrence, Joanna McIntosh, Stan Brehm, Pauline Cote, Ron Lesieur, Paul Adams, Harold Arey, Andrea Deachman

Chairman Scott introduced the Board and explained how the evening’s agenda would proceed and asked the members of the Board to review the minutes of November 4, 1999.

Comments from the town’s people on zoning and site regulation will now be noted in the minutes.

Motion was made to accept the minutes as written.

PUBLIC HEARING:         ZONING CHANGES OR ADDITIONS

HOME OCCUPATIONS

GENERAL REQUIREMENTS

#13     HOME OCCUPATION PERMITS IN THE CI/MF ZONE WILL MEET THE SAME CRITERIA AS ANY BUSINESS VENTURE WITHIN THE CI/MF ZONE.

The following people had comments to this issue: Steve MacCleery, Frank Eaton, Bob & Faye McCanty, Bob Gagne, Dan Burleigh, Diane Wilcox.
Some of the issues were: Why no home occupations in the commercial zone? The Board does not want to eliminate the home occupation, just wants it controlled like the other businesses in the CI/MF zone. What about the home occupations already in the commercial zones?  They are grandfathered.  If we do this we will drive small business from town. The Board feels this is not true it will encourage more business in the commercial zone. What are the restrictions on frontage? A fifty-foot deeded right of way. Can I sell my commercial zone residence as a residence? Of course, it is still a home.

ARTICLE III

C. TRAILERS, MOBILE HOMES AND TRAILER PARKS

THE BUILDING INSPECTOR MAY PERMIT:

D. STORAGE TRAILERS WILL BE LIMITED TO ONE (1) IN THE RESIDENTIAL ZONE AND TWO (2) IN THE CI/MF ZONE. FOR A LIMIT OF 6 MONTHS TO ENABLE ADEQUATE TIME TO ADD APPROPRIATE STORAGE FACILITY.

DEFINITIONS

STORAGE TRAILERS – INCLUDES BUT ARE NOT LIMITED TO TRAVEL TRAILER, SCHOOL BUS, TRUCK BODIES OR ANY CONTAINER USED PRIMARILY FOR STORAGE OF PERSONAL OR BUSINESS PROPERTY.

The following people had comments on this issue: Bob Gagne, Paul Twomey, Frank Eaton, Bruce Wilen.  
Some of the questions or comments: Is this just in the commercial zone? No.  A trailer may not be taxed.

Motion was made to accept the change to zoning and have it placed on the ballot.

ALL NEW CONSTRUCTION SHALL OBTAIN A DRIVEWAY PERMIT FROM THE SELECTMEN OR THEIR APPOINTED AGENT SHOWING ACCESS FROM A TOWN MAINTAINED CLASS V OR BETTER ROAD TO THE NEW CONSTRUCTION. NO CERTIFICATE OF OCCUPATION SHALL BE ISSUED UNTIL THE DRIVEWAY IS CONSTRUCTED.

The following people had comments on this issue: Bob & Kathy Gagne, Larry Ricker.

Some of the comments and concerns were: Why are the driveway permits not issued at the time of subdivision?  The decision as to where the driveway is located is between the owner and the road agent.  What are requirements now? None. Does this do away with shared driveways? No. Who issues the driveway permits? The road agent.

Motion was made to accept this addition to the zoning and have it placed on the ballot.

PAVING – ALL PAVEMENT SHALL MEET THE REQUIREMENTS OF THE MOST CURRENT EDITION OF THE NEW HAMPSHIRE DEPARTMENT OF TRANSPORTATION SPECIFICATIONS FOR ROAD AND BRIDGE CONSTRUCTION.

Motion was made to accept the change to the subdivision regulations.

Subdivision regulation will be changed.

DEAD END ROADS –
SECTION IV –

C.     DEAD END OR CUL-DE-SAC STREETS SHALL NOT IN GENERAL EXCEED 1500 FEET AND MAY BE REQUIRED TO HAVE A CISTERN OF A SPECIFIED CAPACITY (AS DETERMINED BY THE FIRE DEPARTMENT AND OR TOWN ENGINEER) TO PROVIDE WATER FOR A FIRE EVENT. ALL DEAD END ROADS WILL REQUIRE A CUL-DE-SAC OF AT LEAST 60 FT RADIUS FROM THE EDGE OF THE RIGHT OF WAY.

Comments and concerns: Suggested we remove except where near future… should be removed, because there are no guarantees as a road being continued.

Public hearing continued to January 6, 2000.

BUILDING PERMITS

Section II – remove the last line; This limitation does not apply…
Section VI – change last line to read …and shall be reviewed by the Planning Board annually.

Discussion on how many permits per year and what percentage of growth. How long a permit is good for?

Growth studies will be worked on to determine final percentage of growth.

TELECOMMUNICATIONS TOWERS

Motion was made to accept the proposed zoning addition and have it placed on the ballot.

IMPACT FEES

Questions and concerns were:  How much would administration costs be? No on knows at this point in time, but the cost to administer the fees will come out of the general fund. How will these fees be charged? At the time of occupancy permit. How will the funds be held? In an escrow type interest-baring account will be used. What are the proposed impact fees? Without schools the fees would be $ 262.21. With school fees would be $ 3,662.21

DISCUSSION:                             Larry Ricker

Mr. Ricker presented the Board with a plan showing how he would like to have this property subdivided. The plan needs to be completed by a surveyor.

Design Review and Public Hearing to be held January 6, 2000

DISCUSSION:                     Northern Home Sales,    Elwin Flanders Trust, Owner
                                        Site Review – Manufactured Housing
                                        Map 4, Lot 165, Dover Road

Peter Holden presented the Board with plans of the proposed site review. The plans showed 2 levels of sales area a lower lot with an office and an upper show lot. All display area and driveway will be paved. A site specific from the state will be needed because of the wet lands.  There will be no storage of old homes on the property.  It is agreed this is a permitted use. Mr. Holden will get the plan to SEA Consultants for review.

The Board will be sending out proposed zoning changes to the landowners in the town of Chichester.
