PLANNING BOARD

MINUTES OF MEETING

JANUARY 8, 1998


PRESENT:  Chairman Tracy Scott, Jeff Andrews, Skip Lawrence, Harold Arey, Dave Bickert, Ron Lesieur, Paul Adams, Ted Bailey and Secretary Andrea Deachman

Chairman Scott called the meeting to order at 7:15pm and requested the Board to review the minutes of December 4, 1997.

Motion was made to accept the minutes as written.

PUBLIC HEARING:                 IMPACT FEES
                                        TOWN OF CHICHESTER

Many towns people were on hand to discuss impact fees and some of the questions were as follows:

How are impact fees kept?  Impact fees must be kept in escrow accounts and if the money is not used for what was intended in a certain amount of time the money will be returned to the current land owner.

Could part of the money be refunded?  Yes, if something is not built or bought.

What  are the administrative cost going to be? Somewhere around 3 percent of the impact fee.

Will commercial development be exempt?  Yes it has minimal impact to the town and we want to encourage commercial development.

Would an elderly couple be subject to impact fees?  It would be up to the Selectmen to decide this after someone has come in for a waiver.

Has the town lawyer seen this document?  No, not as of yet.

Don’t you feel the impact fee should be collected before certificate of occupancy?
Yes, the Board feels that would be an appropriate time to collect the fees.

The two Selectmen wanted the Board to be informed that the Board of Selectmen are opposed to the impact fees.

Formal request to remove the waiver was made.

Motion that the draft copy of the impact fee ordinance  will be delivered to an attorney at the Municipal Association for review and comment and the document will be revised and voted on at public hearing February 2, 1998.

PUBLIC HEARING:                 ZONING ORDINANCE CHANGES

Article II, Home Occupation
j.  All uses allowed in district R except Commercial

This was put to public hearing to clear up conflict in the zoning.

Public discussion on how this could cause hardship on the loops on route 28.

Motion was made to strike Article II Home Occupation j. change

Motion to accept as reads and present to the town.

PUBLIC HEARING:                 Nolin/Keeler
                                        Lot Line Adjustment
                                        Map 6, Lots 20 & 21
                                        Canterbury Rd.

Abutter:  James Winslow

Webb Stout Registered Land Surveyor presented the Board with final plans  with the two corrections requested.  Lot line Adjustment and well protection area on the plan.
The Board was read Article 4 of zoning ordinances, non conforming uses and has determined that the alteration is NOT substantially different.

Motion was made to accept the Lot Line Adjustment

PRELIMINARY HEARING:                    Rob Court/Norman Fauteux
                                                Multi-Use
                                                Map 4, Lot 155C, Cross Rd.

Abutter:  Paul Dupont

Joseph Wichert Registered Land Surveyor presented the Board with preliminary plans.

Parking spaces are an issue there will need to be what the regulations state for each square foot of floor space.

The garage has no floor drains so hazardous waste will handled with drying compound and disposed of properly.

Mr. Wichert needs to go thru the site review checklist and complete the plan.

The Board would also like to see the dumpster with the scrap metal on the plan.

The Board suggested that the fire chief see the plan to make sure fire apparatus will have proper access to the property.

Note #4 on plan is an issue but will not delay the site plan approval.

Public hearing will be set for Monday February 2, 1998.

DISCUSSION:                     Mike Anderson
                                        Building with Rental Units
                                        Map 4, Lot 160, Dover Rd


Mr. Anderson presented the Board with some sketches of his property and what he would like to do.

Mr. Anderson would like to build a 3600 square foot building for retail rental units.

The Board informed Mr. Anderson he would first need a subdivision and then a site review.

DISCUSSION:                     Larry Ricker

                                        Map 3, Lot 94, King Rd.

Mr. Ricker would like to subdivide his property.

He has 14 acres of land but only 300 foot frontage on King Rd. he would like to build a road into the land so he would have enough frontage for both lots.

The Board informed him he would need a town approved road with cul-de-sac and proper frontage before they could go forward with a subdivision.



DISCUSSION:                             Bob Seavey/Campers Inn, Inc.
                                                RV Sales
                                                Map 4, Lot 166, Dover Rd.

Bob Seavey representing Campers Inn, Inc. would like to start a business of RV sales with a building between 8 and 9000 square feet.

He will start with selling pop up tent trailers and travel trailers.

The Board Suggested he check with district 5 about the driveway.

Mr. Seavey will continue with the site review and be in contact when he is ready.

The Board was in agreement with a reproducible mylar to be registered with the register of deeds as we have been doing.
