Minutes of Meeting
Tuesday, November 10, 2015

Members Present: Richard DeBold, Jeff Jordan, Town Administrator Jodi Pinard

Others Present: John Freeman, Chief Clarke, Chief Quimby, Donna Chagnon, Alan Mayville, Tom Houle, Lucille Noel, Bernie Reinhardt, and others members of public

Call to Order:  Mr. DeBold called the meeting to order at 6:30pm

Appointments:

Department Heads

Forest Fire – Stephen Stock stated that on Halloween we had an outside fire that was unextinguished. There was still smoke being seen in the morning after the fire was supposed to be extinguished. I called the resident and explained that he may receive a bill for the department extinguishing the fire. The resident had the feeling that he could not put a fire out in the amount of time that was allotted on the permit. After I put the bill together the resident may come in and voice his feelings.  I just wanted to let the Board know what had happened.

Building – John Freeman stated that we have had 11 permits since the last time we met. Last week I got three solar array permits in one day. Income was roughly $960. I am requesting a leave of absence from January 1 to March 31, 2016. It is a medical reason. I suggest that Matt Cole be my assistant while I am gone as he does basically the same inspections and we work together on a lot of things.

Mr. DeBold asked about having to a certified inspector. As well as asked Matt if he comfortable with taking this over for a few months.

Mr. Freeman stated that there is no requirement for a certified inspector.

Matt Cole stated that he does not have any issues with doing this.

Mr. DeBold stated that we would most likely discuss this as a full Board.

Mr. Freeman stated that this is a Leave of Absence and he anticipates coming back on April 1st.

Police – Mrs. Pinard spoke with Chief Clarke, he was not feeling well. He stated there was nothing to report.

Highway – Jim Plunkett stated that Frank Merrill finished the binder coat on the subdivision roadway. The road going to Perry Brook is the only road that does not have binder. The main road and the three circles are completed. I have to move a telephone pole on Perry Brook and I have been in touch with PSNH. This pole narrows the roadway. The new hire is working out well. We are on the south side of town grading. Blackman Road bridge was hit. We are working on estimates for insurance purposes. I spoke with Mrs. Blackman and she is fine with the process that we will be following. I did inform her I was not sure if it would be repaired by winter. The quote will be for putting it back to the way it was prior to being hit. I’ve been working on the budget and warrant articles. We will be working on potholes and trees next week. Everything is ready for snow.

Emergency Management – John Martell stated that he had nothing to report.

Fire – Chief Quimby stated that we are working on the budget and warrant articles. I am requesting a non-public session with the Board next week due to the reputation of someone other than the public body itself.

Library – Lucille Noel stated that is working on the budget and our last book sale will be on the 21st. December 5th we have the Pontine Theatre coming. We met yesterday with Bruce Mason and discussed the lift at the Library. We are moving ahead with that to get some proposals. We would like to appoint Mary Jane Colbert as a Trustee Alternate.  
        
Public Hearing - Comcast Franchise Agreement - Pursuant to RSA 53-C: 3-a Franchise Applicant Considerations. – No municipality shall grant a franchise for cable service to a cable system within its jurisdiction without first, at a duly noticed public hearing

Mr. DeBold read the public notice and opened the public hearing at 6:55pm.

The agreement was reviewed.

There was no public input.

Closed hearing at 7:02pm.

A motion was made by Mr. DeBold and seconded by Mr. Jordan to enter into the Comcast Cable Franchise Agreement beginning November 20, 2015 thru November 19, 2020. Motion Passes

General Business/Board Discussion:

Public Input
Debbie Marden stated that she is very disturbed by the letter in the paper. The tax deed had been presented three times to this Board, why has this guy been able not to pay while five other properties were tax deeded. I want to know what the dates were and what the reasons were.

Mr. DeBold stated that on September 30th Chichester Condominium Corporation paid $38,620. This paid all the taxes for 2009-2012 no penalties and interest were included as they were waived per the agreement made. 2013 taxes, penalties and interest have been paid. Part of 2014 has been paid. It was Mr. Paveglio and Mr. Jordan that made the agreement that would waive the penalties and interest for those years. I felt there was already an agreement in place that the Board had agreed too.

Mr. DeBold stated that the reason I was never in favor taking this property for one is the materials that have been put on this property. The agreement that had been signed regarding these materials refers to the land not being used for certain things. That tells me that the soil that has been placed up there has issues. I did not feel comfortable about the town taking the liability of that issue. Number 2 is the confounding amount of ownership issues that are associated with this piece of property.  I was not comfortable taking this property. Whatever we could do to get the taxes back and not have the liability that was good enough for me.

Mr. Mayville stated that why did the Town lawyer said take it?

Mr. DeBold stated that there is a misconception about the attorney’s opinion. He stated that we could accept the deed for the property legally but his opinion did not address the issues associated with the property

Mrs. Marden asked what is the BTLA?

Mr. DeBold stated that that is the Board of Taxes and Land Appeal. The BTLA agreed that the Town had over assessed his property.

Mr. Jordan stated that the reason I did what I did was he was completely over taxed considering how over assessed he was.

Mr. DeBold stated that we tried to work with Mr. Steed. Regarding the Head property the town lost money. On the tax deed for the mobile home the town lost money. I as a selectmen will only look at case by case and their merits.

Debbie Marden stated that she felt that regarding tax deeding properties the Board should have public hearings and it should not just be the Boards decision.

Mr. DeBold stated that Board reviews the tax deeds as they are presented to them and it is not until the Town Clerk Tax Collector presents them that they are discussed.

Non-Public Session 91-A:3 II (b) The hiring of any person as a public employee

A motion was made by Mr. Jordan and seconded by Mr. DeBold to enter into non-public session under RSA 91-A:3 II (b). DeBold Aye, Jordan Aye. Motion Passes.

A motion was made by Mr. DeBold and seconded by Mr. Jordan to exit non-public session DeBold Aye, Jordan Aye. Motion Passes

A motion was made by Mr. DeBold and seconded by Mr. Jordan to seal the non-public meeting minutes indefinitely. Motion Passes

Adjournment
Being no further discussion, a motion was made by Mr. Jordan and seconded by Mr. DeBold to adjourn the meeting at 8:10 pm.  Motion passes
