CHICHESTER BOARD OF ADJUSTMENT MINUTES
OCTOBER 25, 2006

Case #204-Thomas & Christine Addington, Map 9 Lot 54-1, requesting a special exception to Article III, Section P. 5.f. to increase the dwelling size of existing use by 156 sq. ft.

Members Present:  Edward Meehan, Chairman; Stephen MacCleery, ex-offico; Ben Brown, Mark McIntosh, David Dobson, & Tom Wainwright.
Voting:  Ed Meehan, Steve MacCleery, Ben Brown, Mark McIntosh & David Dobson.

The applicants would like to upgrade their current home with a new one which is approximately 156 sq. ft. larger.  They were denied a permit from the building inspector because of the issue of wetlands.  They have lived on the property for 6 years.  They will not impact wetlands since they are on the out skirts of the property.  The current manufactured home is 14x52 and the new one will be 24x36.  It will sit on a slab and be moved closer to the residential zone and away from the wet area.  Site plan was submitted showing where the new location of the home will be placed.

At this time Ed Meehan brought to the board’s attention that he had done veterinary work for the applicants in the past.  The members did not feel that Ed had a conflict of interest and could continue to chair the meeting and be a voting member.

Abutter Tom Downey had no objections to this special exception.  Abutter Deb Lacross felt this would be an improvement to the neighborhood.  

BOARD DISCUSSION

Board felt the proposed use will not be injurious or detrimental to the neighborhood because they are replacing an existing manufactured home with a new one that has approximately 156 additional square feet of living space.  The home will be on a slab versus blocks.

The proposed use will not make an excessive demand on municipal services any more than the existing home does, or generate additional traffic.

This will not have an adverse impact on the natural environment or Chichester’s groundwater resources because the home is being moved further away from the wetlands and the wetland buffer is being increased.

It was asked when the old home would be removed and the applicants stated when the new one is delivered.  The board felt it should set a time limit of removal within 90 days of delivery of the new home.



MOTION
Steve MacCleery moved to grant the special exception requested by Thomas & Christine Addington, Map 9 Lot 54-1, to Article III, Section P 5.f. to increase the dwelling size of existing use by approximately 156 sq. ft. for the following reasons:
  The proposed use will not be injurious or detrimental to the neighborhood because they are replacing an existing manufactured home with a new one that has approximately 156 additional square feet of living space.  The new home will be on a slab versus blocks.
  The proposed use will not make an excessive demand on municipal services any more than the existing home does.
  The proposed use will not generate traffic volumes that will overburden existing roads and highways any more than the existing home does.
  The proposed use will not have an adverse impact on the natural environment or Chichester’s groundwater resources because the home is being moved further away from the wetlands and the wetland buffer is being increased.
  The old manufactured home will be removed within 90 days of delivery of the new home.
