Minutes for November 2, 2011 Selectmen’s Meeting

Members Present:  Peter E. W. Burns, Robert C. Libby, Jean C. Harmon, Dianne M. Senechal.  Clifford L. Emery was absent.

Others Present:  Mike Grovo, Jack Hanna, Rep. Donald Pilon, David Harmon.

Special Town Meeting – 7:00 p.m.
Town Clerk John Myers called the meeting to order at 7:00 p.m., and read the Warrant.  Hiram Davis was voted and sworn in as Moderator.  No questions or comments from the public.  Affirmative vote for Article 2 to reconcile accounts.  The meeting adjourned at 7:08 p.m.

  • Approval of Prior Meeting Minutes
Selectmen Meeting Minutes October 26, 2011.  
Approved 4-0-1



  • Discussion held between 5:00 & 7:00 p.m.
The Board discussed trash pick-up, mailboxes, plowing, and some other things.  The Selectmen also talked about whether or not they had done an Executive Order hiring our new Treasurer.



  • Review of Correspondence
  • Email from Kate Dufour at Maine Municipal Association – Re:  2010 Municipal Fiscal Survey Report.
  • Email from Tom Reinauer, Transportation Director at So. ME. Regional Plan Commission – Re:  DOT Municipal Partnership Initiative.
  • Letter from the Clyde Russell Scholarship Fund – Re:  information about the Scholarship and the application process.
Selectman Burns read a letter from Maine DOT regarding the Route 112 Buxton-Saco Project #STP-9493(100) X, WIN 009493.10, advising that the contractor on this project is Pike Industries, Inc., 145 River Road, Lewiston, ME 04240.  The Resident representing Maine DOT is Christopher Gallant.  There will be a field office located on this project and Chris can be reached through his cell phone number (207) 215-2715.  Residents and property owners adjacent to this project may contact Chris for information in connection with this project, or contact LaRay Hamilton, Project Manager I at (207) 592-1367.



  • Review of Projects and Issues
Selectman Libby has been busy with calls about mailboxes, abatements, and some Veteran Exemptions.

Selectman Harmon talked about calls from the storm and the power outage.  If there is a power outage resulting from a storm; residents who rely on electricity for medical reasons can call Buxton Dispatch to ask if the Emergency Shelter is open.  The Shelter was opened during the recent storm for a resident who needed power for medical equipment.

Selectman Senechal said the walls have been painted at Groveville Fire Station, and the new floor should be done by Friday.  She mentioned work that has started at Berry Library, and provided information from the Recreation Director about discounted tickets that are available through the Rec. Department for Portland Pirates ice hockey games.  

Selectman Senechal reminded everyone that Absentee Ballot voting will end tomorrow at 4:00 p.m.

Selectman Burns has been busy keeping up with mail and responding to residents who have issues.

  • Old Business
Selectman Burns updated people on the Public Hearing regarding trash pick-up on private roads.  Some areas could not be changed.  He said there will be no change on roads around Bonny Eagle Pond because of the density of that area.



  • New Business
Selectman Burns read the following information that is posted on the Town’s web site:  “The Town will not replace or reimburse for regular or custom made mailboxes, ornate posts or granite posts, etc., or existing mailboxes with rotted posts or in obvious poor existing condition.  Maine law views mailboxes as an encroachment in the public way put there at the owner’s risk and municipalities are not legally liable for any damage or repairs to mailboxes due to plowing operation.”



  • Executive Orders
E.O.111211003 – An order to appoint Charisse Keach to the position of Treasurer effective November 1, 2011 until replaced.  Approved 4-0-1.

E.O.111211004 – An order to approve a Supplemental Tax Warrant in the amount of $1400.00 for Map 3-49.  Approved 4-0-1.

E.O.111211005 – An order to accept the appointment of Hiram R. Davis as the Election Warden for the State of Maine’s Referendum Election to be held on November 8, 2011.  Approved 4-0-1.

E.O.111211006 – An order to approve 8 hours sick leave for Charisse Keach.  Approved 4-0-1.

E.O.111211007 – An order to approve John Myers’ attendance at the E.D.R.S. Training workshop.  Approved 4-0-1.

E.O.111211008 – An order to approve an Application for Veteran Exemption for [Map 4, Lot 11].  Approved 4-0-1.

E.O.111211009 – An order to approve Abatement of Real Estate Taxes in the amount of $329.60 for Map 9, Lot 6-21.  Approved 4-0-1.

E.O.111211010 – An order to approve an Application for Veteran Exemption for [Map 2, Lot 42-5].  Approved 4-0-1.

E.O.111211011 – An order to approve the Carry Forward Amount of $112,473.69 for Fiscal Year 2011 as shown on the report dated 10/17/2011.  Approved 4-0-1.

E.O.111211012 – An order to approve Charisse Keach’s attendance at the MMA Municipal Law for Tax Collectors and Treasurers Workshop.  Approved 4-0-1.

E.O.111211013 – An order to approve 16 hours vacation time for John Myers.  Approved 4-0-1.

  • Accounts Payable and Payroll Warrants
E.O.111211001 – An order approving expenditures as documented in Accounts Payable Warrant #43.  The total Warrant was $28,900.  Approved 4-0-1.

#42.  Approved 4-0-1.



  • Next Meeting of the Board
Comprehensive Plan Meeting Thursday, November 3, 2011 at 6:00 p.m., in the small conference room at the Town Office.

Special Town Meeting November 8, 2011.  Polls will open at 6.00 a.m. and will close at 8:00 p.m.

Selectmen’s Meeting Wednesday, November 9, 2011 at 7:00 p.m.

The State of Maine will conduct a Liquor License Appeal Hearing on the appeal of the Town of Buxton Liquor License denial of William Ham, d/b/a Skip’s.  The Hearing will be held at the Town of Buxton Municipal Building, 185 Portland Road, Buxton, Maine on November 16, 2011 at 11:00 AM.

Friday, November 11, 2011, is a holiday.  The Town Office will be closed.



  • Other Business
We would like to remind people about our schedule for Thanksgiving week:  There will be no Selectmen’s Meeting and no evening hours during the week of Thanksgiving.  Town Office will be open Monday, November 21st through Wednesday, November 23rd, from 8:30 a.m. to 4:30 p.m.  We will be closed Thursday & Friday, November 24 & 25th.  The Transfer Station will also be closed Thursday & Friday.  They will be open Saturday, November 26th.   There will be no curbside trash pickup on Thanksgiving Day so Thursday pickup will take place on Friday.

There will be a Rabies Vaccination Clinic Saturday, December 3, 2011, from 1-3 PM, at the Buxton Public Works Garage.  The cost is $8.00 per Vaccination – Cash only.  All dogs must be on a leash and all cats must be in carriers.  Please bring the previous Rabies Vaccination Certificate.  Flyers are on the counter at the Town Office.  For more information call the Buxton Town Office at 929-6171.



  • Public Comments and Questions
Chief Grovo reported that the Prescription Drug Take Back day went off without a hitch.  The amount of take back was down a little from last year.  He said Halloween night also went okay aside from the usual pranksters.  He shared statistics for last week and said there were 253 total calls for the week.

Selectman Burns spoke briefly about the Elden Store/EMA building saying that the trees are down, the doors have been painted, and there is a new sign on the Haines Meadow Road side of the building that looks very good.  He encouraged folks to stop by and take a look.
