Minutes for April 28, 2010 Selectmen’s Meeting

Members Present:  Jean C. Harmon, Daniel T. Collomy, Linda W. Pulsoni and Peter E. W. Burns.  Robert C. Libby was absent.

Others Present:  Robert Elwell, Olive Collomy, Dennis Santolucito, Stacey Breault, Keith Emery, Larry Miller, David Harmon and Peter Pinkham.

Public Hearing – 7:00 p.m.

Liquor License renewal for Stacey and Randy Breault, Inc., DBA Chefa’s Catering

Chairman Harmon opened the Public Hearing at 7:03 p.m. by reading the Notice of Public Hearing for a Liquor License renewal for Stacey & Randy Breault doing business as Chefa’s Inc. Catering.  The Meeting was opened for comments from the Board of Selectmen.  There were no comments/questions from the Board.

The Chair asked if there were any comments from the Public.  Dennis Santolucito asked if the owner of the business would speak about the operation.  

Owner, Stacey Breault stated that she started the catering business two years ago.  The business is located on Portland Road and what she is requesting is her annual renewal of her liquor license so she can serve liquor at weddings and other functions.  When she does cater weddings or other functions, she obtains another license in the Town where the function is located.  She stressed she is not a bar or a tavern.

The Public Hearing closed at 7:05 p.m.

  • Review of Projects and Issues
Selectman Pulsoni reported that the Selectmen held a Workshop on Monday to review the budget information in the Warrant.  

She also reported that the same problem Buxton is encountering with attendance to the Annual Meeting appears to be happening in Montville a town of 1,000 residents with 63 people at town meeting, Liberty with a population of 900 with 60 people attending town meeting and Morrill another small town with a population of 890 and 55 people attending town meeting.

Selectman Pulsoni also reported that lottery tickets sales are highest in the poorest counties in the State of Maine.

Selectman Collomy reported that he has been working on the Warrant.

Selectman Burns reported that he has been working with Mike Edgecomb at Time Warner regarding the renewal contract.  Selectman Burns worked with Fred Farnham and made sure that all of the Town of Buxton is cable ready and there is easy access for the new housing developments.  Selectman Burns reported there will be a Public Hearing on May 22 at the Buxton Town Hall regarding the renewal of the Franchise Agreement.

Selectman Burns reported on the totals for the Warrant Articles.  The Municipal Budget is $4,587,758.50, Buxton’s portion of the County Budget is $391,339.00 and the School Budget is $5,228,137 for a total budget amount of $10, 207,234.50.

Selectman Harmon reported she has finished the Warrant.  She also reported the water quality report came back indicating that the arsenic problem has been solved with the new filter system but the sodium is significantly higher than acceptable.  Fred Farnham is seeking a solution.

Selectman Harmon also reported that she will be working with Roger Kelly the Town’s Police Union negotiator next Tuesday at 10:00 a.m.  There have also been emails with complaints about Route 4A and the speed limits on State Roads.

  • Old Business
Antenna at Buxton Center – Partners are getting together and should be ready next week.

Designated Smoking Areas – Done, will review Monday night.

Public Work Garage Floor Sealing – No change.


  • New Business
Selectman Pulsoni reported that there are tickets available for the May 20th Fenway Park Red Sox game.  Tickets are $75 and the price includes the bus and the game.  The bus will be leaving the Town Office at 3:30 p.m. on the 20th.

Selectman Harmon reported that the Town had heard back from the DOT regarding the speed limit on Spruce Swamp Road and Waterman Road.  One of the issues was that the speed limits were inconsistent.  Different areas have limits of 35 mph and 40 mph.

E.O.091004025 – An order to enter into an agreement between the Town of Buxton and Richard Wing & Son to Harvest Trees at Pleasant Point Park.  Approved 4-0-1.

E.O.091004026 – An order to approve Larry Anderson, Keith Emery, Ed O’Neil, Tom Kennie and Mike Pulsoni’s attendance to the Highway Congress.  Approved 4-0-1.

E.O.091004027 – An order to appoint Jane Cummings, Ruth Scheibenpflug, Bette Robicheaw, Joan Berry, Patricia Morrison,  Burton Pease, Barbara Pease, Shirley Libby, Sharleen Fields and Sandra Mergen to the position of Ballot Clerk effective until completion of the May 4, 2010 election.  Approved 4-0-1.

  • Other Business
A candidate’s night has been scheduled for 7:00 p.m. May 18 here at the Municipal Building.  All candidates running for an elected office are invited to participate.  The event is sponsored by the West Buxton Public Library.


  • Public Comments and Questions
Les Volland will be easing out of the position of Camera Operator and the Town is looking for camera operators.  The Editor of the Buxton News is moving and the Town is looking for a Newsletter Editor.  There are also openings on the Comprehensive Plan Committee.

Dennis Santolucito made an observation regarding the State’s numbers published in the Portland Press Herald that since 1979 the student population has decreased by 16% and the cost for education per student has increased 451% per student.  Maine has a student teacher ratio of 11/1 while other states have 14/1 ratio.

Dennis Santolucito commented how nicely the Budget Committee had worked this year.  There was only one item that the Budget Committee had a major difference and that item was the amount to be spent on paving.  The Budget Committee recommended $190,000 and the Selectmen recommended $20,000 for the upcoming year.

Dennis also wanted to know if the Selectmen could contact Representative Rob Hunt to see if he could do something at the State level about Route 4A.

Peter Burns stated that in his 8 years on the Budget Committee this was the first time that the Budget Committee recommended more money be spent than the Board of Selectmen.

Larry Miller also noted that Route 4A was bad and asked of the Board could follow up with the State.

Larry Miller stated that MSAD #6 enrollment situation has not declined and has increased in the past few years.

Larry Miller read a prepared statement regarding the State Department of Education information and the costs of instruction, administration and maintenance.  He stated that 286 school districts are listed for fiscal year 2008-2009, and ranking from high-to-low per pupil costs MSAD 6 is No. 225 meaning that 78% of all districts have per pupil costs higher than SAD 6.  The State average per pupil cost is $9,625 whereas the average cost for SAD #6 is $8,593 per pupil.

Larry Miller stated that if the District’s budget is passed as proposed, the tax assessment to Buxton will be approximately $5,228,000 an increase of about $239,000 over the current fiscal year.  

Larry reminded everyone that the District Budget Meeting is Thursday evening, April 29, 2010 at the Middle School Gym at 7:00 p.m.

Robert Elwell questioned the underground tanks at the Public Works Garage and if they were still leaking.  He wanted to know if the tanks installed were the ones that were
originally designed for the building.  Selectman Harmon stated that she would have to look into the issue and get back to him.  Robert also wanted to know if the tanks were still leaking.
