Minutes for November 18, 2009 Selectmen’s Meeting

Members Present:  Jean C. Harmon, Daniel T. Collomy, Robert C. Libby and Linda W. Pulsoni.  Peter E. W. Burns was absent.

Others Present:  Mike Grovo, Robert Elwell, Jack Hanna, Keith Emery, David Pinkham, Dennis Santolucito, Mike Pulsoni, Olive Collomy, Steve & Lori Anthony, Larry Anderson, Bruce Mullen, Robert Hunt, Peter Pinkham, Tashia Geaumont, Fred Farnham and Hiram Davis.

Special Town Meeting – 700 p.m.

The Special Town Meeting was called to order at 7:00 p.m. by Town Clerk, John Myers, Jr.  Hiram Davis was elected moderator.  

Article 2, reconcile $2,115.08 and Article 3 to purchase a $25,000 generator passed as written.  The Meeting adjourned at 7:10 p.m.

Public Hearing Automobile Graveyard or Junkyard 7:15 p.m.

Public Hearing – Renewal of Automobile Graveyard or Junkyard Licenses.
Chairman Harmon opened the Public Hearing at 7:16 p.m. by reading the Notice for the Public Hearing for Automobile Graveyard or Junkyard licensing.  Chairman Harmon opened the Meeting to the public for comments.  

There were no comments and the Meeting closed at 7:17 p.m.


Public Hearing Liquor License Renewal – 7:20 p.m.

Chairman Harmon opened the Public Hearing at 7:18 p.m. by reading the Notice for Public Hearing for a Liquor License Renewal for Personal Touch Catering.  Chairman Harmon opened the Meeting to the public for comments.

There were no comments and the Meeting closed at 7:19 p.m.

5:00 p.m. – Fire Chief Bruce Mullen – discussed training paramedic, participating in Flu Shot Clinics, upcoming budget, IMC computer program system.

The Selectmen went into Executive Session at 6:20 p.m. per 1 MRSA 405 (6)(A) and came out at 6:50 p.m.

Selectman Libby reported he was getting caught up from the prior week.
Selectman Collomy reported that the grinding of cement by the doors at the Public Works Garage was complete and they were recommending salt guard for protection.
Selectman Harmon reported that she had been working on the Special Town Meeting.

  • Old Business
Town owned property for sale – will revisit later in the spring.

Public Works Garage grinding – grinding done, needs salt guard.

Antenna situation at EMA building – Police Chief will be meeting with the owner of the Buxton Center Tower after Thanksgiving.

Installation of Plexiglas in front office – gathering data from other towns.

Repair Church Hill Salt Shed – Public Works will be repairing the damage to the door done by the salt mixture.

  • New Business
The Town Office will be open on Wednesday, November 25, from 8:30 a.m. to 4:30 p.m.  The Office will be closed for the Holidays on November 26 & 27th.  There will be no evening hours during the week of Thanksgiving.

There will be no curbside pickup on Thanksgiving Day.  The Thursday pick up will be done on Friday.

E.O.091011016 – An order to approve an Application for Veteran Exemption for
[Map 2, Lot 82].  Approved 4-0-1.

E.O.091011017 – An order to approve an Application for Exemption for [Map 1, Lot 5-1] from Local Taxation for a Widow of a Deceased Veteran.  Approved 4-0-1.

E.O.091011018 – An order to approve a Poverty Abatement for Case No. PA09-008.  Approved 4-0-1.

E.O.091011019 – An order to approve 8 hours of vacation time for Dianne Senechal.  Approved 4-0-1.

E.O.091011020 – An order to approve a new road name ‘Eastwind Drive’ which will serve a new housing development off Portland Road.  Approved 4-0-1.

E.O.091011021 – An order to approve an Abatement for Real Estate taxes for fiscal year 2009 in the amount of $242.55 for [Map 19, Lot 14-1].  Approved 4-0-1.

E.O.091011022 – An order to approve the applications for a non-transferable automobile graveyard or junkyard for those entities listed on the Notice of Public Hearing dated October 28, 2009.  Approved 4-0-1.

E.O.091011023 – An order to approve the Liquor License Renewal for Kevin and Sundae Fallen doing business as Personal Touch Catering.  Approved 4-0-1.

  • Other Business
York County Community Action is still taking applications for fuel assistance through the LiHeap Program.  Applicants must pay their own heat and not live in subsidized housing.  To make an appointment, call 1-800-965-5762.

The Charter Commission still has Resident Surveys available at the Town Office and on the Town’s website and is requesting input from the public on Buxton’s form of government and any changes the residents would like to see made to the Town’s Charter.  All Surveys should be returned to the Town Office by December 9, 2009.

The Buxton Toy Box started taking applications on Tuesday November 17.  Applicants can apply Tuesday, and Thursdays between 1:30 – 3:00 p.m. and Friday morning from 9:00 – 11:00 a.m.  Applications can be picked up the week of November 23th but cannot be submitted to the program until the week of November 30.

There will be a free Thanksgiving Dinner at the Pythian Sister Hall on Route 22 on Thanksgiving Day starting at Noon.

  • Public Comments and Questions
Peter Pinkham asked how long the warrantee would be extended for the grinding work that was done at the Public Works Garage.  The Selectmen indicated the work would be guaranteed for an extended length of time when finished.

Peter asked Representative Hunt about the contract work that was finished by Pike Industries ahead of schedule and the company got a 2 million dollar bonus.  

Representative Hunt stated that he was not aware of the bonus but he would check into it and get an answer.

Robert Elwell questioned the $7,000 for the generator that came from the Town Garage Building Account and why there was money in the account.  Selectman Harmon stated that some work that had been done by Emery Brothers was not charged for and some money was left in the account.

Robert asked about H1N1 and availability to the public.  There is no cost to the SAD 6 students who received the H1N1 shots and no word when the vaccine will be available to the public.

Robert asked about the salt guard that was going to be used on the groves in the Public Works Garage and if perhaps the whole floor should get the same treatment.

Dennis Santolucito asked Representative Hunt if the State curtails spending now to the end of the year what the impact will be on the School Districts.

Representative Hunt stated that the State projects a short fall of 400 million due to the economy.  Last year stimulus money was used to bridge the shortfall with the schools and the State notified the schools that there would be a shortfall this year.  The exact amount has not been projected.



Jeanette Fernstrom read a card from an unknown individual who passes by her house each morning that stated that the patriotism shown by the flags was uplifting and the card thanked the soldiers serving America.  Jeanette wanted to thank the individual who left the card, she very much appreciated it.

Fire Chief Bruce Mullen stated that he hoped Representative Hunt would work hard not to cut money for Buxton.

Chief Mullen presented some highlights from his Department.  There is an individual who is training to be a paramedic and the Town is paying for the education.  An individual is being trained to become and EMT Intermediate.  The Town is paying for the class and the books.  

The Paramedics are assisting with the H1N1 vaccinations at the SAD 6 district as there is a 15 minute wait time required to make sure there is no reaction to the vaccination.  The Chief also reported that he has ordered vaccine for his first responders and will be notified when it is ready.  The Chief reported he is tracking the cost his Department is providing for the vaccine standby in case there is some reimbursement from the government.

Chief Mullen thanked the Board for the open and frank discussion regarding budgeting for the upcoming year.  He also stated that the Fire/Rescue Department is working with all other Town Departments to get ready for the winter months.

Tashia Geaumont reported that the Recreation Department coordinated a Thanksgiving Dinner for the Town employees and the residents who participate in the Community Cares program.

Tashia reported that the Town is sponsoring a Blood Drive on Wednesday, January 6 from 11:00 to 4:00 p.m. at the Town Hall meeting room.

Tashia also reported that she is the Chairman of the Community Day event that is scheduled for July 23 and 24.  The theme is Home Town Heroes.

Police Chief Mike Grovo thanked everyone for the help they provided to capture the individual who was wanted by the U.S. Marshalls.  The Chief stressed there was never any danger to the public as the individual did not like law enforcement personnel.  The individual did turn himself in later in the week.
Chief Grovo stated that he would be speaking with the owner of the Tower in Buxton Center next week.
The Chief also notified the public that there were some graffiti bandits in Town and he reported that the Police were on alert as they seem to hit after dark.  Several Town buildings have been vandalized.  The bandits appear to be well organized and are in and out very fast.
A resident of Pinder Road read a prepared statement regarding Map 6, Lot 7 where a mobile home has been placed and the resident believed the mobile home did not meet the code requirements for the Town.  There was some concern about the material that was used under the mobile home as a pad, the lack of electricity, water and sewerage.  The resident indicated that the land required DEP approval before it could be used for a residence.  The resident was advised to work with the Code Officer and contact the DEP regarding the situation.
