Minutes for June 10, 2009 Selectmen’s Meeting

Public Hearing -- Victualer Licensing

Selectman Harmon read the Notice of Public Hearing for Victualer Licensing and the Hearing was opened at 7:01 for comments from the Public and the Board of Selectmen.  There were no comments and the Hearing closed at 7:02 p.m.

The Meeting was called to order at 7:03 p.m.

  • Pledge of Allegiance

3.      Approval of Prior Meeting Minutes.

Selectmen’s Meeting Minutes June 3, 2009.  Approved 5-0.


  • Discussion held between 5:00 & 7:00 p.m.
5:00 p.m. – Anne Robishaw discussed tax acquired property and on line registration of boats using debit and credit cards.

5:30 p.m. – Marina Salang discussed property on Seavey Drive which abuts property owned by the Town.  There will need to be a land exchange and a Special Town Meeting to handle the exchange.

The Selectmen went into an Executive Session at 6:25 p.m. and came out at 6:30 p.m. per
1 M.R.S.A 405 (6) A.  They went into another Executive Session at 6:31 p.m. and came out at 6:50 per 1 M.R.S.A. 405 (6) A.


  • Review of Correspondence.
  • Email from Geoff Herman, Maine Municipal – Re:  LD 1432 a bill regarding the creation of a registry of “recreational saltwater” fishing
  • Memorandum from John J. Sylvester, Chair, Twelve Town Group – Re:  Next Meeting Monday, June 15 at 6:30 p.m. at Waterboro Town Hall
  • Bulletin from Maine State Planning Office – Re:  Floodplain Map Meetings scheduled for Cumberland and York counties – June 22 and 23

  • Review of Projects and Issues.
Selectman Libby reported that he is preparing numbers for the upcoming Annual Meeting.

Selectman Emery reported that he spoke with David Pinkham regarding the paving at the Public Works Garage.  Selectman Emery also attended a Maine Human Rights hearing on Thursday.

Selectman Harmon reported that 476 people voted and there were 68 Absentee Ballots cast in Tuesday’s election.  Selectman Harmon reported that she had spoken with the Town’s attorney and the Selectmen have 30 days to appoint representatives to the Charter Commission which passed in Tuesday’s election.  She stated that the Scarborough Town Manager had offered his services to the Committee.

8.      New Business.
        
        Selectman Harmon said that the Boy Scouts would be providing lunch at the Town Meeting and they would also provide the flag presentation.




  • Executive Orders.
E.O.080906020 – An order to approve a Poverty Abatement for Case No. PA09-001.  Approved 5-0.

E.O.080906021 – An order to approve Fred Farnham’s attendance to a Plumbing Workshop.  Approved 5-0.


10.     Executive Orders by Initiative.

E.O.080906022 – An order to approve the Victualer Licenses as shown on the Notice of Public Hearing dated June 10, 2009.  Approved 5-0.



11      Accounts Payable and Payroll Warrants.

  • Other Business.

Selectman Harmon thanked Selectman Emery for his years of service to the Town as a Selectman.




  • Public Comments and Questions.
Carol Sanborn thanked the people who supported her in the election for Selectman.

Dennis Sweatt asked about the minimum bid of $60,000 for the property that will be put out to bid by the Selectmen.  Selectman Harmon stated that it would also include a soil analysis that has been done on the property.

Dennis said that he was disappointed in all five Selectmen for putting an item on the ballot that did not get the proper signatures when he was required to go out and get a petition to get an item on the ballot.  He said that he was treated differently.  He stated that he is resigning from the Charter Commission as he would be a hindrance.

Robert Elwell asked about the $2,500 that was being given back to the Town for the paving and how that number was arrived at.  Selectman Emery stated that he had reviewed two bills that were submitted by Dayton Sand and Gravel as that work was performed by Emery Bros.

Robert asked about all the bids for the new Public Works Garage which showed 2,000 yards of fill would be removed and Emery Bros. had only 200 yards of fill being removed.  Robert wanted to know why the extreme difference.  Selectman Emery stated that how his bid was calculated was not open for discussion.  Selectman Emery did state that material that could have been used on the site had to be hauled off due to the late timing of the work being done.

Peter Burns thanked the voters for his election support.  He stated he was disappointed in the turn out of voters but those that turned out were very enthusiastic.

Motion made and seconded to adjourn the Meeting at 7:30 p.m.  Approved 5-0.
