Minutes for June 3, 2009 Selectmen’s Meeting

Members Present:  Jean C. Harmon, Clifford L. Emery, Robert C. Libby, Daniel T. Collomy and Linda W. Pulsoni.

3.      Approval of Prior Meeting Minutes.

Selectmen’s Meeting Minutes May 27, 2009.  Approved 3-0-2.  (Selectmen Emery and Pulsoni were absent)

Selectman Libby stated that he has been handling questions and phone calls.  He has been working with Selectman Collomy identifying poles for more flags.

Selectman Pulsoni reported she had been on vacation.
Selectman Emery reported that he has been working with an attorney on a Maine Human Rights case for the Town.

Selectman Harmon reported that the June Buxton Newsletters are in and have been distributed around Town at banks, supermarkets, and various stores.  The Newsletter is also posted on the Town’s website.

  • Executive Orders.
E.O.080906003 – An order to approve a leave of absence for Joan Weeman from June 23 to July 10, 2009 with no compensation.  Approved 5-0.

E.O.080906004 – An order to approve John Myers attendance to the New England Municipal Clerk’s Institute.  Approved 5-0.

E.O.080906005 – An order to appoint Patricia Morrison to the position of Ballot Clerk effective until the completion of the June 9, 2009 election.  Approved 5-0.

  • Other Business.
TruChoice Federal Credit Union is sponsoring a Community Celebration on Sunday, June 7th from 10:00 – 2:00 p.m.  There will be games, car wash, scavenger hunt, fire trucks, hot dogs and popcorn.  The car wash is a fund raiser for the Buxton Little League and donations are being accepted for the hot dogs and popcorn for the Keep The Heat On Program.

The Selectmen are still looking for a group to provide lunch at the Annual Town Meeting which will be held on Saturday, June 13 starting at 9:00 a.m.



  • Public Comments and Questions.
Bruce Buchanan read a prepared statement regarding his gate that was destroyed by a logger and the disregard for his rights.  He showed the Board of Selectmen a piece from the gate that was destroyed and he wanted to know the difference between a criminal case and a civil case.  Police Chief Mike Grovo responded that he had investigated the incident when it happened and the Police did take a report.  The Chief stated that he had been in touch with the landlord and the landlord stated that at no time did he request the gates.  The landlord stated that he does own the property and he does not own the gates.  The Chief indicated that it is a civil matter between the loggers and Bruce Buchanan.

Robert Elwell stated that he had obtained a copy of the letter from Deluca and Hoffman that was read two weeks ago regarding the shimming and the fine grading work.  Selectman Emery stated that he reviewed the bills and Dayton Sand and Gravel had been overpaid by $2,500 and that amount would be deducted from the final payment to them as they did not do the work.

Robert wanted to know if the property had been re-assessed this year.  The Selectmen said that property is only re-assessed if there is a building permit or the property owner comes in and asks for a revaluation.  Robert questioned why his property had been re-assessed.  Selectman Libby stated that he had been in touch with Bob Gingras and he will get back in touch with Robert as to why his property was re-assessed.

Robert said that after he pulled his property card he pulled the Selectmen’s property cards and found that one of them had a change in the value.  Selectman Emery stated that would be his property as he had requested a review of his property as two acres is wetland.  Selectman Emery said that he has known for several years that part of his land was unusable and he has done nothing about it while he was a Selectman.  As he was stepping down he asked for a re-assessment.

Keith Emery asked about the Comprehensive Plan Committee and where that stood.  The Selectmen stated the one more committee member is needed.  One that had initially said ‘yes’ was no longer available.

Dennis Sweatt asked about the amount that is paid each year for interest on the bond to build the new Town Garage.  He wanted to know if there was a penalty for paying early.  Selectman Harmon stated that she did not know the answer to the question, but she would get it from the Town’s Treasurer.

Steve Anthony asked who determined when a woodlot becomes a wasteland.  Selectman Emery said that it was up to the taxpayer to come to the Town to request changes to property.  The Town does not go out to walk all pieces of property.  The Assessor does a walk through on houses.

Steve asked if the Board of Selectmen were certified assessors.  Selectman Libby responded that a Board member would have to be certified if they spent 75% of their time assessing.  The Selectmen spend less than 75% of their time on that function.

Robert Elwell asked Selectman Emery if he filled out re-assessment paperwork.  Selectman Emery did not realize there was even a form to complete.  He spoke directly to Bob Gingras.

Peter Burns stated that the election was next Tuesday and that there are 6,000 registered voters in the Town.  Last year 61 residents turned out to vote on 5M dollars on the Warrant Articles at the Annual Town Meeting.  Peter would like to see more people involved in the voting process other than Town employees.
