Minutes for April 8, 2009 Selectmen’s Meeting

Members Present:  Jean C. Harmon, Clifford L. Emery, Robert C. Libby, Daniel T. Collomy and Linda W. Pulsoni.

Others Present:  Dave Harmon, Jack Hanna, Larry Miller, Keith Emery, Randy & Stacey Breault, Robert Elwell, Mike Grovo, William York and Peter Pinkham.

Public Hearing Liquor License – 7:00 p.m.

 Liquor License for Stacey & Randy Breault DBA Chefa’s, Inc. Catering

Chairman Harmon opened the Public Hearing at 7:00 p.m. by reading the Notice of Public Hearing for a Liquor License.  The Meeting was opened for comments from the Board of Selectman.  The Selectmen asked where the business was located and how long had it been in Business.  Stacey and Randy stated that the business was located at 405 Portland Road and it was opened in May, 2008.  The applicants stated that business was good and this is the next step for their catering business.  They have to be licensed to serve liquor, but will only be doing so at catered events.  They are not a tavern or a bar.

The Public Hearing closed at 7:05 p.m.

3.      Approval of Prior Meeting Minutes.

Selectmen’s Meeting Minutes April 1, 2009.  Approved 5-0.

  • Discussion held between 5:00 & 7:00 p.m.
5:00 p.m. – Chief Mullen – discussed the joint venture with the Gorham Fire Department.  One issue that needs to be addressed is the land for the proposed building.  There is a parcel of land on Dingley Spring Road that is vacant and owned by three different owners that Gorham will be looking at.  The Selectmen reported that they will also have to meet with the Gorham Town Manager to discuss details.

6:00 p.m. – May Schumacher – discussed the Community Day event which will be held on July 24 – 25 and fireworks.

It was also reported that the employees will be planting a garden through the Wellness Program which Tasha heads up.

  • Review of Correspondence.
  • Notice of Buxton CLYNK Earth Day on April 22nd at 9:00 a.m. at Pleasant Point Park
  • Selectman Collomy read the Notice of the SAD#6 Budget Committee District Budget Hearing which will be held April 30, 2009 at the Bonny Eagle Middle School at 7:00 p.m.
  • Selectman Harmon read a letter from Peter Burns in which he is formally resigning from the Budget Committee and he has two years left on his term


  • Review of Projects and Issues.
The Selectmen reported that they have been working on the Budget and attending Budget Committee Meetings last week and this week.  They will be meeting shortly to vote on budget items with the Budget Committee.

Selectman Collomy reported that has completed a map reading table for the new Public Works Garage and the employees want him to build a picnic table for the Garage.

Selectman Pulsoni reported that she had toured the new Public Works Garage last Thursday and she attended the open house at the EMA building last Saturday.  She was also at the Transfer Station and she wanted to publicly thank the employees who are handling the bottles for the Clynk program.

Selectman Harmon reported that she has been in contact with Carol Morris regarding a representative from Buxton serving on the Gorham East/West corridor study.

9.      Executive Orders.

E.O.080904021 – An order to approve A. Kerry Harrison’s work week as 32 hours effective April 8, 2009.  Approved 5-0.

E.O.080904022 – An order to approve the hire of Ashley Knight as a full-time Dispatcher effective April 6, 2009 at a pay rate of $14.70 per hour.  Approved 5-0.

E.O.080904023 – An order to approve an Application for Veteran Exemption for
[Map 9, Lot 1-6].  Approved 5-0.

E.O.080904024 – An order to approve an Abatement for [Map 3, Lot 95-1] for tax year
2008 – 2009 for Real Estate taxes in the amount of $356.40.  Approved 5-0.

E.O.080904025 -- An order to approve 8 hours of vacation time for Fred Farnham.  
Approved 5-0.  Approved 5-0.

E.O.080904026 – An order to allow the Board of Selectmen to countersign the Warrant and Notice of Election Calling Maine School Administrative District No. 6 Budget Validation Referendum pursuant to (20-A M.R.S.A. Section 1486).  Approved 5-0.



10.     Executive Orders by Initiative.

E.O.080904027 – An order to approve an application for a liquor license for Stacey and Randy Breault DBA Chefa’s Inc.  Approved 5-0.


11      Accounts Payable and Payroll Warrants.

E.O.080904019 -- An order approving expenditures as documented in Accounts Payable Warrant #40-09.  ($68,130.20)  Approved 5-0.

#40-09.  ($40,546.25)  Approved 5-0.

Selectmen’s Meeting Wednesday, April 15, 2009 at 7:00 p.m.

  • Other Business.
Nomination papers are still available from the Town Clerk’s Office for the following positions:  One Selectman, six Charter Commission Members, three Planning Board Members, two School Board Members and one Budget Committee Member.  All candidate nomination papers must be filed in the Town Clerk’s Office by 4:30 p.m. April 27th.






  • Public Comments and Questions.
Police Chief Grovo reported that he had done more research on the Census 2010 process and found that some of the Census workers will be knocking on doors.  Primarily, they will be speaking with individuals where it appears there is more than one family living.  Most of the census work will be checking the physical location.  If any resident has any concerns, please call the Police Department.

Chief Grovo stated that the Buxton Police Department had received a JB Burnes Grant of $18,000 to be used for items the Police Department needed to supplement their current budget.  The Chief indicated that one item that would be purchased is new antennas to improve the dispatch.  The Chief will be submitting official paperwork by May 18 for the grant.

Keith Emery asked about the length of the Budget Committee term vacated by Peter Burns.  The Selectmen thought it would be the two years left on Peter’s term.

Robert Elwell asked about the location of the new Fire Station in Gorham.  The Selectmen stated that Gorham was looking at a parcel of land on Dingley Spring Road.  Gorham is working with Windham and Buxton.  Gorham’s intent is to close four fire stations and work with Buxton and Windham and open two new stations.  The new station that is proposed with Buxton would be 100% built with stimulus money.

Robert wanted to know if the new Town Garage was complete.  The Selectmen stated that the garage is done except for the lights.  Robert wanted to know the total cost.  The Selectmen stated 1.8 million was the total cost.  Robert wanted to know if the method to build it cost less than having a general contractor.  Selectman Collomy said the Town would have to build another garage to find out.  Overall, however the Selectmen felt the least expensive method was used.

Robert wanted to know if the School Budget could go back to being voted on at the Annual Town Meeting.  The Selectmen said it was not feasible under the new method.

Dianne Senechal stated that Representative Rob Hunt would be hosting an informational meeting on Friday, May 17 at 6:00 p.m. at the Buxton Town Office on the proposed Tax Reform Bill.

Dianne questioned the antennas that the Police Department proposed to purchase as Verizon was supposed to put the antenna on their tower and maintain it.  The Chief indicated that the antennas that are being used now are outdated and new ones would be purchased to put on the tower with the grant money.

Dianne asked if the new Gorham/Buxton Fire Station would have full time staffing so the ISO rating of 9 may be lowered for Buxton homeowners for insurance purposes.  The Selectmen said that they had not gotten that far in the process yet.

Dianne announced that there was an excellent amateur photography show at the West Buxton Public Library during the month of April.  Sixteen photographers were exhibiting 90 pieces of work.  Every one is invited during open hours with are Tuesday and Thursdays from 4:00 – 8:00 p.m. and Saturday from 9:00 – 1:00 p.m.
