Keith called the meeting to Order with the pledge of allegiance.
  • Motioned by Jere, seconded by Larry to open public hearing for ordinance amendments 5 – 0 vote
Public Hearing:    Public Hearing for proposed ordinance amendments, additions or deletions to the Town of Buxton Zoning Ordinance
                         Article #      Shall Article 5, Administration Section of the Buxton Zoning Ordinance be amended as    
                follows? (Additions are bold and underlined, deletions are strikethrough)
5.6  Application for Building Permit.

5.6.A.  All applications for building permits shall be accompanied by plans clearly showing the lot lines, the size and location of proposed and existing structures.  Where applicable, the location of parking areas, subsurface sewage disposal systems, wells, landscaping and signs shall also be shown.  Copies of all other required permits and surveys (state of Maine, etc…) shall be included for the town records.  The application shall also include other information as lawfully may be required by the Code Enforcement Officer to determine the conformance with this Ordinance.
Article #      Shall Article 11, Section of the Buxton Zoning Ordinance be amended as follows? (Additions are bold and underlined, deletions are strikethrough)
11.6.C.2.b.  A part or all of the common open space may, at the option of the Town not be dedicated for acceptance by the Town.

11.6.C.5.  This homeowner's association shall have the responsibility of maintaining the common open space(s) and other common facilities until accepted by the Town.
11.15.E.7.  The application shall contain an estimate of the average daily traffic projected to be generated by the park. Estimates of traffic generation shall be based on the TRIP GENERATION MANUAL, 1987 1997 EDITION, or most current edition published by the Institute of Transportation Engineers.  If the park is projected to generate more than 400 vehicle trip ends per day, the application shall also include a traffic impact analysis by a registered professional engineer with experience in transportation engineering.

(Section 11.15.E.7 applies to Mobile Home parks only)
  • Jere motioned to close public hearing, seconded by Larry.  The motion passed with a 5 – 0 vote.
Review from site walk for Edward Lavigne of 51 Dunnell Road who is requesting a conditional use permit to allow repair and sales of farm machinery and equipment. Tax Map 6, Lot 10-2. The applicant was not in attendance.  Larry mentioned that Mr. Lavigne submitted a note listing the number of farm equipment that will be on site, as requested by the Board.  Larry added that he did not make the site walk, but did stop by and looked around.   Keith said that Mr. Lavigne plans to clear the trees and level off a knoll over to the left side.  This is where he will display the equipment for sale.  Jere says Mr. Lavigne would like to have equipment displayed on both sides of his driveway.  Keith added that Mr. Lavigne will be planting a row of trees to the equipment from the street.  Larry asks about the fluids from the vehicles with oil and other fluids.  Jere said the Board is reviewing this application under the auto repair guidelines.  The Board can limit the number of farm equipment displayed.  
Christopher was also unable to make the site walk and stopped at another time. He recalls that Mr. Lavigne mentions a fence in his notes, are there any setbacks from the road, for the fence or equipment.  Would this be an attractive nuisance for kids or anyone else?   Jere felt as long as the equipment is placed out of the right-of-way and on his own property it would be fine.  As far as the attractive nuisance that would be left up to the homeowners insurance to make that determination.   Keith believes the row of trees is in place of a fence.
Christopher is concerned with Article 10.10A - Setbacks and Screenings should apply.    
  • Motioned by Jere, seconded by Larry to schedule a public hearing for Edward Lavigne of 51 Dunnell Rd, Tax Map 6, Lot 10-2 on April 14th 2014 at 7 pm.  The motion passed with a 5 – 0 vote.

  • Motion by Larry to approve the minutes as amended, seconded by Christopher, motion passed with a 5 – 0 vote.

        ~One seat available and two vacancies for the planning Board term.              
~SMRPC price for maps.  – request a copy of each map from SMPDC.

Other Business:
Larry met with the Budget Committee there questions of concern were with the reduction of size of Planning Board, the length and cost for the Shoreland mapping project.

Adjourn:  Cliff motioned to adjourn 7:30 p.m. , seconded by Larry.  A unanimous vote.
