Minutes
Monday, February 24, 2014 at 7 p.m.

Members in attendance: Cliff Thomas, Christopher Carroll, Keith Emery, Jeremiah Ross and Larry Curtis.

Members not in attendance:  none

Others in attendance:  Code Officer Fred Farnham, Henry Huntley, Kerri & Steven
Rappold.

Chairman Keith Emery opened the meeting with the Pledge of allegiance.

Kerri & Steven Rappold are requesting a conditional use permit for a daycare facility at 993 Long Plains Road. Tax Map 6, Lot 69A.
  • Motioned by Jere, seconded by Larry to open the public hearing.  Unanimous vote.
The Rappolds are in the process of opening a daycare facility at 993 Long Plains Road.  The Fire Marshal walked through today, should have report soon.
Christopher was concerned about the separation of the play area and parking area.  Mr. Rappold said “The spot chosen was a tentative location; we will have a better idea once the snow is gone.”  
Jere asks about a letter related to Article 10.9 Refuse Disposal.  The Planning Board told them they would need a letter stating who will be accepting the trash.  Jere also confirmed that DHS will be inspecting the play area, the Board agreed to leave that in their jurisdiction.  
Keith asked “what will be the total number of kids?”  The Rappold’s said “Twenty (20) to start, with a maximum total of twenty-eight (28).”
Having no further questions from the Board, the abutters or the public, the Board moved to approve the application.
  • Jere moved to close the public hearing, seconded by Larry the motion passed with a 5 – 0 vote.  
The Board continued discussion on conditions.
Standard conditions of approval:
  • All elements and features of the plan and all representations made by the applicant concerning the development and use of the property which appear in the record of the planning Board proceedings, are condition of approval.  No change from the condition of approval is permitted unless an amended plan is first submitted to and approved by the Planning Board.
  • That the applicant be in compliance with all applicable provisions of Article 8.2.B and 10.
  • That the applicant be in compliance with all applicable provisions of Section 11.
  • All outstanding bills paid before building permit is issued.
Additional Conditions:
  • Copy of license from DHS & Fire Marshall approval.
  • Letter stating where trash will be disposed.
  • Letter stating the maximum number of children will be twenty-eight (28).
  • Jere motioned to find the applicant in compliant with all applicable provisions of Articles 8.2.B, Section 10 and 11.  Seconded by Christopher.  The motion passed with a 5 – 0 vote.
  • Motioned by Jere, seconded by Larry to approve the application the conditions stated from this and from previous meetings. Having no discussion the motion passed with a 5 – 0 vote.

Approval of Minutes:
February 10, 2014
  • Motioned by Larry, seconded by Christopher, to approve the minutes of February 10, 2014 as amended. The motion passed with a 4 – 0 – 1 vote.  Keith abstained.

Other Business:
Two board members will not be available for the March 10th meeting.  The Board discussed options for a meeting.   
  • Motioned by Christopher, seconded by Larry to re-schedule the regular March 10th meeting to March 17th at 7pm. The motion passed with a 5 – 0 vote.  
Attendees may address the Board on the evening’s business: none at this time.

  • Jere motioned to adjourn to a workshop in order to review ordinance amendments at 7:26 pm, seconded
  by Larry; a unanimous vote.
