Keith called the meeting to Order at 7 pm. by commencing the pledge of allegiance.

Review of site walk for Zaremba Group, LLC., requesting a conditional use permit for a proposed 9,100 sq. ft.  Dollar General at 422 Narragansett Trail.  A portion of Tax Map 5, Lot 47.

John Wojtila from the Zaremba Group, and Chris Nadeau, from Nobis Engineering presented the application.  Chris submitted an amended driveway layout. Spoke with MDOT after the site walk.   They have changed their minds and need to issue a new permit, due to the turning conflicts.  Still waiting for MDOT approval on this site.  The driveway was moved approximately 25-feet to the south.  So cars turning left into the site can pass by the cars turning left into the Hannaford driveway. Had to grab a little more land from the main site and will give back on the back portion of the property.  They will still have 2.25 acres.
Chris Carroll, curious if there should be another left hand turn lane?  Once MDOT responds back, we will know.  We may change to a single entrance lane.  Mark clarifies that MDOT is okay with the driveway, but just need to hear back for final approval.  
John Wojtila explains the amendment to the front architecture of the building.  The bottom ten feet of the front elevation nechiha panel, which is a composite material with a brick finish.  Matches the height of the store front entry.   There will be a dark bronze awning over the store front entry.  They are proposing a cornice along the top of the front elevation.  Bumped up the entry feature a couple feet higher to provide vertical and horizontal change in the ascetics.  
Mark said it looked like the building is closer to the street.  Christopher noticed options for a vestibule or an airlock?  The horizontal break with the awing and the glass door are recessed slightly, making it look like a vestibule.  Concrete sidewalk around the building is approximately 9-feet wide with appropriate sloping for ADA compliance.  
John Wojtila spoke briefly about the memo from Chief Schools, we have no issue with the recommendations listed except the automatic fire sprinkler system, which is not required for this size building.   John would like to continue to talk with the fire chief about other options.  Neither, the National Fire Safety Protection Agency (NFSPA) or International Business Code (IBC) require an automatic fire safety system for this size building, even when based on occupancy classification and the building construction type.  The building is proposed to be made with non-type 2B noncombustible material. The proposed building is considerably below the square foot threshold required by NFPA and IBC counts the mercantile area only, which is about 8,000 sq. ft.  John intends to speak with the fire rescue chief.  Keith said “this building is under the State requirement, so if you don’t want to sprinkle it, you don’t have to”.

Jere asked if the Town of North Berwick required them to sprinkle their new building?  What percentage of the Dollar General buildings have been sprinkled?  One in Texas has been sprinkled within the last 4 years.  Currently in California, they the requirement that above a certain threshold had to be sprinkled in their code.
Business hours will be 8 a.m. to 10 p.m. Monday through Saturday and Sunday from 10 a.m. to 8 p.m. or 9 pm.  Each store will employ 3 to 4 employees per shift and there will be three check out registers.  
Jere requested a copy of correspondence with the Fire Chief on the sprinkler discussion.  Chris B.’s concern is with a buffer next to the dentist office.  The conversation at the site walk was that the trees were going to be cleared along the property line.  Will more trees be planted as a buffer?  John’s comment was that they had not planned on it but are certainly not opposed to it.  
The gravel parking area is shaded in gray.  The plan is to bring it up to gravel base and plant the grass in, so that if needed in the future could just remove the grass and pave the area.  Chad is concerned with the buffer between the dentist office and the proposed building.  He would not think there is a need for the buffer. If the abutter does not come to the public hearing, it may not be necessary.
There will be an agreement, either with Mr. Thompson for the remaining property or with the prospective buyer for the shared cross access driveway.  Keith noted that the land slopes to the back of the property, so water runoff will not flow into the street.
Hoping to break ground in spring, with approx. 3 months of construction.

Set public hearing:
•     Motioned by Chad, seconded by Chris B. to schedule a public hearing on the Dollar General Development for Oct 27, 2014, at 7pm, the motion passed with a 7 – 0 vote.

September 22, 2014
•     Motioned by Jere, seconded by Chris C. to approve the minutes of September 22, 2014 as written.  The motion passed with a 7 – 0 vote.

Approval of Bills: none

Communications:
        ~MMA workshop courses.  There is a Planning Board workshop in Kennebunk in March 2015.
        ~Letter from State of Maine ref. Donald Pederzini abutter to Hannaford complex.
~SMPDC Newsletter commission is looking for replacements for their executive committee.
           ~The Planning Board members would like the BOA Chair to attend the next meeting to review
         the proposed ordinance amendment to Article 4.2.F.3.

Other Business:
~Carry Forwards:  Larry Curtis – we have been carrying forward the line items, printing costs and shoreland zoning maps for the past two years.  The Board of Selectmen decided that no amounts will be carried forward.

~Review findings for Old Port Realty, LLC  
•     Chris B. approved the finding of facts for Old Port Realty, LLC, seconded by Larry.  The motion passed with a 7 – 0 vote.

Attendees may address the Board on the evening’s business:
        Henry Huntley attended the Low Impact Development workshop at the Town Hall last Saturday.  It was the same presentation and expanded to include the SRCC.  They want to work with planning Boards on the runoff from buildings and impervious spaces.  Could save developers money.  Water quality – the towns are taxing the builders
