Town of Buxton Planning Board
        Minutes         
Monday, January 14, 2013 at 7 pm
             All meetings are held at the Buxton Municipal Building located at
                  185 Portland Road, Buxton, Maine 04093

Board members in attendance: John Vedral, David Savage, Christopher Carroll, Keith Emery, Nicholas Murray and Larry Curtis.

Board members absent:  none

Others in attendance: Fred Farnham, Michael Skillings, Henry Huntley, Cliff Thomas and Edward Brackett.

Call to Order:

Pledge of allegiance:

Public Hearing for Michael Skillings of 55 Skillings Road, who is requesting a Conditional Use permit allowing him to operate a auto repair garage.  The parcel is located in the Rural Zone on Tax Map 1, Lot 194-10.
"       John motioned to open the public hearing for Michael Skillings, seconded by Larry followed by a unanimous vote.
Michael Skillings said he wants to open an auto repair shop for the residents in the area.  Trying to keep low rates for local business.
Keith added, Mr. Skillings did submit the information the Board requested at the last meeting.  
Questions from the Board:  Larry, Nicholas, Keith and Christopher had no further questions.  David asked Fred if the aquifer map in the Comprehensive Planning book is accurate.  Fred said he referenced the 1985 Hydrogeologic Data for Significant Sand and Gravel Aquifers map.  He used a larger scale to match to the tax maps, which showed the location of Mr. Skillings property.  Fred measured over 1,100 feet from Route 22 to the garage area and then measured that distance on the aquifer map.  In doing this, it indicated that Mr. Skillings garage is not over the aquifer.  David is satisfied with Fred's findings.
John said there where two outstanding issues, one was for water protection, which Fred confirmed in a note that the drain has been completely sealed over.  Second the question of having a business sign in the Residential area.  The code enforcement office submitted a list of other businesses that have signs in a district not allowing the activity.  After reviewing the ordinance, John said the DOT road signs are put up in any zone.   John has no further issues, now that the two concerns have been addressed.
Mr. Skillings said he plans to put up a 2' x 3' sign.

Questions from abutters: None

Questions from the public:  Mr. Brackett said it is not going to do me any good.  He continued, stating he has a nuisance neighbor and the Board nor the police can do anything about it.
"       Motioned by John, seconded by David, to close the public hearing.  A unanimous vote.

Conditions of approval:
        Hours of operation are from 8 a.m. to 5 p.m. Monday through Friday, and Saturday 8 a.m. to 12 p.m.

David asked about the number of vehicles, Keith answered not including the antique cars, he could not have more than three.  John added this is a situation where the cars are over 1100 feet off the main drive.  Fred will keep an eye on it.
John suggests being cognizance of his neighbor's welfare.  Mr. Skillings said he has talked to many people, asking them to leave the driveway easy. It's a busy driveway and he cannot drive for them.  He has put up "SLOW" signs in the driveway and talked to all of the neighbors.

Keith read the conditions of approval:
1.      All elements and features of this application and all representations made by the applicant concerning the development and use of the property which appear in the record of the planning Board proceedings, are condition of approval.  No changes from the condition of approval is permitted unless an amended plan is first submitted to and approved by the Planning Board.
2.      That the applicant be in compliance with all applicable provisions of Article 8.2.B and 10.
3.      That the applicant be in compliance with all applicable provisions of Section 11.
4.      All outstanding bills paid before building permit is issued.
Additional conditions:
5.      Hours of operation are from 8 a.m. to 5 p.m. Monday through Friday, and Saturday 8 a.m. to 12 p.m.

"       Motioned by David to suspended the reading of 8.2.B, 10 and Section 11.  Seconded by John, the motion passed with a 6 - 0 vote.  

"       John motioned, that based on previous discussions we find the application to be in compliance with all applicable provisions of Articles 8.2.B, 10 & Section 11 if applicable, seconded by Larry passed with a 6 - 0 vote.  

"       John motioned to approve the application with the conditions stated this evening and from previous meeting for Michael Skilling of 55 Skillings Road, seconded by David passed with a 6 - 0 vote.  

CEO Report:  no report this evening.

Approval of Minutes:
December 10, 2012

"       John motioned to approve the minutes December 10, 2012 as amended, seconded by Larry 5 - 0 - 1, Nichols abstained.

Approval of Bills: There are no bills at this time.

Communications:
~2012/2013 Budget Request - Larry would like to discuss at workshop, whether
  to keep money with plan going forward.  The Board will discuss at the next  
  meeting.
~Southern Maine Regional Planning Commission: requesting annual dues of
 $2,290.  The Selectmen take care of this; it does not come out of our budget.
~Maine DOT - Public meeting on Bar Mills and Canal Bridge
~Maine Townsman - December issues
~Still have an opening on the Board

Other Business:
Review 2013 Ordinance amendments
Keith asked the Selectmen's office for any ordinance amendments.

John would like to review the legal notice procedures.   We may have to get the State up to speed.

Attendees may address the Board on the evening's business: Mr. Brackett does not feel it will do him any good to complain.  He cannot get the police to do anything.  The Board does not have any control over exhaust issues.   Mr. Brackett said he makes no effort in keeping his diesel vehicle quiet.  

Adjourn:  Motioned by John, seconded by David to adjourn at 7:40 p.m.  Unanimous.
