Workshop Minutes of February 5, 2007

Planning Board Members Present:  Keith Emery, Dennis Santolucito, David Anderson, Jeremiah Ross and Wanda Emery.

Planning Board Members Absent:  Barbara Elwell and Cullen Ryan

The workshop opened at 7:30 p.m.

Wanda has the opportunity to update the zoning map through a class she is currently taking.  With this project she will be able to overlay the Shoreland zone on the current zoning map as well add areas where the zone has changed since the last update in 1999.  Wanda will be working with Southern Maine Regional Planning Commission on this project.  

Wanda will give brief updates at the end of the Planning Board meetings.

Article #       .  Shall Article 2 – Definitions of the Buxton Zoning Ordinance be amended as follows?

Automobile Graveyard.  Shall be defined as in 30-A M.R.S.A. § 3752, as amended by 2003 Public Laws, Chapter 312.
Automobile graveyard. "Automobile graveyard” means a yard, field or other area used to store 3 or more unregistered or uninspected motor vehicles, as defined in 30-A M.R.S.A. § 3752, as amended by 2003 Public Laws, Chapter 312.

Article #      .  Shall an “Ordinance to Regulate Junkyards, Automobile Graveyards and Automobile Recycling Businesses” be enacted to read as follows?

        Ordinance to Regulate Junkyards, Automobile Graveyards and Automobile Recycling Businesses

Section 1.  Any person wishing to locate a junkyard, automobile graveyard or automobile recycling business within the Town shall apply to the Board of Selectmen for a permit as required by State law.  Such businesses shall be governed in all respects by the provisions of Title 30-A, Chapter 183, Subchapter 1, as last amended by 2003 Public Laws, Chapter 312.

Sec. 2.  The Town ordinance entitled “Ordinance to Regulate Automobile Graveyards, Automobile Salvage Yards and Junkyards,” enacted June 10, 1989, is repealed.

Article #        Shall Section 13.4.K.1.c. of the Buxton Zoning Ordinance be amended as follows? (Additions are underlined, deletions are strikethrough)
10.6.B. Noise shall be measured with a sound level meter meeting the standards of the American National Standards Institute (ANSI SI.4 1961) (ANSI Sl.4A 1985) "American Standard Specification for General Purpose Sound Level Meters". The instrument shall be set to the A-weighted response scale and the meter to the slow response. Measurements shall be conducted in accordance with ANSI S1.2 1962    ANSI 51.4-1983 "American Standard Method for the Physical Measurements of Sound".
Article #        Shall Section 10.11.C of the Buxton Zoning Ordinance be amended as follows? (Additions are underlined, deletions are strikethrough)

        10.11.C.          In the Business-Commercial & Light Commercial districts any non-residential use may display a sign attached to the building, that shall be no larger than the 10% of the total building area, to a maximum of 120 square feet. or and a free standing.  However, Only one free-standing sign shall be permitted per lot.   No sign shall measure larger than forty (40) eighty (80) square feet in area.  No free-standing sign shall be higher than 20 feet above the road level nor closer than the height of the sign from any side or rear  property line.  Attached signs shall not be placed on the roof of a building.
