Charter Commission
May 27, 2010

Present:~ Chair, Andy Townsend, Vice Chair, Dianne Senechal, Jen Barschdorf, David Dunn, May Schumacher, Brent Havu, Larry Miller, Daniel T. Collomy and Judy Schulander.

The Meeting was called to order at 7:00 p.m. by Chair, Andy Townsend.~ The Minutes of the last meeting were accepted with two changes.~ Larry Miller was removed from making a motion and seconding it.~ Section 2.01 was changed to section* 2.02.

The members of the Charter Commission started reviewing Section 2.09 (c-1).~ The members agreed that the minute taker would not capture who made the motion and seconded it.~ Only the final results would be written into the minutes.

Motion made and seconded to accept item 2.09 (c) as written.~ Motion passed.

Paragraph (d) under section 2.09.~ Removed 'or the Finance* Director'.~ Motion made and seconded to accept paragraph (d) with the understanding that the money amount of 1/2 of 1% would be subject to change at a later date* to make sure it was enough.~ Approved with the change and the revisit of the money amount.

Paragraph (e) under section 2.09.~ Motion made and seconded to accept paragraph as written.~ Motion passed.

Paragraph (f) under section 2.09.~ Motion made to remove the word 'laws' and substitute 'Town Meeting'.~ The members flagged this item to be reviewed by the attorney due to the word 'enact'.~ Motion passed with changes.

Paragraph (g) under section 2.09.~ Motion made and seconded to accept the section as written.~ Motion passed.

Paragraph (h) under section 2.09.~ Motion made and seconded to accept with the section '3.07' corrected once the document is done.~ Motion passed.

Paragraph (i) under section 2.09.~ Motion made and seconded to accept the section as written.~ Motion passed.

Paragraph (j) under section 2.09.~ Motion made and seconded to accept the section as written.~ Motion passed.

Paragraph (k) under section 2.09.~ Discussion~ to remove the word 'all'.~ Motion made and seconded to accept section with the word 'all' removed.~ Motion passed.

Paragraph (l) under section 2.09.~~ Motion made and seconded to accept section as written.~ Motion passed.

Section* 2.10 (K3.08 Appointment* and Removal of Town Manager

Paragraph (a) under section 2.10.~ Section changed as follows:~ The Board of Selectmen shall appoint a Town Manager for a definite term by written contract of 1 year who shall have the powers and perform the duties provided in Section 4.02 of this Charter.~ Motion made and seconded to accept section with changes.~ Motion passed and (Section 4.02) will be corrected in final Charter.

Paragraph (b) under section 2.10.~ Motion made and seconded to accept as written.~ Motion passed.

Paragraph (c) under section 2.10.~ Motion made and seconded to accept as written.~ Motion passed.

Section 2.06 Prohibitions

Paragraph (a) under section 2.06.~ Motion made and seconded to accept as written.~ Motion passed.

Paragraph (b) under section 2.06.~ Motion made and seconded to accept as written.~ Motion passed.

Paragraph (c) under section 2.06.~ Motion made to remove the first sentence and leave the last sentence.~ Article VI was flagged as it may need to be changed when final version of Charter is completed.~ Motion passed.

Section 2.07 Vacancy or Forfeiture of Office

Paragraph (a), (b) (1) (2) (3) (c) (d) under section 2.07.~ Motion made and seconded to accept as written.~ Motion passed.

Section 2.11 K3.09 Holding Other Office

Paragraph changed as follows:

No Selectmen or his/her family member shall hold any other compensated Town office or be employed by the Town, during the term for which he/she was elected to the Board of Selectmen.~ An individual may not be hired as a Town employee if a member of his/her family is a Selectman.~ No former Selectman shall hold any compensated Town Office or be employed in any Town department until one (1) year after resignation or expiration of the term for which he/she was elected.~ No elected Town official shall hold appointed office in the Town unless the law or ordinance creating the appointed office so requires or allows; provided that this shall not prohibit an elected Town official from serving on a Town board or committee in an ex officio capacity.~ Whenever the term "Town Official" is used in this Charter* it shall be interpreted to mean any elected* or appointed Town officer, appointee or employee, unless otherwise required by law, or the context in which the term appears compels a contrary interpretation.

The restrictions in this section shall apply not only on a prospective basis, but shall also apply to incumbent Selectmen.

added:~ For this purpose family member means spouse, brother, sister, parent, son, daughter, corresponding* in-law or permanent resident of the same household.

Motion made and seconded to accept the above paragraph as shown.~ Motion passed.~ Note, the members of the Commission want to make sure this section has a legal review.

Section 2.12 K3.10 Interference with Administration

Motion made and seconded to approve the following:

Except for the purpose of inquiry, the Board of Selectmen shall deal with Town employees solely through the Town Manager.

Motion approved.

The agenda was set for the next meeting.
