Board of Appeals Minutes 03/07/2006

Chairman Stephen Heroux called the meeting to order at 7:02 p.m.  

Timothy & Sarah Alexander of 401 Chicopee Road have submitted an application for an administrative appeal; Tax Map 2, Lots 26A and 26C.
·       Motioned by Charlene, seconded by Jack to open the public hearing.  The motion passed with a 3 – 0 vote.
Mr. Alexander explained he owns two parcels of land on Chicopee Road; one is a non-conforming lot with an existing house on containing .53 of an acre.  The second lot contains 5.39 acres of land only.  Both properties are located in the Residential District, which requires 200’ of frontage 120,000 sq. ft. minimum lot size.  The house located on lot 26A was built in 1986, before zoning.  Fred researched back to 1970 for a building permit for the garage, but was unable find one.  He assumes the garage was built before 1970 when the setbacks were 40 feet on the front and 10 feet on the sides and rear giving some explanation for the location of the garage being built on both lots.  Mr. Alexander is proposing to build a home on the rear parcel, but needs a  R-O-W for road frontage.   While reviewing the building permit application, Fred informed them a 50-foot right-of-way is required to access the rear lot.  A survey dated February 2006 indicates the garage for lot 26A straddles both lots and the corner of the house is on the property line.  Mr. Alexander wants to relocate the property line for lot 26A adding a 50-foot ROW to the left side lot 26A, creating road frontage for lot 26C and 26.  This would remove the setback and road frontage violations for lots 26 and 26A, and provide access to the rear lot as depicted in a survey dated October 16, 1995.  
·       Motioned by Charlene, seconded by Jack to close public hearing.  The motion passed with a 3 – 0 vote.
Discussion within the Board:  After seeing the map dated 10-16-96, Stephen feels the line change will create and correct changes that should have been corrected in 1996. The granting of the administrative appeal would correct the lot diminutions on two lots.  Creating frontage on one lot and changing the location of the frontage on the second lot.
·       Stephen motioned that to approve the administrative appeal with the boundary changes based on boundary map dated February 2006.  Maintaining the R-O-W drawn on the map dated October 1995.   Seconded by Charlene the motion passed with a 3 – 0 vote.   

Approval of Minutes: unable to approve, hold until next meeting.

Approval of Bills: Charlene motioned to pay Portland Press Herald $64.60, seconded by Jack the motion passed with a 3 – 0 vote.

Communications:

Other Business:  Budget – Requesting a $500 budget for ’06-’07.
                Submittal for the town report.
·       Being no further business, moved by Charlene, seconded by Jack, to adjourn at 7:40 p.m.  The vote was unanimous.
