The Regular Meeting of the Zoning Board of Appeals of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York on the 1st of April 2014 commencing at 7:30 p.m.

A variance was requested because an application for a building permit to construct a second story addition at an existing single family dwelling was denied due to nonconformity with Column 9A One Side Yard Minimum Yard Dimension of the Code of the Village of Briarcliff Manor.
DISCUSSION:
Mr. Luigi DeMasi, Architect for the Applicant stated they were seeking to add a small second floor addition to above an existing footprint and were seeking a side yard setback variance. He stated there currently was no space for a playroom and they sought to put a playroom and master suite above the garage. He further stated there wasn’t a basement and the addition would not block anyone’s view. He stated it was a very low addition and the average height was 27.3 feet where 30 feet is allowed. He stated they wanted to preserve the views.
Dr. Steven Cho, Owner, stated the neighbors were supportive of their proposed project.
Member Gioscia asked if all neighbors were notified.
PUBLIC COMMENTS:
There were no public comments.
Upon motion by Member O’Leary, seconded by Member Moraglia, the Board voted unanimously to close the public hearing.
DECISION:
Member Moraglia stated he visited the site and he agreed that the views would not be impacted by the addition and he appreciated the Applicant not changing the pitch of the roof. He stated all of the enhancements were in line with the neighborhood and there wouldn’t be any detriment to the area.
Member O’Leary stated it was a significant increase to the Gross Floor Area but it was staying within the current footprint. He stated there was a hardship for a growing family and the screening in the rear of the site was significant and wouldn’t impact any of the neighbors. He stated he was in support of the application.
Member Gioscia stated it was a self-imposed hardship and asked what other considerations were made to avoid applying for a variance.
Mr. DeMasi stated the garage needed repair and the applicant thought they’d fix it and build over it. He stated building over the kitchen would have been too costly.
Chairman Bogart stated there was a material increase in the Gross Floor Area but the footprint wouldn’t be affected and the coverage area was still low. He further stated he appreciated keeping the pitch of the roof the same and he would be in favor of granting the variance.
MINUTES
Upon motion my Member Moraglia, seconded by Member Gioscia, the minutes of the February 24, 2014 meeting were approved.
ADJOURNMENT
Upon motion by Member O’Leary, seconded by Member Moraglia the Board voted unanimously to adjourn the meeting at 7:45p.m.
