Regular Meeting
July 24, 2013
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York on the 24th of July, 2013 commencing at 7:30 p.m.

Village Managers Report by Village Manager Zegarelli
  • The various Capital Projects are being planning in accordance with the Capital Projects list recently adopted.  
  • A meeting is scheduled for tomorrow at Chilmark Park with the Recreation Committee on how to meld together plans for the site and create a comfort station and fulfill the needs for more fields.  
  • Summer camp has been very active.
  • The Affordable Housing Units at 445 N. State Road are moving ahead.  
  • The SCADA system is up and running.  
  • Tax collection is going very well at 97%.
  • Sales tax came in at 101%
  • Family Fun Night (Beat the Heat) was a huge success.
Public Comments

Mrs. Stephanie Drive of 16 Ash Road stated her house was reclassified by FEMA as a repetitive loss property.  She asked the Board to lend their support along with the various other local and state representatives to get the additional funding.  She stated she reached out the Village and didn’t get any response.  

Mayor Vescio stated the Village had been supporting the flooding remediation for over 20 years with several different plans and the DEC kept obstructing any attempts to do work in the stream.  

Village Manager Zegarelli stated the Village spent a lot of time and money to alleviate the flooding by clearing and snagging the river and the DEC stopped the work.  

Deputy Mayor Sullivan stated she lived in the Flood Zone also and the Village had taken several steps to figure out ways to mitigate the flooding concerns.  She stated she was available to meet to discuss any concerns and correct any misinformation given by the other Officials that were trying to “pass the buck”.  

Mr. Ian Driver of 16 Ash Road stated they didn’t mean to cause offense and hoped they could come to a resolution.  

Mayor Vescio stated the FEMA funding wasn’t the issue, that the issue was getting the DEC to cooperate.  He stated the Board would support a petition if the residents put one together.    

Bond Resolutions

Upon motion by Trustee Pohar, seconded by Deputy Mayor Sullivan, the Board voted unanimously to amend Bond Resolution “C”.  

Village Attorney Smith noted that all of the Bond Resolutions were a Type 2 SEQRA action with the exception of the demolition of the Recreation Building.  He stated he’d ask the Village Engineer to prepare an Environmental Assessment Form.  

Upon motion by Deputy Mayor Sullivan, seconded by Trustee Wilson, the Board voted unanimously to table the resolutions to the next meeting.  

Tax Abatements – Town of Mount Pleasant

Upon motion by Trustee Wilson, seconded by Trustee Pohar, the Board voted unanimously to approve the following resolution:

185 LARCH ROAD

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 185 Larch Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claim Assessment Review has been issued for the property at 185 Larch Road for the 2012 Town assessment year, Fiscal Year 2013-2014 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2013-2014 assessment roll and the approval of the budget for Fiscal Year 2013-2014;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2013-2014 assessment roll by $900 from $9,600 to $8,700; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund of the tax bill for Fiscal Year 2013-2014 in the amount of $168.62 and the abatement of the tax bill for Fiscal Year 2013-2014 in the amount of $168.63 based upon the reduced assessment values in the Stipulation of Settlement and Order.  


45 WASHBURN ROAD

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 45 Washburn Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claim Assessment Review has been issued for the property at 45 Washburn Road for the 2012 Town assessment year, Fiscal Year 2013-2014 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2013-2014 assessment roll and the approval of the budget for Fiscal Year 2013-2014;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2013-2014 assessment roll by $2,100 from $25,200 to $23,100; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund of the tax bill for Fiscal Year 2013-2014 in the amount of $393.46 and the abatement of the tax bill for Fiscal Year 2013-2014 in the amount of $393.46 based upon the reduced assessment values in the Stipulation of Settlement and Order.  


133 WASHBURN ROAD

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 133 Washburn Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claim Assessment Review has been issued for the property at 133 Washburn Road for the 2012 Town assessment year, Fiscal Year 2013-2014 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2013-2014 assessment roll and the approval of the budget for Fiscal Year 2013-2014;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2013-2014 assessment roll by $1,200 from $10,000 to $8,800; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund of the tax bill for Fiscal Year 2013-2014 in the amount of $224.84 and the abatement of the tax bill for Fiscal Year 2013-2014 in the amount of $224.84 based upon the reduced assessment values in the Stipulation of Settlement and Order.  


7 INGHAM ROAD

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 7 Ingham Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claim Assessment Review has been issued for the property at 7 Ingham Road for the 2012 Town assessment year, Fiscal Year 2013-2014 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2013-2014 assessment roll and the approval of the budget for Fiscal Year 2013-2014;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2013-2014 assessment roll by $1,000 from $10,400 to $9,400; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund of the tax bill for Fiscal Year 2013-2014 in the amount of $187.36 and the abatement of the tax bill for Fiscal Year 2013-2014 in the amount of $187.36 based upon the reduced assessment values in the Stipulation of Settlement and Order.  

    
12 ASH ROAD

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 12 Ash Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claim Assessment Review has been issued for the property at 12 Ash Road for the 2012 Town assessment year, Fiscal Year 2013-2014 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2013-2014 assessment roll and the approval of the budget for Fiscal Year 2013-2014;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2013-2014 assessment roll by $1,825 from $7,300 to $5,475; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the refund of the tax bill for Fiscal Year 2013-2014 in the amount of $341.94 and the abatement of the tax bill for Fiscal Year 2013-2014 in the amount of $341.94 based upon the reduced assessment values in the Stipulation of Settlement and Order.

Minutes

The minutes of May 15, 2013 were tabled to the next meeting.

Upon motion by Trustee Pohar, , seconded by Deputy Mayor Sullivan, the Board voted unanimously to approve the minutes of July 10, 2013.

Upon motion by Trustee Wilson, seconded by Deputy Mayor Sullivan, the Board voted unanimously to adjourn the meeting at 8:15pm.
