Regular Meeting
April 3, 2013
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York on the 3rd of April, 2013 commencing at 7:30 p.m.

Public Hearing Fiscal Year 2013-2014 Tentative Budget (to be continued to April 17th)

Upon motion by Trustee Pohar, seconded by Deputy Mayor Sullivan, the Board voted unanimously to open the public hearing.  

Village Manager Zegarelli gave a presentation on the Tentative Budget for FY 13-14.  

The Board had general discussion regarding the different variables that contribute to the budget and tax rates.  

Upon motion by Deputy Mayor Sullivan, seconded by Trustee Wilson, the Board voted unanimously to adjourn the public hearing to April 17, 2013 at 7:30pm.  

Board of Trustees Report by Mayor Vescio
  • Welcome to Trustee Wilson and Congratulations to Trustee Sullivan and Justice Code on their election.  
  • Chilmark Shopping Center has received their Building Permits and construction will begin this month.  
  • The Community Center plans are progressing and 6-8 months of construction is anticipated.  
  • Les Miserables will be shown at the Library and Community Center on Friday, April 5th.  
  • A Clifford Party will be held at the Library and Community Center on Saturday, April 4th for children and their caregivers.  
Village Managers Report by Village Manager Zegarelli
  • The water tank at the Edith Macy Center needs work and is a critical component of the Village’s water system.  
  • The Westchester County Mobile Shredder will be behind Village Hall on Saturday, April 6th from 10am-1pm.  
  • The Westchester County Mobile Passport Unit will be at Village Hall on Thursday, April 25th from 11am-2pm.  
  • The Fire Department will hold their elections tomorrow.  
Public Comments

There were no public comments.  

Fire Department Service Awards Program

The Board requested the certification be posted along with the lists.  

Upon motion by Trustee Wilson, seconded by Trustee Pohar, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED, that the Volunteer Firefighter Service Award Program list for all 2012 active firefighters of the Briarcliff Manor Fire Company, the Briarcliff Manor Hook, Ladder & Fire Company and the Scarborough Engine Company is hereby approved.

BE IT FURTHER RESOLVED that the list and certification shall be directed to the respective fire companies for posting for a period of thirty (30) days.

Authorize Village Manager to Execute Agreements:

Westchester County Emergency Services – 60 Control

Upon motion by Trustee Pohar, seconded by Deputy Mayor Sullivan, the Board voted unanimously to approve the following resolution:

RESOLVED, that the Village of Briarcliff Manor approves participation by the Village of Briarcliff Manor Fire Department in the Westchester County Fire Mutual Aid Plan (“Plan”), as amended from time to time, and further certifies to Westchester County, through its Commissioner of Emergency Services, that it shall comply with the provisions of the Plan; and be it further

RESOLVED, that there are no resolutions in effect that restrict outside service and training by the named Fire Agency; and be it further

RESOLVED that there are no limitations, conditions or restrictions on the Fire Agency from providing prompt assistance, and the Commissioner of Emergency Services shall be notified in writing of any such limitations are imposed subsequent to the adoption of this Resolution; and be it further

RESOLVED, that the named Fire Agency shall respond to all calls for assistance from another Fire Agency through the Westchester County Emergency Communications Center a/k/a “60 Control”; and be it further

RESOLVED, that the Village of Briarcliff Manor hereby acknowledges and accepts it’s financial responsibility pursuant to applicable law; and be it further

RESOLVED, that a copy of this resolution shall be filed with the Westchester County Commissioner of Emergency Services.  

Pace University

Upon motion by Deputy Mayor Sullivan, seconded by Trustee Wilson, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Facilities Use Agreement with Pace University for the use of designated facilities for the Village of Briarcliff Manor Summer Camp from June 24, 2013 through August 2, 2013 for a fixed amount of $24,000.  

Woodard & Curran Engineering – SCADA System Support

Upon motion by Trustee Wilson, seconded by Trustee Pohar, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an Annual Service Agreement with Woodard & Curran Engineering to provide support hours for maintenance and service for the SCADA system per their amount of $25,000.  

Ambulance Services 2012 and 2013 – Town of Mount Pleasant

Upon motion by Trustee Wilson, seconded by Deputy Mayor Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute agreements with the Town of Mt. Pleasant for the West Ambulance District ambulance services in the amount of $3,647 for 2012 and $3,720 for 2013.  

Northeast and East Briarcliff Fire Protection Agreement – Town of Mount Pleasant

The Board requested the amounts be added to the resolutions.  

Upon motion by Deputy Mayor Sullivan, seconded by Trustee Wilson, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Briarcliff East Fire Protection Districts in the amount of $11,825 to expire on December 31, 2012.

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Northeast Briarcliff Fire Protection District in the amount of $23,590 to expire on December 31, 2012.

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Briarcliff East Fire Protection Districts in the amount of $12,062 to expire on December 31, 2013.

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Northeast Briarcliff Fire Protection District in the amount of $24,062 to expire on December 31, 2013.

Hydrant Rental Agreement – Town of Mount Pleasant

Upon motion by Trustee Wilson, seconded by Trustee Pohar, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Hydrant Rental Agreement with the Town of Mt. Pleasant for the Briarcliff East Fire Protection District in the amount of $618 for 2012 and $630 for 2013.

Affirmative Determination Regarding the Findings of Fact and Recommendations Between the Village of Briarcliff Manor and the Civil Service Employees Association Local 1000

The Board had general discussion regarding the determination and the process moving forward.  

Upon motion by Trustee Pohar, seconded by Deputy Mayor Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Village Manager is hereby authorized and directed to make an affirmative determination to accept the Findings of Fact and Recommendations made by Carol M. Hoffman, Esq. Fact Finder for PERB Case No. M-2010-35 in the matter of the Fact-Finding between the Village of Briarcliff Manor (“Village”) and the Civil Service Union Employees Association, Local 1000 AFSCME, AFL-CIO, Village of Briarcliff Manor Rank and File Unit, (“Union”) dated March 29, 2013.   

Minutes

Upon motion by Trustee Pohar, seconded by Deputy Mayor Sullivan, the Board voted unanimously to approve the minutes of March 20, 2013.    

Adjournment

The Board congratulated Village Manager Zegarelli, Village Clerk Dennett and Village Treasurer Rizzo on their reappointments and thanked them for their hard work.  


Upon motion by Trustee Wilson, seconded by Trustee Pohar, the Board voted unanimously to adjourn the meeting at 8:30pm.
