Board of Trustees acting in their capacity as
Board of Police Commissioners
March 29, 2012

A Special Meeting of the Board of Trustees acting in their capacity as Board of Police Commissioners of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, 1111 Pleasantville Road, Briarcliff Manor, New York on the 29th day of March, 2012 commencing at 7:32 p.m.

Philip Zegarelli, Village Manager/Deputy Village Clerk

Absent
Deputy Mayor Venditti

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to open the Special Meeting.  

Upon motion by Trustee Sullivan, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

Authorize the Village Manager to Execute a Stipulation Agreement with a member of VBM Police Department

WHEREAS the Board of Trustees of the Village of Briarcliff Manor acting in its capacity as the Board of Trustees and/or the Board of Police Commissioners have reviewed a certain Settlement in satisfaction of the proposed disciplinary charges against Police Officer “A”; and,

WHEREAS the Village Manager and Chief of Police have reviewed the Settlement and have agreed as to the provisions of the Settlement as being in the best interest of the Village and its Police Department as a whole and in keeping with the appropriate provisions of public law and departmental discipline; and

WHEREAS the Special Counsel for Labor  Matters has reviewed the terms and conditions and drafted the proposed settlement as being in good order and in keeping with the seriousness of the proposed disciplinary matters:


NOW, THEREFORE, Be It Resolved that the Board of Trustees acting in its own role and/or that of the Board of Police Commissioners does hereby approve and ratify the terms of the Settlement (subject to non-material changes, if any) with Police Officer “A” as appropriate, final and in keeping with the best interests of the Village and its Police Department; and,

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute the Settlement and ensure that the terms and conditions of said Settlement are fully implemented.  

Upon motion by Trustee Capasso seconded by Trustee Mayer, the Board voted unanimously to close the Special Meeting at 7:40pm.
