Regular Meeting
July 20, 2011
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 20th of July 2011 commencing at 7:30 p.m.

Public Hearing - Special Use Permit – Renew a Special Use Permit – Briarcliff Congregational Church

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to open the public hearing.  

Village Manager Zegarelli stated the Building Department’s inspection found no violations at the site and the tax assessment was in the Town’s hands.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to close the public hearing.  

Upon motion by Trustee Capasso, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution as amended:  

BE IT RESOLVED that the Special Use Permit issued to Briarcliff Congregational Church is hereby renewed subject to the same conditions included in the original Special Use Permit approval dated July 13, 1995 and as amended thereafter.  

BE IT FURTHER RESOLVED that the Special Use Permit renewal shall be retroactive to July 13, 2010 and shall extend to July 12, 2015.  

BE IT FURTHER RESOLVED that should the Briarcliff Congregational Church desire to renew this Special Use Permit for another five year period, commencing in 2015, the Church shall be responsible for requesting the renewal at least sixty (60) days prior to the expiration of the Special Use Permit.  

Board of Trustees Announcements by Trustee Capasso
  • The Library’s Summer Reading program is in full swing.  Please visit their website for more program information.  
  • The Recreation Department have relocated back to their home in the lower level of the Library.  
  • Tickets are still available for Summercliff’s summer production of The Sound of Music on July 22nd and 23rd.  
  • Pool Hours are listed on the Village website and scroll.  
  • Family Fun Night was a big success. Congratulations to the Lisi Family for winning the event.  
  • Subscribe to “Rec News” on the Village website to keep apprised of upcoming events.  
Village Managers Report by Village Manager Zegarelli
  • Water is currently circulating through the new system and a full water flow is expected by the end of the month.  
  • Today’s traffic “SNAFU” was created by the NYS DOT’s decision to completely close Route 9A in order to install new guiderails.  Neither the PD of the Village of Briarcliff Manor nor the Town of Mount Pleasant PD was notified in advance of the closure of Route 9A thus, adding to the confusion.  
  • The Village Hall window project is virtually complete.  
  • The lines were repainted at the Scarborough Station parking lot.  
  • Village Tax collection is ongoing and is just shy of the full amount for the first half.  
  • The pre-audit for FY 2010-2011 was held and no exceptions were noted.  Kudos to the Village Treasurer, her staff and other department heads.  
  • Several street and traffic signs in the Village have been vandalized recently.  This is a serious issue, a potential traffic hazard and costly to the Village.  Residents are asked to report if they see anyone causing damage or destruction.  
The Board requested the Village Manager to look at the Club field because it appeared as though it was being cut too short.  They asked residents that live near streams or brooks to make sure debris (lawn or otherwise) isn’t dumped into them.  They stated it was causing damage to homes downstream.  Residents are encouraged to install dry wells before the Village takes action and make sure their landscapers don’t dump illegally into water sources.  

Public Comments

Mr. Robert Little of 8 Scarborough Circle implored the Board to not hold the public hearing for shared housing legislation in the summer so more people could attend and have a chance to review it.  

Schedule Public Hearing to Amend Chapter 220, Zoning to amend Section 220-6(C) and Section 220-6(F) and add a new Section 220-6(J) (15) for shared residence Special Use Permits

Village Attorney Smith stated the draft was not a marked copy because it had fairly substantial changes that were incorporated at the Board’s request.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the September 21, 2011 Board of Trustees meeting to hear and discuss a proposed local law to amend Chapter 220, Zoning, of the Code of the Village of Briarcliff Manor to amend Section 220-6(C) and Section 220-6(F) and add a new Section 220-6(J)(15) for shared residence Special Use Permits.  

Authorize Village Manager to Approve Change Orders – FWSP LJ Coppola

The Board requested a spreadsheet be prepared of the original expenses of the Full Water Supply Project and the project’s add-ons.  

Upon motion by Trustee Capasso, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:  

BE IT RESOLVED that the Board of Trustees hereby approves the following change orders for a total project increase of $33,949.30:

Change order LJ Coppola-CO2 in the amount of $ 3,536.49 to increase the size of discharge piping from 3” to 6”.   

Change order LJ Coppola-CO3 in the amount of $ 29,078.12 to furnish and install two simplex quick removal sewage ejectors and control panels.  

Change order LJ Coppola-CO4 in the amount of $ 1,334.69 to install indirect waste standpipe drains for the HVAC condensate.  

BE IT FURTHER RESOLVED, the funds will be drawn from contingency in account H8397.201.10PPL for change order approval from the New York State Environmental Facilities Corporation for the Full Supply Project.

Acceptance of a Donation to Purchase a Library Clock

The Board thanked the Friends of the Library for their donation.  

Upon motion by Trustee Capasso, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution as amended:  

BE IT RESOLVED, that the Board of Trustees hereby accepts a donation in the amount of $560.00 from the Friends of the Library for the purposes of purchasing a wall clock and plaque for the Briarcliff Manor Library.

Award of Bid – Emergency 60” Pipe Debris Removal

The Board had general discussion regarding confined space procedures and how the amount of debris removed would be calculated.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:  

WHEREAS the Village received two bids for the Emergency 60” Pipe Debris Removal Project located primarily in the Village’s right of way in and about Law Park Field; and

NOW THEREFORE BE IT RESOLVED that the bid for the Emergency 60” Pipe Debris Removal Project is hereby awarded to Cassidy Excavating Inc. per their proposal of $116,700.   

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with Cassidy Excavating Inc. for said project.

BE IT FURTHER RESOLVED that the project will be charged to Capital Budget Code H5110.201.11481.  

Authorize Mayor to Execute an Agreement with the Village Manager  

The Board thanked the Village Manager for his time and service to the Village and stated it was one of their best decisions.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Mayor is authorized to execute an agreement with Philip Zegarelli for his service in the 2011/2012 Village year as Village Manager, Deputy Village Clerk, Deputy Registrar and Marriage Officer (in the absence of the Mayor).  

Minutes

Upon motion by Trustee Capasso, seconded by Trustee Mayer, the Board voted unanimously to approve the minutes of the July 6, 2011 Regular Meeting as amended.    

Public Comments

Mr. Dan Zucchi of 161 Locust Road stated he didn’t attend many meetings as of late but he liked to show up occasionally to express what the Village feels as a whole about the job the Board was doing.  He thanked the Village staff for their cleanup efforts in the recent storm.  He stated the Board did a phenomenal job bringing the new water system to fruition and thanks to ARRA monies it would cost the residents virtually nothing.

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to adjourn the regular meeting at 8:35pm.
