Regular Meeting
July 6, 2011

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 6th of July 2011 commencing at 7:30 p.m.

Public Hearing - Special Use Permit – T-Mobile Northeast, LLC

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to open the public hearing.  

Ms. Cara Bonomolo of Snyder and Snyder explained the proposed application for a cellular monopole located at the Department of Public Works site at 10 Buckhout Road.  

The Board had general discussion regarding visual impact, height, site access and the photo renderings.  

Mr. David Weinfeld, on behalf of the Applicant, explained the proposed site plan and stated that 4 additional carriers could be housed on the monopole.  

The Radio Frequency Engineer for the Applicant explained height of the proposed monopole and that it would confirm the reliability and coverage objectives.  

Ms. Bonomolo stated they may need a wetlands permit and asked who to coordinate with.  

Village Attorney Smith suggested she coordinate with the Village Engineer.  

Mr. Bruce Graves of 574 Pleasantville Road stated all of the renderings of the monopole were with leaves on the trees.  He asked what other sites were evaluated.  

Bruce Graves 574 Pville Road – this is in my backyard, all the pictures are with leaves on the trees and very mature, likely to be less trees there in the future.  Of all the places to put it, there should be some discussions if this is the optimal location.

The Board requested the Applicant show the monopole on each rendering and show the coverage level at different height increments.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to adjourn the public hearing to August 3, 2011.  

Board of Trustees Announcements by Deputy Mayor Venditti
  • The Library held their 8th Annual “Schools Out for Summer” party and over 400 people attended.  They have a number of Summer Reading and other programs.  Please visit their website for more information.  
  • The Recreation Department is temporarily located at Village Hall while their offices are repaired due to the flooding.  
  • The Board thanked DPW, and the Fire Department for their efforts during the recent storm.    
  • Pool Hours are listed on the Village website and scroll.  
  • Pool and Tennis Permits are on sale at Recreation Office
  • Family Fun night will be on July 8th.  
  • Donnie’s Law Park Café is open.  
  • Specialty Camp Registration is ongoing.    
Mayor Vescio stated after many years of planning and construction the Full Water Supply System was almost in service.  He commended the Board, Village Staff, Village Counsel and the Village Manager for their efforts.  He stated the project secured a reliable, potable drinking water source for the Village for many years to come.  

Deputy Mayor Venditti thanked Mayor Vescio for carrying the project forward.  

Village Managers Report by Village Manager Zegarelli
  • Water is currently circulating through the new system and July 18th is the target date for a full water flow.  
  • Village Hall Administrative Hours are on summer hours will continue through Labor Day.    
  • The Window Treatments in the Board/Court Room were installed.  
  • An RFP will be sent out to clean the 60 inch main that was clogged with debris from the recent storm.  
  • The Scarborough Station will be restriped.  
  • Village Tax collection is ongoing.

Schedule Public Hearings

Renew a Special Use Permit – Briarcliff Congregational Church

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for July 20, 2011 to hear and consider an application for a renewal of a Special Use Permit to the Briarcliff Congregational Church.  

Zoning Map Amendment

The Board requested all affected property owners be notified.  

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the August 17, 2011 Board of Trustees meeting to hear and discuss a Local Law to amend Section 220-3.B of the Zoning Ordinance of the Village of Briarcliff Manor, New York relative to the adoption of a new Zoning Map in digitized form, which will result in the correction of Zoning District Boundaries relative to the following tax parcels in the Village of Briarcliff Manor:

BE IT RESOLVED FURTHER that the proposed local law to amend Section 220-3.B of the Zoning Ordinance of the Village of Briarcliff Manor, New York relative to the adoption of a new Zoning Map in digitized form is hereby directed to the Village Planning Board and to the Westchester County Planning Board for review and recommendation and to the Town of Ossining, Town of Mount Pleasant, and Village of Ossining for review and comment as they see fit.

Award of Bid

Tree Trimming Services

Upon motion by Trustee Sullivan, seconded Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the bid for Tree Trimming Services (VM-1112-02) is hereby awarded to Ramos & V Tree Care Services of Yonkers, New York per their bid of $1,050.00 per day.

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Ramos & V Tree Care Services for Tree Trimming Services for a one year term with two one year renewable options.

DPW Building Roof Replacement

The Board made revisions to the resolution and reduced the contingency.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

WHEREAS the Village received 12 bids for the DPW Building Roof Replacement Project; and

BE IT RESOLVED that the bid for the DPW Building Roof Replacement Project (VM-1011-10) is hereby awarded to WB Contracting Corp. as per their proposal of $280,600 with a $15,000 contingency not to exceed a total project cost of $295,600.    

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with WB Contracting Corp for said project.    


Restore a Tax Exemption – 15 Larch Road

The Board requested the Village Manager to contact the Town of Mount Pleasant to make sure the resident’s exemptions were applied to her School, Town and County taxes as well.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

WHEREAS, the Town of Mount Pleasant controls the Village Assessment Roll for 265 Village Parcels; and

WHEREAS, the 2009 Mount Pleasant Town Tax Roll listed the Senior Low Income Exemption as 5% for 15 Larch Road (Parcel ID 98.15-2-16); and

WHEREAS, the 2010 Mount Pleasant Town Tax Roll erroneously omitted any  Senior Low Income Exemption for 15 Larch Road (Parcel ID 98.15-2-16) when the Mount Pleasant Tax Assessor had increased the exemption to 50%; and

WHEREAS, Mount Pleasant advised the Village of its error; and

WHEREAS, the Village is taking corrective action to revise the error regarding Village Taxes; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the Village tax bill for Fiscal Year 2011-2012 based upon the corrected 50% Senior Low Income Exemption for 15 Larch Road (Parcel ID 98.15-2-16).  

BE IT FURTHER RESOLVED, that the original Village tax bill for 15 Larch Road (Parcel ID 98.15-2-16) was $1,904.47 for Fiscal Year 2011-2012 and has been reduced to $952.24.  

BE IT FURTHER RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $952.23 based upon the reduced assessment value and the issuance of a new tax bill.  

SCAR Tax Abatements

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

WHEREAS, Stipulations of Settlements and Orders and the Small Claims Assessment Review have been issued for 7 Village parcels for the 2010 Ossining Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, those Stipulations of Settlements and Orders reduced the tax assessment for the properties for the Fiscal Year 2011-2012 assessment roll as set forth in the schedule below; and

WHEREAS, the Stipulations of Settlements and Orders were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bills for Fiscal Year 2011-2012 based upon the reduced assessment values in the Stipulations of Settlements and Orders and further adopts the attached set of resolutions for each of the specific properties.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 211 Central Drive; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 211 Central Drive for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $33,860 from $161,000 to $127,140; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $3,013.54 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

22 Tanglewood Circle

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 22 Tanglewood Circle; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 22 Tanglewood Circle for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $16,200 from $90,200 to $74,000; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $1,441.80 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.


149 Cedar Drive

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 149 Cedar Drive; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 149 Cedar Drive for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $3,000 from $43,500 to $40,500; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $267.00 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

10 Avondale Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 10 Avondale Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 10 Avondale Court for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $4,000 from $49,000 to $45,000; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $356.00 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

21 Avondale Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 21 Avondale Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 21 Avondale Court for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $3,500 from $48,000 to $44,500; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $311.50 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

18 Avondale Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 18 Avondale Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 18 Avondale Court for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $1,200 from $43,500 to $42,300; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $106.80 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

13 Lewiston Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 13 Lewiston Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 13 Lewiston Court for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $4,100 from $49,000 to $44,900; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2011-2012 in the amount of $364.90 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.



Fire Department Memberships

The Board thanked the new members for volunteering.  

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:  

DANIEL BARELLA

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Daniel Barella to the Scarborough Engine Company.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

MICHAEL REFF

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Michael Reff to the Briarcliff Manor Fire Company.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

JOHN M. WALLIS

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of John M. Wallis to the Briarcliff Manor Fire Company.  

Minutes

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, with one abstention from Trustee Mayer, the Board voted to approve the minutes of the June 15, 2011 Regular Meeting.  



Adjournment

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to adjourn the regular meeting at 9:00pm.
