Regular Meeting
June 15, 2011
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 15th of June 2011 commencing at 7:30 p.m.

Public Hearing - Chapter 220, Zoning to add a new Section 220-6(J)(15) for shared residence Special Use Permits (will be immediately adjourned)

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to open the Public Hearing.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to adjourn the Public Hearing to a date uncertain.  

Board of Trustees Announcements by Trustee Capasso
  • The Library has a number of Summer Reading and other programs.  Please visit their website for more information.  
  • The Recreation Department has moved into their new location in the lower level of the Library.  
  • Pool Hours are listed on the Village website and scroll.  
  • Pool and Tennis Permits are on sale at Recreation Office
  • Specialty Camp Registration is ongoing.    
Village Managers Report by Village Manager Zegarelli
  • Wild foxes and bears have been seen in the Village.  Residents should stay away and call the police if there is a threat.  
  • Work continues on the FWSP Project and the Village is waiting for EFC reimbursement.  
  • Village Hall Administrative Hours are on summer hours on a trial basis.  We will be open the full day on July 1st for tax collection.  
  • Village Hall window installation has begun.  
  • DPW Roof Replacement Bids came in lower than anticipated.  
  • The Scarborough Station will be restriped.  
  • Village Tax Bills are due by July 1st without penalty.  
  • A parade was held for the baseball team.  Congratulations on their success and coming in second place.  
Public Comments

Mr. Andrew Thompson of 2 Requa Street stated he was a lifelong resident and wanted to see the Albany Post Road corridor preserved as the historic treasure it is and encouraged the Board to formulate a Master Plan.  He further stated he was opposed to the Shared Residence proposed legislation.  

Authorize Village Manager to Execute an Agreement - NYSDOT, Snow and Ice

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with the New York State Department of Transportation to amend the Indexed Lump Sum Municipal Snow and Ice Agreement for the winter of 2010-2011.

Declaration and Authorization of the Sale of Surplus Vehicles and Equipment

The Board requested they receive the list in advance of the public notice.  

The Village Manager stated he would add the surplus equipment and vehicles to the Annual Organizational Meeting.  

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees does hereby declare the Village owned vehicles and equipment listed below as surplus and further authorizes their sale pursuant to public bid retroactive to June 9, 2011.

SCAR Tax Abatement s

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution as amended:

WHEREAS, Stipulations of Settlements and Orders and the Small Claims Assessment Review have been issued for 3 Village parcels for the 2010 Mount Pleasant Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, those Stipulations of Settlements and Orders reduced the tax assessment for the properties for the Fiscal Year 2011-2012 assessment roll as set forth in the schedule below; and

WHEREAS, the Stipulations of Settlements and Orders were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bills for Fiscal Year 2011-2012 based upon the reduced assessment values in the Stipulations of Settlements and Orders and further adopts the attached set of resolutions for each of the specific properties.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 157 Washburn Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 157 Washburn Road for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $880 from $9,400 to $8,520; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $286.49 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

599 Pleasantville Road

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 599 Pleasantville Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 599 Pleasantville Road for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $2,040 from $13,400 to $11,360; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $664.12 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

611 Pleasantville Road

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 611 Pleasantville Road; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 611 Pleasantville Road for the 2010 Town assessment year, Fiscal Year 2011-2012 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order were received after the finalization of the Fiscal Year 2011-2012 assessment roll and the approval of the budget for Fiscal Year 2011-2012;

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2011-2012 assessment roll by $2,415 from $12,850 to $10,435; and

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $786.21 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

Minutes

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the minutes of the June 1, 2011 Regular Meeting as amended.  



Adjournment

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to adjourn the regular meeting at 8:20pm.
