Regular Meeting
February 16, 2011

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 16th of February 2011 commencing at 7:30 p.m.

Board of Trustees Announcements by Trustee Mayer
  • For Adult Readers… Read the book; watch the movie at the Library.  Vote on the Library’s website by February 28th for your favorite choice.  
  • The Library is offering Microsoft Publisher courses in March.  
  • Read the book; watch the movie “The Indian in the Cupboard” at the Library.  
  • Residents are required to clear their sidewalks of snow within 12 hours of a storm.  
  • Spring Summer Recreation Programs planning is underway.   
Village Managers Report by Village Manager Zegarelli
  • Work continues on the FWSP Pump Station.
  • The Village has received 2/3 of the stimulus funds.  
  • Proposed legislation is before the Governor to allow for the use of the lever style voting machines.  
  • The CSEA has filed several grievances.  
  • DPW has done great job with snow removal.  
  • At the close of business today, 98% of Village Tax has been collected.  The 5% penalty is state mandated and cannot be waived.  
  • The budget process for FY 11-12 has begun.  
Village Manager Zegarelli gave 6 month budget review presentation.  

Public Comments

A resident from 508 Pleasantville Road stated they did their best to keep the sidewalks clean in front of their home but it was a main thoroughfare and very dangerous.  She requested the Board exempt them from the 12 hour removal requirement.  

Mr. Etzold of 526 Pleasantville Road stated he had a similar complaint and the Village’s plows pushed the snow onto their sidewalks and that it was incumbent on the Village to remove the snow.  

The Board and Village Manager had general discussion regarding snow removal requirements and stated several complaints were received regarding ice and snow on the sidewalks on the Pleasantville Road corridor.  

Ms. Rosemary Hermann of 518 Pleasantville Road stated she resented getting issued a violation notice and their situation was unique and should be given special consideration.  

The Board stated it was the resident’s responsibility to remove snow but the Village would look into possibilities to help ease the burden.   

Schedule Public Hearings


Reschedule Public Hearing to Amend a Special Use Permit – Trump National Golf Club

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for March 2, 2011 to hear and consider an application to amend a Special Use Permit issued to Trump National.  

Schedule Public Hearing to Amend Chapter 168 with respect to sewers

Upon motion by Trustee Mayer, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the March 16, 2011 Board of Trustees meeting to hear and discuss a proposed local to amend Chapter 168 of the Code of the Village of Briarcliff Manor with respect to sewers.  

Confirm Village Manager’s Execution of Agreements

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees of the Village of Briarcliff Manor does hereby confirm the Village Manager’s execution of an Agreement among the Village of Briarcliff Manor, Village of Sleepy Hollow and Village of Tarrytown with the Town of Greenburgh to facilitate a water interconnection for the additional sourcing of Delaware Aqueduct Water (the “mini-Delaware”) for the 3 Villages.  Said agreement having been reviewed by Counsel shall call for the expenditure of $120,000 (Village of Briarcliff Manor’s share: $40,000) with a Village of Briarcliff Manor $4,000 contingency, subject to any non-material changes agreed to by the Village Manager, in form acceptable to Village Counsel.

NYSDOH Amendment to the Stipulation

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees of the Village of Briarcliff Manor does hereby confirm the Village Manager’s execution of an amendment to the NYSDOH Stipulation which had previously called for an extension of the FWSP completion date from January 23, 2011 to June 20, 2011.  All other terms and conditions shall continue as originally agreed.  

Board Appointments

Upon motion by Trustee Mayer, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby makes the following appointments:

Marie Pennachio as a Library Board Member to fill the remainder of a 5 year term to expire on December 31, 2015.

Anne Rybicki as the Conservation Advisory Council Chairperson for a term to expire on April 1, 2011.  

Alan Miller as a Conservation Advisory Council Member for a term to expire on April 1, 2012.  

Scheduling of Additional Work Sessions

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that commencing March 2011, the second and fourth Tuesdays of each month at 6:45pm are designated to conduct Work Sessions by the Board of Trustees.



Adjournment

Upon motion by Trustee Mayer, seconded by Trustee Capasso, the Board voted unanimously to adjourn the regular meeting at 8:45pm.
