The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 3rd of November 2010 commencing at 7:30 p.m.

Board of Trustees Announcements by Trustee Mayer

Mayor Vescio announced the Board was seeking volunteers for the Conservation Advisory Council and a committee of 5-7 members to develop a plan for a bridge over Route 9A.  Anyone interested should send their resume to the Village Manager or Village Clerk.  

  • The Library and Community Center is hosting an event “Hudson River Lighthouses” on 11/4.  
  • The Library and Community Center is offering several computer classes and programs.  Those interested should visit the Library’s website.  
  • There will be a family movie night showing of “Diary of a Wimpy Kid” on November 18th at the Library on the big screen.  
  • The platform tennis season is upon us and the permits are currently on sale.  
  • The deadline to register for basketball and floor hockey is approaching.  
  • The Winter Recreation Brochure will be online shortly.  
  • The Community Bonfire and Sing-A-Long will be on Sunday, December 5th at 5pm.  
  • Please be aware of slippery conditions in the fall leaf season.  Please don’t pile leaves on sidewalks or in the roadway.  
Village Managers Report by Village Manager Zegarelli
  • The Full Supply Water Project is moving along well.  
2011 Scarborough Station Parking Permit applications are available on the website.    
  • The sidewalk project at the Scarborough Station will begin on November 9th.  
  • The Village Hall Window and Door Replacement Project is moving ahead.  
  • The Pocantico River Clear and Snag Project is going well.  
  • The sidewalk in front of Village Hall will be replaced with stamped concrete and evaluated to see if it will work for the Central Business District.  
Village Manager Zegarelli and Village Treasurer Rizzo gave a 4 month budget update.

Amend Master Fee Schedule

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:  

BE IT RESOLVED that the Board of Trustees does hereby amend the Master Fee Schedule for the Village of Briarcliff Manor as follows:

Election Resolution for Annual Village Election

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:  

BE IT RESOLVED that the annual Village Election will be held in the Village of Briarcliff Manor on Tuesday, March 15, 2011 between the hours of 6:00am and 9:00pm during which the polls will be open.  

BE IT FURTHER RESOLVED that the following Village Offices are to be elected at the annual Village Election of March 15, 2011 for the terms as set forth herein:

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution as amended:  

SINGLE VILLAGE ELECTION DISTRICT
WHEREAS, the Village of Briarcliff Manor (“Village”) historically has been divided into multiple election districts voting at a single location in Village elections; and
WHEREAS, New York State Election Law Section 15-110 provides that a Village shall constitute a single election district for Village elections unless it resolves otherwise; and
WHEREAS, the Board of Trustees of the Village (“Village Board”) believes that constituting the Village as a single election district for Village elections would not have any impact on resident voting since voting historically has been in a single location even with multiple districts; and  
WHEREAS, the Village Board also believes that constituting the Village as a single election district for Village elections would be more economical and efficient than having multiple districts;
NOW THEREFORE, BE IT
RESOLVED, that in accordance with New York State Election Law~§15_110(5), the Village shall constitute a single election district for Village elections; and be it further
RESOLVED, that the boundaries of the Village shall constitute the boundaries of the election district; and be it further
RESOLVED, that this Resolution shall take effect immediately and apply to the next Village general election to be held March~15, 2011; and be it further
RESOLVED, that the Village Clerk is instructed to post and publish this Resolution in accordance with New York State Election Law~§15_110(5); and be it further
RESOLVED, that this Resolution shall be construed and applied in accordance with and consistent in all respects with New York State Election Law~§15_110, any other applicable provision of New York State Election Law, and any other applicable provision of law.

Authorize Village Manager to Execute Agreement – NYSDOT Snow & Ice

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:  

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with the New York State Department of Transportation to amend the Indexed Lump Sum Municipal Snow and Ice Agreement for the period from July 1, 2012 through June 30, 2013.

Authorize Submission of 2010 Grant Justice Court Assistance Program

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution as amended:  

BE IT RESOLVED that permission to submit a grant for the maximum amount allowable with the Justice Court Assistance Program is hereby granted.  

BE IT FURTHER RESOLVED that the Village Manager is hereby authorized to submit all paperwork in accordance with the grant.  
 

Minutes

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, with one abstention by Trustee Mayer, the Board voted to approve the minutes of October 26, 2010.  

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, with one abstention by Trustee Mayer, the Board voted to approve the minutes of October 26, 2010.  


The Board will adjourn the regular meeting and reconvene as the Board of Police Commissioners.  

Upon motion by Trustee Sullivan, seconded by Mayer, the Board voted unanimously to convene as the Board of Police Commissioners.  

Authorize Village Manager to Execute a Stipulation Agreement with a Police Officer

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously 5-0 to approve the following resolution:
WHEREAS, the Village of Briarcliff Manor Board of Trustees, acting as Trustees and/or as the Board of Police Commissioners, does hereby authorize a Stipulation Agreement with Police Officer A.  

Upon motion Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to adjourn the Special Meeting of the Board of Police Commissioners.  

Adjournment

Upon motion by Trustee Capasso, seconded by Trustee Mayer, the Board voted unanimously to close the regular meeting at 8:20pm.
