The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 4tht of August 2010 commencing at 7:30 p.m.

Public Hearing to Amend Chapter 56 of the Village Code and Provide for Retirement Incentive Pursuant to Part A of New York Laws Chapter 105 of Laws of 2010
Public Hearing to Amend Chapter 56 of the Village Code and Provide for Retirement Incentive Pursuant to Part B of New York Laws Chapter 105 of Laws of 2010
Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to open the public hearings jointly.
Trustee Sullivan requested on Part A the word “all” be removed from page 2 under section C and replaced by the number “1”.
Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to close both public hearings.
Amendments to Chapter 56 of the Village Code to provide for Retirement Incentives Pursuant to Parts A & B of New York Laws Chapter 105 of Laws of 2010
Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to amend the proposed local law to incorporate Trustee Sullivan’s amendment to Part A.
Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the proposed local law to amend Chapter 56 of the Code of the Village of Briarcliff Manor to provide for a retirement incentive pursuant to Part A of New York Laws Chapter 105 of Laws of 2010 is hereby adopted as amended.
Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the proposed local law to amend Chapter 56 of the Code of the Village of Briarcliff Manor to provide for a retirement incentive pursuant to Part B of New York Laws Chapter 105 of Laws of 2010 is hereby adopted.
Board of Trustees Announcements by Trustee Capasso
- The Summer Soiree and Book Swap will be on August 12th at 7pm.
- The Make a Splash Pizza Party will be on August 26th at 4:30pm.
- Day Camp is in its final week.
- 1 week long specialty camps are being offered. Interested parties should visit the Recreation Page at www.briarcliffmanor.org.
- The Pool is open and permits are required.
- Community Day will be held on Saturday, September 11th with a raindate on Sunday, September 12th.
Village Managers Report
- The Full Supply Water Project is moving along well.
- The Village will be getting funds from FEMA for the Pocantico River Project and for the storm damage.
- Scarborough Station Track 3 is back in service.
- The Village Hall Window and Door Replacement Project is going out to bid.
- The Village Hall Roof Project will commence after Labor Day.
- The Village Hall Exterior Lighting Analysis has been completed.
- Masonry repair is being done on the Scarborough Road Bridge by DPW.
- Sales Tax revenue came in just as expected.
- The pond at Law Park was restocked with carp to help alleviate the duck weed and algae issues.
Public Comments
Ms. Nancy Israel of 43 Pine Road stated she was a member of the Briarcliff Manor Affordable Housing Taskforce and read aloud their tentative mission statement. She stated she looked forward to working with the Village for affordable housing solutions and hoped to attract more citizen participation.
Mayor Vescio stated the Village would be moving forward with rezoning the downtown business district as per the Comprehensive Plan and the Village was pursuing avenues for affordable housing. He stated the Village was ahead of the curve with the federal mandate.
Budget Transfers
The Board asked for a clarification of what various transfers were for. They asked that descriptions be given in future resolutions.
Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the budget for Fiscal Year 2009-2010 is hereby amended as follows:

Mayoral Appointment
Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to confirm the following Mayoral appointment of Acting Village Justice:
BE IT RESOLVED THAT, Laurie Sullivan, is hereby appointed as Acting Village Justice to fill the unexpired term to expire on April 1, 2011.
SEQRA finding for Solar Array at DPW
Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:
STATE ENVIRONMENTAL QUALITY REVIEW
NEGATIVE DECLARATION
RESOLUTION OF NON-SIGNIFICANCE
WHEREAS, the Village Board of Trustees (“Board”) has reviewed schematic plans for the construction of the proposed solar array at the Village of Briarcliff Manor Department of Public Works (“DPW”) building (“Project”), located at 10 Buckout Road in the Village of Briarcliff Manor, NY, Village; and
WHEREAS, the Board has determined that the Project is subject to the State Environmental Quality Review Act [“SEQRA” (6 NYCRR Part 617)] and does not involve any federal agency and that the Project is an Unlisted action pursuant to 6 NYCRR. §617.2(ak); and
WHEREAS, the Board is the only agency with authority to undertake, fund, or approve the Project; and
WHEREAS, pursuant to 6 NYCRR. §617.6(b)(1), the Board is the SEQR Lead Agency for the proposed action; and
WHEREAS, the Board has reviewed a Short Environmental Assessment Form (“Short EAF”) and supporting documentation prepared by the Village Engineer and has considered the probable environmental impacts of the Project as set forth in the EAF; and
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
- The Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein.
- That on the basis of the EAF, the Board finds that the Project will not result in significant adverse environmental impacts and adopts the EAF’s proposed declaration that the Project will not result in any significant adverse environmental impact (“Negative Declaration”);
- That the Mayor is authorized to execute the EAF and, for the reasons set forth, to execute and file a Negative Declaration in accordance with the applicable provisions of the law.
Minutes
Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the minutes of July 21, 2010 as amended.
Adjournment
Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously adjourn into executive session to discussion a personnel matter and then to close the regular meeting thereafter at 8:05pm.
