The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 21st of July 2010 commencing at 7:30 p.m.

Public Hearing to Amend Chapter 56 of the Village Code and Provide for Retirement Incentive Pursuant to Part B of New York Laws Chapter 105 of Laws of 2010

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to open the public hearings jointly.  

Village Manager Zegarelli explained the Village’s separation incentive and how it would work in conjunction with the proposed local laws.  

The Board had general discussion relating to which titles were eligible, how many employees held those titles and how many employees qualified for the program.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to adjourn the public hearings to August 4, 2010.  

Board of Trustees Announcements by Trustee Sullivan

  • A Library User Survey is available at the Library or on the website for patrons to fill out.  
  • The Library summer reading program is underway and is having several movie nights for different age groups throughout the summer.     
  • The Pool is open and permits are required.
  • Summercliff Players presents Urinetown on July 23-25.  Tickets are available online at showtix4u.com
  • Community Day will be held on Saturday, September 11th with a raindate on Sunday, September 12th.  
  • The Recreation Staff is looking for input on Fall programs.  
  • Engine 92 is back at Scarborough Station and the Board thanked Archville Fire Department for allowing the Village to store the truck at their location.  
Village Managers Report

  • The Full Supply Water Project is moving along well.  
  • Water consumption is extremely high.    
  • The Village will be getting funds from FEMA for the Pocantico River Project.  
  • Fire Hydrant Repairs are underway
  • The Village’s 2009-2010 Fiscal Year is closed out.  
Public Comments

Ms. Kay Gresar stated that she worked at Prescription Plus and there was a plan to close their pharmacy and put in a CVS.  She asked for the Board’s support to determine what was best for the Village and quality of life.  

Ms. Maria Anella of Prescription Plus stated there were untruths printed in the paper about their pharmacy and their lease agreement.  

Ms. Jill Weiner asked why the parking lot wasn’t addressed when the shopping center was first designed.  

Mr. Robert Sherman stated large corporations were only interested in the bottom line and not in the customer.  

Mr. Sayid Ramen of Prescription Plus stated laws were to protect the Community and the Village was changing into a City.  

Ms. Rosemary Miller of Prescription Plus stated that Pleasantville and Ossining both changed from being rundown to vibrant and thriving.  She asked why Briarcliff hadn’t done the same.  

Mayor Vescio stated the owner of the property had the right to apply to amend their site plan.  He stated the application was to redevelop the shopping center and bring it up to the current Village Code and building standards.  He further stated the Village did not determine who goes into each retail space and that right was reserved for the applicant.  He stated the Village would address some of the antiquated language in the Zoning Code regarding parking and there would be public hearings during that process.  He encouraged the public to attend the Planning Board meetings and gather facts about the application.  

Tax Abatements

The Board requested changes to the resolution add columns tallying up the total refunds and total abatements.  

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:  

WHEREAS, Stipulations of Settlements and Orders and the Small Claims Assessment Review have been issued for 21 Village parcels for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, those Stipulations of Settlements and Orders reduced the tax assessment for the properties for the Fiscal Year 2010-2011 assessment roll as set forth in the schedule below; and

WHEREAS, the Stipulations of Settlements and Orders were received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bills for Fiscal Year 2010-2011 based upon the reduced assessment values in the Stipulations of Settlements and Orders and further adopts the attached set of resolutions for each of the specific properties.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 369 Long Hill Road East; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 369 Long Hill Road East for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $16,800 from $74,600 to $57,800; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $3,256.62 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,466.79 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $733.39 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

12 Justine Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 12 Justine Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 12 Justine Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $13,915 from $57,915 to $44,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,528.25 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,214.90 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $336.40 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

11 Berkley Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 11 Berkley Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 11Berkley Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $7,706from $42,706 to $35,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $1,864.31 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $672.80 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $336.40 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

5 Elizabeth Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 5 Elizabeth Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 5 Elizabeth Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $6,181 from $39,681 to $33,500; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $1732.25 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $539.66 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $269.83 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

4 Elizabeth Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 4 Elizabeth Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 4 Elizabeth Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $5,381 from $37,881 to $32,500; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $1,653.67 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $469.81 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $234.90 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

2 Elizabeth Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 2 Elizabeth Court; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 2 Elizabeth Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $8,700 from $43,050 to $34,350; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $1,870.59 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $759.59 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $379.79 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

55 Peachtree Lane

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 55 Peachtree Lane; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 55 Peachtree Lane for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $18,600 from $76,600 to $58,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $3,343.93 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,623.94 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $811.97 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

33 Peachtree Lane

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 33 Peachtree Lane; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 33 Peachtree Lane for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $11,000 from $67,000 to $56,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,924.85 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $960.40 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $480.20 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

63 Hollowtree Lane

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 63 Hollowtree Lane; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 63 Hollowtree Lane for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $4,715 from $66,115 to $61,400; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,886.21 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $411.66 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $205.83 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

28 Tanglewood Circle

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 28 Tanglewood Circle; and

WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 28 Tanglewood Circle for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $14,800 from $81,900 to $67,100; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $3,575.30 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,292.17 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $646.09 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

158 Hirst Road

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 158 Hirst Road; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 158 Hirst Road for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $13,865 from $87,865 to $74,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $3,835.70 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,210.54 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $605.27 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

7 Avondale Court

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 7 Avondale Court; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 7 Avondale Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $14,820 from $59,320 to $44,500; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,589.58 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,293.92 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $646.96 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 6 Avondale Court; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 6 Avondale Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $7,600 from $50,800 to $43,200; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $663.55 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 5 Avondale Court; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 5 Avondale Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $13,540 from $54,140 to $40,600; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,363.45 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,182.16 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $591.08 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 177 Quinn Road; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 177 Quinn Road for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $10,000 from $55,000 to $45,000; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,400.99 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $873.09 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $436.54 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 96 Elm Road; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 96 Elm Road for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $11,270 from $54,470 to $43,200; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,377.86 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $983.97 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $491.99 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 51 Cherry Hill Court; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 51 Cherry Hill Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $10,650 from $48,750 to $38,100; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,128.15 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $929.84 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $464.92 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 91 Cherry Hill Court; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 91 Cherry Hill Court for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $15,595 from $62,380 to $46,785; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

WHEREAS, the Village received payment in the amount of $2,327.16 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $1,361.58 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 122 Old Briarcliff Road; and
        
WHEREAS, a Stipulation of Settlement and Order in the Small Claims Assessment Review has been issued for the property at 122 Old Briarcliff Road for the 2009 Town assessment year, Fiscal Year 2010-2011 Village assessment roll; and

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $19,125 from $83,375 to $64,250; and

WHEREAS, the Village received payment in the amount of $3,025.25 for the first installment of 2010-2011 taxes due on the property based on the assessed value prior to any adjustment of the Stipulation of Settlement and Order (“First Installment Payment”);

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $986.59 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

WHEREAS, the Stipulation of Settlement and Order reduced the tax assessment for the subject property for the Fiscal Year 2010-2011 assessment roll by $10,100 from $55,300 to $45,200; and

WHEREAS, the Stipulation of Settlement and Order was received after the finalization of the Fiscal Year 2010-2011 assessment roll and the approval of the budget for Fiscal Year 2010-2011;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2010-2011 in the amount of $881.82 based upon the reduced assessment value and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement and Order.

BE IT FURTHER RESOLVED, that the payment of a tax refund in the amount of $440.91 as that portion of the First Installment which the Village collected in excess of what the First Installment Payment should have been if the taxes had been determined based upon the reduced assessment value in the Stipulation of Settlement and Order.

Authorize Village Manager to Execute an Agreement with Westchester County for Police Mutual Aid

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an Inter-municipal Agreement with Westchester County for the participation of the Village of Briarcliff Manor in the Mutual Aid and Rapid Response Plan for the Police Departments of Westchester County.  

Fire Department Membership - Rowan

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Andrew Rowan to the Briarcliff Manor Fire Company.  


Minutes

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the minutes of July 7, 2010 as amended.
