Regular Meeting
July 7th, 2010

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 7th of July 2010 commencing at 7:30 p.m.

Board of Trustees Announcements by Deputy Mayor Venditti

  • The Board sent their condolences to Assistant Fire Chief, Mike King for the loss of his father, Robert J. King, who was Fire Chief from 1981-1983.  
  • The Library summer reading program is underway and is having several movie nights for different age groups throughout the summer.     
  • Family Fun night will be on July 9th at the Village Pool.  
  • The Pool is open and permits are required.
  • Day Camp is in its second week and limited registration is still being accepted for the 2nd session.  
Village Managers Report

  • The Full Supply Water Project is moving along well.  
  • Water consumption is up significantly and the NYC Water Board has increased their excess water rates by 25%.  
  • The final submission was made to FEMA for storm cleanup and the Village is awaiting payment.  
  • The Village has received $5 million in tax payments which is 53% of the total annual tax revenue.  
  • Scarborough Firehouse is expected to be completed and fully operational by July 18th.

Budget Transfers – Library

Trustee Sullivan noted the budget transfer was a reallocation of funds and they were not increasing the overall budget.  

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

Authorize Village Manager to Execute an Agreement for Senior Advocate Services

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with Family Services of Westchester, Inc. for Senior Advocate Services for the period from June 1, 2010 through May 31, 2011 per their proposal of $20,000.   

Authorize Village Manager to Approve a Change Order for the Full Water Supply Project – Pump Station

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees hereby approves the following change orders totaling $485.00:

Change Order 1 (Mercator Land Surveying) in the amount of $485.00 for plan revisions for the Pump Station.  

Schedule Public Hearing to Amend Chapter 56 of the Village Code and Provide for Retirement Incentive Pursuant to Part A of New York Laws Chapter 105 of Laws of 2010

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the July 21, 2010 Board of Trustees meeting to hear and discuss a proposed local law to amend Chapter 56 of the Village Code and provide for a retirement incentive pursuant to Part A of New York Laws Chapter 105 of Laws of 2010   

Schedule Public Hearing to Amend Chapter 56 of the Village Code and Provide for Retirement Incentive Pursuant to Part B of New York Laws Chapter 105 of Laws of 2010

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the July 21, 2010 Board of Trustees meeting to hear and discuss a proposed local law to amend Chapter 56 of the Village Code and provide for a retirement incentive pursuant to Part B of New York Laws Chapter 105 of Laws of 2010   

Abolishment of Vacant Positions

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

WHEREAS, at the Village’s request, the Westchester County Department of Human Resources supplied the Village with a report of authorized titles for full time positions and permanent part time positions for the Village of Briarcliff Manor; and

NOW THEREFORE BE IT RESOLVED that in keeping with the current economic climate, the Village wishes to remove any vacant titles and any other titles deemed surplus specified below:

Budget Amendments – Non-Budgeted Line Items

The Board requested a policy be drafted to ensure the Village was paid for all expenses associated with off duty police being hired for private events.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the budget for Fiscal Year 2009-2010 is hereby amended as follows:

Increase Expenses – Police Off-Duty
(A3120.112) by $13,187.64

Increase Revenue – Police Off-Duty
(A0103.1521) by $13,187.64

Increase Expenses – Insurance Recovery
(A1989.425) by $35,048.24

Increase Revenue – Insurance Recovery
(A0101.2680) by $35,048.24

Authorize Village Manager to Approve a Change Order for the Library

Mayor Vescio noted the project was completed under budget.  

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that the Board of Trustees hereby approves the following change order to be charged to Fiscal Year 2009-2010:

Change order LJC-02 credit in the amount of ($5,000.00) for issues regarding the installation of the sprinkler piping on the 2nd floor.    

Authorization of an Application for Funding From the New York State Office of Parks, Recreation and Historic Preservation for Scarborough Park Improvements

The Board had general discussion regarding the 100% matching requirement of the grant.  

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that Philip Zegarelli, as Village Manager of the Village of Briarcliff Manor is hereby authorized and directed to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $400,000, and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to the Village of Briarcliff Manor for improvements at Scarborough Park and, if appropriate, a conservation easement/preservation covenant to the deed of the assisted property.

Upon motion by Trustee Mayer, seconded by Trustee Capasso, with one abstention from Deputy Mayor Venditti, the Board voted to approve the minutes of June 16, 2010 as amended.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the minutes of June 26, 2010 as amended.  

Adjournment

Mayor Vescio stated the Police Department was awarded a grant for a license plate reading system.  He thanked the State and congratulated the Police Department.  He stated that despite the New York City Water Board increasing their rates, they were still significantly less than the charges from Ossining or New Castle whose rates were $9,000 per million gallons of water.  He asked residents to still conserve water when possible.  

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to close the regular meeting at 8:45pm.
