Regular Meeting
April 7, 2010
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 7th of April 2010 commencing at 7:30 p.m.

Public Hearing Fiscal Year 2010-2011 Tentative Budget

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to open the public hearing.  

Village Manager Zegarelli gave an overview of the FY 2010-2011 Tentative Budget.  

The Board had general discussion relating to the budget process, the Equalization Rates determined by New York State and assessments.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to adjourn the public hearing to April 20, 2010 at 7:00pm.  

The Board thanked Village Manager Zegarelli, Village Treasurer Rizzo and Village Staff for their hard work on the budget.  

Village Managers Report

  • The Full Supply Water Project is moving along well.  
  • Census 2010 forms are in the mail.  
  • Storm debris brought to the curbside will be picked up the DPW through April 16th.
  • A NYSERDA grant was received to install solar panels on the roof of the DPW building.  
A follow up meeting will be scheduled with Con Edison regarding storm management and the tree trimming program.  
The Village is working to improve drainage at the fields.  
  • Stash the Trash will be on April 24th at the Youth Center.
  • Despite the economy the Village experienced a 99.6% collection of the Village Taxes.    
Mayor Vescio gave a status update regarding the Scarborough Fire House construction.

Budget Amendment - Scarborough Park Fishing Platform Design Grant

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the budget for fiscal year 2009-2010 is hereby amended to accept a Grant from the New York State Department of State towards the design of a fishing platform at Scarborough Park as follows:  

Increase Expense – Scarborough Park Design (H7110.201.06740) by $1,811.67.  

Change Orders – Full Supply Water Project - Federal Davis-Bacon Prevailing Wage Requirement

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that the Board of Trustees hereby approves the following change orders at no cost to the Village:

Change Order 001 (LJ Coppola) to modify the contract by adding the Federal Davis-Bacon Prevailing Wage requirement.    

Change Order 001 (Carey and Walsh) to modify the contract by adding the Federal Davis-Bacon Prevailing Wage requirement.    

Change Order 003 (Jett Industries) to modify the contract by adding the Federal Davis-Bacon Prevailing Wage requirement.    

Change Order 001 (Talt Electric) to modify the contract by adding the Federal Davis-Bacon Prevailing Wage requirement.    

Fire Department Service Awards Program

The Board thanked the volunteers for all the hours they put it in and stated they would approve the resolution as long as the blanks in the service credit were replaced with zeros.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Volunteer Firefighter Service Award Program list for all 2009 active firefighters of the Briarcliff Manor Fire Company, the Briarcliff Manor Hook, Ladder & Fire Company and the Scarborough Engine Company is hereby approved.

BE IT FURTHER RESOLVED that the list shall be directed to the respective fire companies for posting for a period of thirty (30) days.

Fire Department Membership - Solberman

Upon motion by Deputy Mayor Venditti, seconded by Trustee Capasso, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Pauline Solberman to the Scarborough Engine Company.  

Retainer Agreement – WKGJ

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a general retainer agreement with Wormser, Kiely, Galef and Jacobs for legal services for the period from April 1, 2010 through March 31, 2011 for a fixed rate of $93,252, and on a pro-rated monthly basis thereafter for the months of April and May 2011 to coincide with the Fiscal Year.  

Minutes

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, with two abstentions from Deputy Mayor Venditti and Trustee Capasso, the Board voted to approve the minutes of March 4, 2010 as amended.  

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, with two abstentions from Trustee Mayer and Trustee Capasso, the Board voted to approve the minutes of March 18, 2010 as amended.  

Adjournment

Upon motion by Trustee Capasso, seconded by Trustee Sullivan, the Board voted unanimously to close the regular meeting at 8:55pm.  

The continuation of the Tentative Budget Public Hearing will be held on Tuesday, April 20th at 7pm and the next regular Board of Trustees meeting will be on Wednesday, April 21st.
