Regular Meeting
January 7, 2010
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 7th of January 2010 commencing at 7:30 p.m.

Proclamation: Briarcliff High School Girls Varsity Soccer Team

Mayor Vescio read aloud the proclamation and presented it to Team Captain, Katie Underwood on behalf of the Soccer Team.  

Proclamation: Madeline Berkman

Mayor Vescio read aloud the proclamation and presented it to School District Superintendant Dr. Fran Wills on behalf of Madeline.  

Board of Trustees Announcements by Trustee Mayer
  • The temporary platform at the Scarborough Station will be dismantled and track 3 will remain out of service due to work being done in Ossining.  
  • The Library and Community Center is offering hands on computer classes and Story Time on Saturdays. Registration is required.      
  • Briarcliff and Pleasantville Recreation will be offering some programs jointly.  Please visit the website for more information.  
Village Managers Report by Village Manager Zegarelli
  • 8,000 lineal feet of pipeline was installed out of the 19,000 for the Full Water Supply Project.  
  • The Rosecliff Tank Rehabilitation Project has been completed.
  • The turbidity is up in the water because of getting everything online.  The primary source is Catskill but it will be helped by the Delware.  
  • The Stimulus Funding initial reports have been completed.        
  • The RFP was sent out for Scarborough Park.    
The grant was awarded to the Village for the study of the consolidation of the Water Department.  
  • Village Hall ceiling and lighting replacements are underway.  
Trustee Sullivan stated a number of neighborhoods received a mailing from Con Edison regarding tree trimming.  She urged residents to communicate with Con Edison.  

Village Manager Zegarelli stated he had a meeting scheduled with Con Edison on the upcoming Monday.  

Public Comments

Mr. Clay Tiffany of Hall Road stated Mount Pleasant Town Justice Ponzini was a long time friend of Village Manager Zegarelli and asked if Deputy Mayor Venditti worked for Mr. Ponzini’s law firm.  He asked if there were any lawsuits pending in Sleepy Hollow that involved Village Manager Zegarelli.  

Authorize Village Manager to Execute an Agreement with New York State Department of Transportation Snow and Ice Agreement For 2011-2012

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute an agreement with the New York State Department of Transportation to extend the Indexed Lump Sum Municipal Snow and Ice Agreement for the period from July 1, 2011 through June 30, 2012.

Election Resolution for Annual Village Election 2010

Mr. Clay Tiffany of Hall Road stated the Village Election should be emphasized more and the caucus system was fatally flawed and partisan.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the annual Village Election will be held in the Village of Briarcliff Manor at the Youth Center (5 Van Lu Van Road) in said Village on Tuesday, March 16, 2010 between the hours of 6:00am and 9:00pm during which the polls will be open.  

BE IT FURTHER RESOLVED that the polling places for the Village of Briarcliff Manor, will be designated as follows, Voting districts #15, #16, #17, #19, #26, #27 and #29 will vote in the Briarcliff Manor Youth Center located at 5 Van Lu Van Road.  

Schedule Public Hearing, Amendment to Special Use Permit, Briarcliff Manor Investors (The Club at Briarcliff Manor)

Village Attorney Smith explained the proposed amendment.  

Trustee Sullivan stated a letter was received from Cuddy and Feder on behalf of The Club requesting the amendment.  

The Board requested amendments to the resolution.  
Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the February 18, 2010 Board of Trustees meeting to hear and consider a request from Briarcliff Manor Investors LLC and Integrated Development Group LLC to modify the Special Use Permit initially issued to Barrington Venture, LLC and The Garlands of Briarcliff Manor, LLC, with amendments issued to CC-Briarcliff LLC and Classic Residence by Hyatt, and currently issued as the “Third Amended and Restated Special Permit and Tree Removal Permit” to Briarcliff Manor Investors and Integrated Development Group (located at the former Kings College property).

Referral to the Planning Board

BE IT RESOLVED that the proposed modification of the Special Use Permit issued to Briarcliff Manor Investors and Integrated Development Group is hereby directed to the Village Planning Board and to the Westchester County Planning Board for review and recommendation.

Mr. Clay Tiffany of Hall Road asked for a ballpark figure as to how many cars The Club would generate compared to how many the potential development of Mr. Erani’s property would generate.  

Mayor Vescio stated they would get him the information.  

Schedule Public Hearing to Amend Chapter 220 of the Code of the Village of Briarcliff Manor with Respect to CCRC’s as Special Uses in Residence Districts

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the February 18, 2010 Board of Trustees meeting to hear and discuss a proposed local law to amend Section 220 of the Code of the Village of Briarcliff Manor with respect to CCRC’s as Special Uses in Residence Districts.  

Referral to the Planning Board

BE IT RESOLVED that the proposed local law to amend Section 220 of the Code of the Village of Briarcliff Manor with respect to CCRC’s as Special Uses in Residence Districts is hereby directed to the Village Planning Board and to the Westchester County Planning Board for review and recommendation and to the Town of Ossining, Town of Mount Pleasant and the Village of Ossining for review and comment as they see fit.

Minutes

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the minutes of December 3, 2009 as amended.  

Adjournment

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to close the regular meeting at 8:15pm.
