Regular Meeting
October 1, 2009
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 1st of October 2009 commencing at 7:30 p.m.

Recognition of Years of Service

Mayor Vescio stated the employees being honored could not be present.  He thanked Kevin McFadden, Martin DeCesaris, Michael Bassett and Donald Gorey for their many years of service.  

Mr. Clay Tiffany stated issues he had with the Police Officers being honored.  

Board of Trustees Announcements by Trustee Mayer
  • The Library and Community Center will be hosting a knitting club starting October 13th as well a series of discussions regarding the Quadricentennial.  
  • Community Day was held on September 26th and was a great success.  
  • Halloween Window Painting will be on October 17th
  • The Ragamuffin Parade will be on October 31st at 9:30am
  • Daylight hours are limited.  Please drive safely.  
  • Happy Birthday to Trustee Sullivan.
Village Manager’s Report by Village Manager Zegarelli
  • Water consumption for the last four months has been consistently down.
  • FWSP construction is progressing.  Daily site visits are being done.
  • The Village is taking the lead on the Delaware Tap Application.
  • The painting of Mr. Law is back from rehabilitation.
  • The current valet parking contract is being reviewed.  It will need to be re-bid.
  • An H1N1 session was held with all Department Heads and various sanitizing materials have been acquired.  
  • The annual paving program is about to begin.
  • The landscaping program for the Library is being worked on with Dawn Orza.
  • Due to the rare financial market the $8.2 million borrowed to bridge the FWSP at .5420% was reinvested at .55% essentially remaining neutral.
  • The Police Department was awarded a $30,000 grant for technology.  
Public Comments

Mr. Jim Barnett of 240 North State Road stated he lived on a residential road with some offices and each morning starting at 6am the march of the school buses began.  He stated that 62 buses pass his house every week day morning twice and again in the evening causing several problems.  He stated their health was more important than traffic and asked that they find another route or a new place to keep them.  

Ms. Fatima Barnett of 240 North State Road stated they have lived here for 12 years, love the community and are extremely concerned.  

Mayor Vescio stated the Village could not restrict the use of the road and the air quality was most likely the result of over 11,000 cars passing through the intersection of Route 9A and North State Road.  He stated the Village had plans to make a recommendation for an overpass which would help clean up the air but in the short term was trying to put in a right turn lane.  

Trustee Waxenberg asked Village Counsel if the Village had any role.

Village Attorney Smith stated if it was a County road the Village had no control and it had a dedicated public use.  He stated the Village had the authority to ask them to route the buses another way but the road was being used as it was intended.  

Trustee Sullivan suggested contacting the Ossining School Board.  

Mr. Clay Tiffany of Hall Road displayed various pictures before the Board and read a statement aloud regarding an incident with former Police Officer Tartaglione on September 19, 2009.  

Authorize Village Manager to Execute an Agreement with the New York City Department of Environmental Protection

Village Manager Zegarelli stated the DEP was insistent on creating a water district for the outside district and in his opinion it would strengthen the Village’s relationship with outside customers.  

Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees hereby authorizes the Village Manager to execute, deliver and perform the Water Agreement between the Village of Briarcliff Manor and the New York City Department of Environmental Protection in connection with the Village’s Full Water Supply Project.  

Budget Transfers – Recreation

Village Manager Zegarelli stated the extra expenses for the day camps did not outpace the revenue received.  

Upon motion by Trustee Waxenberg, seconded by Trustee Sullivan and one vote of no by Mayor Vescio, the Board voted to approve the following resolution:

Fire Department Membership - Wall

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Kelly Wall to the Briarcliff Manor Fire Company.  
                                                                                                                                                                                                                                                                   
Minutes

Upon motion by Trustee Mayer, seconded by Trustee Waxenber, the Board voted unanimously to approve the minutes of August 20, 2009 as amended.  

A Special Work Session has been scheduled for October 15th at 6:30pm.

Adjournment

Upon motion Trustee Waxenberg by, seconded by Trustee Sullivan, the Board voted unanimously to close the regular meeting at 8:15pm.
