Regular Meeting
September 3, 2009
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 3rd of September 2009 commencing at 7:30 p.m.

Board of Trustees Announcements by Deputy Mayor Venditti
  • School Starts next Tuesday and Residents are asked to exhibit more caution on the roads
  • Community Day is on 9/12 at 2pm
  • Back with a Splash Party 9/10 for Youth Center will be at the Pool
  • The Recreation Fall/Winter Brochure is out and program registration begins 9/12
  • The drainage project in the lawn area will be started after the pool closes
  • The hours during the final days of the pool season will be 11am-7:30pm.  The Board thanked the pool patrons for making the most out of the season.  
Mayor Vescio stated the Village had been awarded $18.8 million in stimulus money towards the Full Water Supply Project.  He read an excerpt from Governor Paterson’s August 31st Press Release.  He stated it was very good news for the Village and its taxpayers.  He thanked the Governor and President Obama.  He further thanked Village Manager Zegarelli and the staff for their diligence and for a wonderful job getting this through.  

Deputy Mayor Venditti also thanked Village Manager Zegarelli and stated they owed a great thank you to Mayor Vescio for taking the water project by the horns and getting the project to be shovel ready and eligible for funding.  

Village Manager’s Report by Village Manager Zegarelli
  • The DOH stipulation has been extended to January 24, 2011 and all the penalties have been lifted.  
  •  A notice was sent to all residents regarding “HAA5” in the water.
  • The FWSP (Full Water Supply Project) construction will start on September 14th with early finish of June 2010 projected for Pump Station and May 2010 for the Transmission Main.  
  • The Rosecliff Tank meeting will be on Thursday, September 10th at the Rosecliff Mansion.  
  • The August Manor Monthly was centered on the Scarborough Fire Station and September’s will be based on the FWSP.  
  • The meetings are underway regarding the consolidation of Courts.  
  • The Primary is on September 15th
  • The McCrum Field drainage and fence repairs are completed.  
  • The Brookwood project is complete.  
  • The Scarborough Station Water Main is 90% complete
  • September 14th begins the 2008-2009 Audit
  • Due to excellent credit rating the BANS are very successful and have great rates.  
  • There have been recent alerts about pending changes to the NYS Pension Fund and obligations for 2010-2011.  There will be some large impacts for some municipalities.  
  • The Library Punch List is almost complete.  
  • Progress is continuing at the Scarborough fire station.  
Public Comments

Mr. Clay Tiffany read a statement aloud regarding previous events and lawsuits.  He further read a statement from a family member of his Bertrand Russel.

Mr. Peter Gasperini of 403 Pine Road thanked Village Manager Zegarelli and Ed Torhan for coming out to his property.  He stated he was very impressed with them and asked when the work would be done.

Mayor Vescio stated the short term solution would most likely be done by the end of the year and that Village Manager Zegarelli would keep Mr. Gasperini informed.  

Amend Master Fee Schedule – Recreation Fees

Village Manager Zegarelli stated any department proposing new fees for the next fiscal year will submit them by February.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution.  

BE IT RESOLVED that the Board of Trustees does hereby amend the Master Fee Schedule for the Village of Briarcliff Manor as follows:

Acceptance of Gift and Donation from Briarcliff Manor Little League

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the budget for fiscal year 2009-2010 is hereby amended as follows:  

Increase Revenue - General Fund Gifts and Donations
(A0101.2705) by $1000

BE IT FURTHER RESOLVED that the Board of Trustees does hereby accept the donation of foul poles for the Neighborhood Park Baseball field.

Schedule Public Hearing to Amend a Special Use Permit – Verizon Wireless Telecommunications located at Scarborough Presbyterian Church

Mayor Vescio stated the Board wouldn’t schedule the public hearing until they heard the Planning Board’s recommendation.  

Mr. Michael Sheridan, Attorney for the Applicant, stated their application would be before the Planning Board at their September 8th meeting.  

Mr. Clay Tiffany stated there were a number of studies done showing that cell phones were detrimental to people’s health.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the request to amend a Special Use Permit for Verizon Wireless to install a generator at a wireless telecommunications facility located at Scarborough Presbyterian Church is hereby directed to the Planning Board for review and recommendation.

Acceptance of Donation from the Rotary Club of Briarcliff Manor

Mr. Clay Tiffany stated in his opinion the Rotary Club was politically partisan and racist.    

Trustee Sullivan requested before any future placements of benches were decided they should come before the Board to formally accept the gifts.  

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees hereby accepts the donation of benches from the Rotary Club of Briarcliff Manor that have been installed in their name in various locations throughout the Village.    

Authorize Village Manager to Approve Change Orders for the Library

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution as amended:

BE IT RESOLVED that the Board of Trustees hereby approves the following change orders:


Change order FCI-31 credit in the amount of $8,000 for the deletion of the Hufcor Electric Partition.  

Change order FCI-32 in the amount of $3,500 for the relocation of a drop curb and drain cover and the additional demolition and construction concerning existing raised flooring at the transition area.  

Schedule An Informational Session for Public Discussion - Increase Terms of Office for Board of Trustees and Establish Biennial Elections

Mayor Vescio explained the resolution and stated the issue would be placed on the November 3rd General Election ballot for the people to decided.  

Mr. Clay Tiffany stated this was part of the Republican Regime and hoped there would be more than one hearing.  

Upon motion by Trustee Sullivan, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that an Informational Session open for Public Discussion is hereby scheduled for September 17, 2009 to hear and discuss the proposed increase of the Terms of Office for the Board of Trustees and Establishment of Biennial Elections and that the Board of Trustees rules for Public Hearings shall apply in this Informational Session open for Public Discussion.  The proposed change also will be subject to a Permissive Referendum anticipated to be placed on the ballot at the General Election on Tuesday, November 3, 2009.  

Special Election Resolution establishing Polling Places and Hours

Mayor Vescio stated the resolution was conjunction with previous resolution.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:
RESOLUTION OF THE BOARD OF TRUSTEES, OF THE VILLAGE OF BRIARCLIFF MANOR, COUNTY OF WESTCHESTER, STATE OF NEW YORK, INCREASING TRUSTEE TERMS OF OFFICE, ESTABLISHING BIENNIAL ELECTIONS AND CALLING FOR A PERMISSIVE REFERENDUM TO BE PLACED ON THE BALLOT AT A SPECIAL ELECTION HELD ON THE NEW YORK STATE GENERAL ELECTION, TUESDAY, NOVEMBER~3, 2009, FROM 6:00~AM TO 9:00~PM
Be it resolved by the Village Board of Trustees that a special election of the Village shall be conducted on the New York State general election to be held on November~3, 2009, with 6 polling place(s) at the following locations commencing at 6:00~AM, and the polls shall remain open until 9:00~PM:
District 15 - Briarcliff Manor Youth Center
District 16 - All Saints Church
District 17 - Todd School
District 19 - Congregational Church
District 26 - St. Theresa’s School
Districts 27 & 29 - Scarborough Presbyterian Church

Adjournment

Trustee Sullivan thanked the Board for their hard work to get us where we are with the Full Water Supply Project and further thanked former Village Trustee Elsie Smith.

Upon motion Trustee Sullivan by, seconded by Deputy Mayor Venditti, the Board voted unanimously to close the regular meeting at 8:25pm.
