Regular Meeting
April 16, 2009
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 16th of April 2009 commencing at 7:30 p.m.

Public Hearing – 2009-2010 Tentative Budget

Upon motion by Trustee Mayer, seconded by Trustee Sullivan, the Board voted unanimously to open the public hearing.  

Mr. Clay Tiffany of Hall Road asked what percentage the salary increase for the Police Department would be.  He further asked what percentage of the total budget the Police Department was.  

Village Manager Zegarelli stated the Police contract expired on May 31, 2009 and negotiations had not begun.  He stated they were 23% of the total budget.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to close the public hearing.  

Mayor Vescio stated the Board had until May 1st to adopt the budget and they were tentatively scheduling a meeting to adopt the budget on April 28th.  He commended the Department Heads, especially Village Treasurer, Robin Rizzo for cutting $600,000 without cutting services.  

Board of Trustees Announcements by Trustee Mayer
  • Stash the Trash will be on April 18th
  • The Westchester County Earth Day Celebration will be on April 19th from 10am-3pm at the Kensico Dam Plaza
  • The Scarborough Station construction is progressing along well and should be completed by the summer of 2010.
Village Managers Report by Acting Village Manager Zegarelli
  • Spring cleanup and pothole repair has begun.  
  • The Pocket Park and Street Clock Dedication Ceremony will be on May 16th at 2pm.  
  • The stimulus package paperwork was redone and submitted for the Full Supply Water Project.  
Public Comments

Mr. Michael Berkman of 110 South State Road asked why Stash the Trash wasn’t posted on the website.  He requested the Board put up signs prohibiting idling cars at Law Park and Scarborough Station.  He felt it would be a good thing to coincide with Earth Day.  

Trustee Mayer requested Village Manager Zegarelli come up with some suggestions.  

Mr. Clay Tiffany of Hall Road stated there was a law of official misconduct for public officials and wanted to know what the statute of limitations was.  He stated he was going to supply of list of misdeeds by Briarcliff Manor employees and Officials.  He requested he be informed when the meeting to discuss the holiday displays was going to be held.  He requested a letter stating why he hadn’t been hired by DPW and asked if the Board was aware that Village Manager Zegarelli was President of Reliant Bank and that he held a prayer before every Board meeting while he was Mayor of Sleepy Hollow.  

Presentation by the Business Zone Advisory Committee

Mr. Rick Herbek, Chairman of BZAC noted the members of the committee in attendance.  He stated the committee was formed in February 2008 to do follow up work from the Comprehensive Plan to evaluate the Business District.  He thanked Harlan Sexton for putting the report together.  He further thanked Elsie Smith for all the time she spent pulling things together.  

Ms. Harlan Sexton of Buckhurst, Fish and Jacquemart reviewed the recommendations in the report.  She stated the committee was very involved and they were a joy to work with.  

Mr. Clay Tiffany stated he objected to the Village paying for environmental impact studies for business interests that may or may not happen.  

Trustee Sullivan stated the report was wonderful and asked the likelihood of achieving cross access easements with the merchants.  

Mr. Herbek explained the Village already had a number of them and it was a matter of negotiating with property owners.  He stated it would require a bit of work but it was a worthy goal to have parking circulation.  

Mayor Vescio noted there were only two more property owners needed to complete the cross access easement.  

Deputy Mayor Venditti stated there was Municipal Parking by the Youth Center and more noticeable signs might be needed.  

Mayor Vescio thanked the committee and stated it was a privilege to work with such a diverse group that had good discussion and debates.  He stated the report came out very well and he looked forward to moving ahead with it.  He thanked David Weinberg for volunteering to be on the ARAC.   

Budget Transfer - ICMA

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby authorize the following budget transfer:

From:   A1990.499               Contingency             $19,066.67

To:     A1010.460               Contractual             $19,066.67

Fire Department Membership

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of David Guilmette to the Briarcliff Fire Company.  

Upon motion by Trustee Sullivan, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Yuriy Rud to the Briarcliff Fire Company.  

Minutes

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted to approve the minutes of April 2, 2009 as amended.  

Adjournment

Upon motion by Deputy Mayor Venditti, seconded by Trustee Sullivan, the Board voted unanimously to close the regular meeting at 8:30pm.
