The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 2nd of April 2009 commencing at 7:30 p.m.

Mayor Vescio stated it was Trustee Smith’s last meeting and thanked her for a great job for the last 6 years. He stated he appreciated her dedication and unfailing efforts. He requested a motion to make her honorary Acting Mayor for the evening.
Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to make Trustee Smith honorary Acting Mayor for the meeting.
Acting Mayor Smith stated she wanted to thank the Village for letting her serve for the last 6 years and she would miss her colleagues and their wonderfully collaborative efforts. She thanked the staff and welcomed newly elected Trustee Lori Sullivan and hoped she found it as satisfying as she did. She thanked her family and especially her husband Bill and stated she was very proud of the accomplishments the Village and Board made over the last 6 years.
Public Hearing – 2009-2010 Tentative Budget
Upon motion by Mayor Vescio, seconded by Trustee Waxenberg, the Board voted unanimously to open the public hearing.
Acting Village Manager Zegarelli presented the tentative budget to the Board and the Public.
Mayor Vescio asked Acting Village Manager Zegarelli to explain who determined the assessed value and the equalization rate.
Acting Village Manager Zegarelli stated the Towns determined the assessed values and the State determined the equalization rate.
Mr. Roger Battacharia of 16 Holbrook Road thanked Mr. Zegarelli for his fantastic presentation and further stated it shed a lot of light on what was happening. He asked what the extent of savings there would be from the water project.
Trustee Mayer explained the cost was approximately $8 million annually to purchase water from Ossining or New Castle and if there was a water shortage there would be no guarantee they would sell to the Village. He stated it would cost the Village approximately $3 million annually to buy our own water system.
Mayor Vescio stated the Village’s tap would be below the new UV treatment plant and the Village would benefit from it.
Ms. Margo Berger of 2 Elizabeth Court asked if the bond figure was in the budget.
Acting Village Manager Zegarelli stated they were estimating $1.1 million in additional debt service.
Mayor Vescio stated it would be reflected in the water fund and once the project was put out to bid they’d have a number to be able to project the rates. He further stated the project is 99% designed and they hoped to have a shovel in the ground by June 15th.
Mr. Mort Berger of 2 Elizabeth Court asked if the Village was applying for stimulus funding.
Acting Village Manager Zegarelli stated the Village has applied and would be submitting an addendum to the application shortly.
Mr. Berger asked if the Village was pursuing shared services.
Mayor Vescio stated the Village was working with the Village and Town of Ossining for shared services with the Department of Public Works and Police Department and the Board would be voting on a resolution later in the meeting to complete a study.
Upon motion by Trustee Waxenberg, seconded by Mayor Vescio, the Board voted unanimously to adjourn the hearing to April 16, 2009.
Board of Trustees Announcements by Deputy Mayor Venditti
- Joggers and Bikers are reminded to wear reflective clothing and to obey traffic signs.
- US Census 2010 is in the area. It is important to give accurate information.
- The Egg Hunt is on April 4th in Law Park at 10am.
- Stash the Trash is on April 18th at the Youth Center.
- Day camp registration is now open until May 1st.
- Save the date for the May 25th 5k run/walk cosponsored by BMCC and Friends of the Library.
- Arts Abloom 10510 will be on May 3rd at Library/Community Center.
Village Managers Report by Acting Village Manager Zegarelli
- The sanitary sewer project has been completed.
- The pocket park is proceeding and the ribbon cutting ceremony will be on May 16th.
- Street sweeping has started.
- Little league opening day is April 18th.
- The drainage project has started.
- Hydrant flushing will begin next week.
- The stop signs at Larch and Maple Road will be removed and the traffic flow will be monitored.
Public Comments
Village Attorney Smith stated he enjoyed working with Acting Mayor Smith over the years.
Ms. Beth Weiman from Suzi Oppenheimer’s office stated she was attending on Ms. Oppenheimer’s behalf and she was thinking of the Village.
Acceptance of Clock from the Garden Club
Acting Mayor Smith stated the Garden Club spearheaded the fundraising effort for the clock and thanked them. She recognized Terry Marchica for her efforts.
Upon motion by Deputy Mayor Venditti, seconded by Mayor Vescio, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Board of Trustees does hereby accept a Howard Replica/Seth Thomas Clock from the Briarcliff Manor Garden Club to be erected in the Village Pocket Park on Pleasantville Road.
Ms. Terry Marchica of the Garden Club stated the project began back in 2001 and fizzled out until 2005 when the Beautification Committee was started. She thanked Acting Mayor Smith for her help and she hoped everyone would enjoy the clock.
Acting Mayor Smith stated the dedication ceremony would be on May 16th at 2pm.
Fire Department Service Awards
Trustee Waxenberg stated the number of volunteers and the number of hours they give was impressive and the Village was very lucky.
Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED, that the Volunteer Firefighter Service Award Program list for all 2008 active firefighters of the Briarcliff Manor Fire Company, the Briarcliff Manor Hook, Ladder & Fire Company and the Scarborough Engine Company is hereby approved.
BE IT FURTHER RESOLVED that the list shall be directed to the respective fire companies for posting for a period of thirty (30) days.
Award of Bid – Guiderail Project
Mr. Roger Battacharia of 16 Holbrook Road stated there was a section of wall that had been hit several times where Scarborough Road and Holbrook Road intersect. He requested that area be considered.
Deputy Mayor Venditti suggested looking into a stop sign in that area.
Mr. Mort Berger of 2 Elizabeth Court stated there was a dangerous spot opposite Brandywine and the Village should check it out.
Upon motion by Trustee Waxenberg, seconded by Mayor Vescio, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the bid for the Guide Rail Project (VM-0809-10) is hereby awarded to Mohegan Associates per their bid of $22,555.
BE IT FURTHER RESOLVED that the Acting Village Manager is hereby authorized and directed to execute a contract with Mohegan Associates for the installation of guide rails in several locations throughout the Village.
Award of Contract – Pool Concession Services
Upon motion by Mayor Vescio, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Acting Village Manager is hereby authorized and directed to execute an Agreement with Donnie Alecci Enterprises, Inc. to provide pool concession services per their proposal of $6,000.
Library Change Orders
Mayor Vescio stated the change orders were for mainly safety and code issues that needed to be addressed.
Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Board of Trustees hereby approves the following change orders:
Change order EST-06 in the amount of $417 to provide auxiliary contacts at elevator controller.
Change order EST-07 in the amount of $1,408 for the installation of additional addressable monitor modules for Flow Switches and Tamper Switches not shown on contract drawings.
Change order EST-08 in the amount of $2,035 to supply and install a fire alarm module at elevator controller for the fire hat located in the elevator and an additional smoke detector at the top of the elevator shaft, per code requirements.
Change order EST-09 in the amount of $3,489 to supply and install 2 wall sconces, light switches and emergency high hat on T&M Basis in stairwell and T&M work at Transition Area regarding the installation of a horn/strobe per Building Department and safe off buried wiring in existing Library.
Deputy Mayor Venditti asked if there were safety and code issues if it left the Village any recourse.
Mayor Vescio stated there were a number of design deficiencies that the Architect was responsible for and the Village would be putting him on notice and seeking reimbursement.
Authorize Acting Village Manager to Execute Agreement
Fire Protection Agreements with Mt. Pleasant
Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Acting Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Briarcliff East Fire Protection District to expire on December 31, 2009.
BE IT FURTHER RESOLVED that the Acting Village Manager is hereby authorized and directed to execute a Fire Protection Agreement with the Town of Mt. Pleasant for fire protection services to the Northeast Briarcliff Fire Protection District to expire on December 31, 2009.
Westchester County – Organic Waste Refuse Disposal
Upon motion by Trustee Waxenberg, seconded by Mayor Vescio, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Acting Village Manager is hereby authorized and directed to execute an Intermunicipal Agreement with Westchester County for transfer of organic waste for refuse disposal.
Village Attorney Smith stated the contract required a SEQRA determination and it was a type II action.
Animal Control Services, SPCA
Upon motion by Mayor Vescio, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Acting Village Manager is hereby authorized and directed to execute an Agreement with the SPCA of Westchester, Inc. for animal control services for 2009.
ICMA – Local Government Efficiency Evaluation
Trustee Mayer stated the Board was looking for two candidates to name to a committee to work on shared services and anyone interested should contact the Village Manager’s Office.
Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Acting Village Manager is hereby authorized and directed to execute an Agreement with International City/County Management Association (ICMA) Consulting Services for a comprehensive analysis of police and public works/highway services and a workload analysis of data to the Village of Briarcliff Manor, Village and Town of Ossining for the total cost of $57,200.00, the Village portion for such study to be $19,066.67.

Deputy Mayor Venditti stated the past 6 years working with Acting Mayor Smith were an incredible honor.
Minutes
Upon motion by Deputy Mayor Venditti, seconded by Trustee Waxenberg, with two abstentions from Acting Mayor Smith and Trustee Mayer, the Board voted to approve the minutes of March 11, 2009 as amended.
Upon motion by Trustee Mayer, seconded by Mayor Vescio, with two abstentions from Deputy Mayor Venditti and Trustee Waxenberg, the Board voted to approve the minutes of March 19, 2009 as amended.
Adjournment
Upon motion by Mayor Vescio, seconded by Deputy Mayor Venditti, the Board voted unanimously to close the regular meeting at 9:10pm.
