Regular Meeting
September 4, 2008
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 4th of September 2008 commencing at 7:30 p.m.

Board of Trustees Announcements by Mayor Vescio
  • Trustee Waxenberg’s sister Marla passed away.  The Board expresses their deepest condolences.  
  • The Library site work is progressing.
  • Community Day is on Saturday at 2pm.  The Village will announce tomorrow whether it will be postponed or not due to impending inclement weather.  
Trustee Mayer reminded residents that school is open and to please drive carefully.  

Village Managers Report by Interim Village Manager Richards
  • Village wide fire hydrant flushing will begin next week.  
  • The drainage projects have commenced.      
Public Comments

Mr. Clay Tiffany of Hall Road stated on 8/9/08 he made a complaint to the police about a woman at Orfino’s that threatened him and an Ossining police officer that was on duty in the village.  He further stated a false police report was made by Officer Gallagher about him.  He stated he’s made the village aware and they’ve done nothing about it now, or in the past.  He stated he appreciated the conversation he had with the Mayor but Chief Campion has still refused to speak with him.  He stated his social security number was plastered on trees near his home and he was told the police didn’t have to use fingerprints to find the criminal.  He stated a little birdie told him there was a window in the Police Department that’s bullet proof and the cost was around $30,000.  He stated he could help the Village and wasn’t the enemy.

Amendment to Special Use Permit, Clearview School

Mr. Steve Achinelli, Attorney for the Applicant, explained the application.  

The Board had general discussion regarding the application.  

Deputy Mayor Venditti suggested an underwriter review the resolution before the Board moved forward.  

Mr. Achinelli requested a brief recess to discuss the matter with his client.  

Mr. Achinelli stated they would bring the resolution before lenders to see if they were comfortable with the language.  

Mayor Vescio requested the matter be tabled to the next meeting.  

Approval of Resolution of the Board of Trustees of the Village of Briarcliff Manor for its determination under Matter of County of Monroe on the Village’s Full Water Supply Project

Attorney Smith gave an overview of the resolution.  

The Board had general discussion regarding the resolution.  

Deputy Mayor Venditti stated there were numerous typos and inaccuracies with the transcript of the hearing.  He asked if the video tape could be included as part of the record.  

Village Attorney Smith stated the transcript could be amended or the Board could adopt simple minutes and use the transcript as an exhibit.  

Mayor Vescio requested the video tape be included.  

Village Attorney Smith stated if the Board was unhappy with the mesh of the transcript he suggested a copy of the video tape be attached and state the transcript was a draft.  

Upon motion by Trustee Smith, seconded by Trustee Mayor, the Board voted unanimously to approve the following resolution:

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted to approve the minutes of August 21, 2008 as amended.  

Adjournment

Upon motion by Trustee Smith, seconded by Deputy Mayor Venditti, the Board voted unanimously to close the regular meeting at 8:30pm.
