Regular Meeting
June 5, 2008
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 5th of June 2008 commencing at 7:30 p.m.

Public Hearing: Community Development Block Grant Application

Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to open the public hearing.  

Interim Village Manager Richards explained the grant application.  

Mr. Clay Tiffany of Hall Road asked who was paying for the grant and stated he objected to the funding.  He stated there were more deserving places with low income people like Mt. Vernon or Yonkers and very few people used the sidewalks in Briarcliff.  

Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to close the public hearing.  

Deputy Mayor Venditti stated the ramp would benefit the members of the community with lower incomes such as the Senior Citizens at the Atria and it in no way diminished funds from other communities.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees hereby authorizes and directs the Interim Village Manager to submit a Community Development Block Grant Application for the Law Park Pedestrian Linkage project which will allow handicapped accessibility by way of a pathway around the stairs at the rear of the Law Park Pavilion, and;

BE IT FURTHER RESOLVED, that the Board of Trustees commits an expenditure of $30,588 as the Village’s contribution to this CDBG project.  

Village Attorney Smith stated the application was a type II SEQRA action.

Stormwater Management Presentation, David Turiano, Village Engineer

Village Engineer Turiano discussed the phase II stormwater requirements, the minimum control measures and the steps the Village had taken to implement the plan.  

Mr. Clay Tiffany of Hall Road stated the runoff on Hall Road had not been addressed and further stated he believed the Trump Golf Course used chemicals that were harmful.  

Mayor Vescio stated the Trump Golf Course was designed and maintained using Audubon standards.  

Village Engineer Turiano explained what the Village would do moving forward and the Village was ahead of the game.  

Mayor Vescio asked when all the catch basins and storm drain manholes would be marked.  

Village Engineer Turiano stated he would find out.  

Mayor Vescio thanked Mr. Turiano and the staff.  He further thanked the Board of Trustees for the work they’ve done with the laws to be in compliance with the State and stated it was a testament to their commitment to the Village and protecting the environment.  

Board of Trustees Announcements from Trustee Smith
  • The Garden Club will host the Off to the Races flower show on June 6th from 2pm-8pm at the Atria
  • On June 12th BriCa will host a guided tour of the PepsiCo Gardens.  Please call Roberta Socoloff at 923-5210 for more information
  • The 5k run/walk on Memorial Day weekend was very successful and the Board thanked the Police Department and Recreation Department for their participation
  • The Prom is tomorrow night and all are asked to be sensitive to the construction at the library and to follow the guidelines issued
  • The Board congratulated all the graduates and asked that they enjoy the season safely and keep teen parties substance free
  • There are two openings on the Conservation Advisory Council.  Interested parties should contact Interim Village Manager Richards.  
  • Thanks to the Department of Public Works and the Board for their work with the Village’s beautification.  
Mayor Vescio clarified the location of the crosswalk and the bump out.  

Village Managers Report by Interim Village Manager Richards
  • Sleepy Hollow Road was paved
  • Delivery of the community bulletin board is expected in three weeks
Mayor Vescio read aloud a proclamation for Eileen Weber.  

Public Comments

Mr. Clay Tiffany asked if the Rotary Club was charged for using the Recreation Facility.  He asked if the Village would have the same holiday exhibit as the prior year and discussed various members of Village staff.  

Addition of Parcel to Saw Mill Sanitary Sewer District

Interim Village Manager Richards explained the proposal.  

Mayor Vescio asked if it was just for the 3 lots of the subdivision.  

Trustee Waxenberg stated it was great they were joining the sewer district because it was a near a sensitive environmental area and there would no longer be a septic system there.  

Upon motion by Trustee Smith, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:

WHEREAS, on May 21, 2001, the Westchester County Board of Legislators adopted legislation to modify the Ossining and Saw Mill Sanitary Sewer Districts by removing a total of 332 parcels of property not currently connected to the County sewer system and treated at the County operated wastewater treatment plants; and

WHEREAS, the property at 61 Old Sleepy Hollow Road, identified on the Village Tax Maps as Section 4, Plate 34, Block 31, Lot 1 (“Property”), was removed from the Saw Mill Sanitary Sewer District; and

WHEREAS, on April 1, 2008 the Planning Board approved a three lot subdivision at the Property by Resolution dated April 1, 2008 (“Subdivision”); and

WHEREAS, the owner of the Property asked the Board of Trustees to request the Westchester County Board of Legislations to extend the Saw Mill Sanitary Sewer District to add the Property, but not adjacent property, to that sewer district and submitted supporting documentation by letters of McCullough, Goldberger & Staudt, LLP dated May 8 and May 22, 2008; and

WHEREAS, the owner of the Property is constructing a low pressure force main sanitary sewer and other improvements to service the Subdivision at the owner’s sole cost and expense, and the  sewerage will enter the County sewer system and be treated at a County operated wastewater treatment plant:

NOW THEREFORE BE IT RESOLVED, that the Board of Trustees hereby authorizes the Village Engineer to submit a request to the Westchester County Board of Legislators for the addition of the Property into the Saw Mill Sanitary Sewer District.

Authorize Interim Village Manager to Execute an Intermunicipal Agreement with Westchester County– Personal Protective Equipment

Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

Appropriation of Fund Balance and Contingency, Police Department Salaries

Mr. Clay Tiffany stated money was being wasted on the Officers that were out on disability.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Interim Village Manager is hereby authorized and directed to execute an Intermunicipal Agreement with Westchester County for Personal Protective Equipment.    

Tax Abatements

89 Scarborough Road

Upon motion by Trustee Smith, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 89 Scarborough Road; and

WHEREAS, a Stipulation of Settlement in the Small Claims Assessment Review has been issued for the property at 89 Scarborough Road for the 2007 Town assessment year, Fiscal Year 2008-2009 Village assessment roll; and

WHEREAS, the Stipulation of Settlement reduced the tax assessment for the subject property for the Fiscal Year 2008-2009 assessment roll by $5,280.00 from $38,600.00 to $33,320.00; and

WHEREAS, the Stipulation of Settlement was received after the finalization of the Fiscal Year 2008-2009 assessment roll and the approval of the budget for Fiscal Year 2008-2009;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2008-2009 in the amount of $448.23 and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement.

748 Long Hill Road West

Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

WHEREAS, a Small Claims Assessment Review was filed on behalf of the property owner for 748 Long Hill Road West; and

WHEREAS, a Stipulation of Settlement in the Small Claims Assessment Review has been issued for the property at 748 Long Hill Road West for the 2007 Town assessment year, Fiscal Year 2008-2009 Village assessment roll; and

WHEREAS, the Stipulation of Settlement reduced the tax assessment for the subject property for the Fiscal Year 2008-2009 assessment roll by $8,300.00 from $51,300.00 to $43,000.00; and

WHEREAS, the Stipulation of Settlement was received after the finalization of the Fiscal Year 2008-2009 assessment roll and the approval of the budget for Fiscal Year 2008-2009;

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby authorize the abatement of the tax bill for Fiscal Year 2008-2009 in the amount of $704.62 and the issuance of a new tax bill based upon the reduced assessment value in the Stipulation of Settlement.

Board Appointments

Upon motion by Trustee Smith, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby makes the following appointments:

Lori Sullivan Francese as a member of the Ethics Board for a five year term to expire on April 1, 2013.  

Stephen Smalley as the CDAG representative.  

Bill Sharman as a member of the Scarborough Park Visioning Advisory Committee.

Georgina Gualdino as Chairperson of the Recreation Committee for a term to expire on April 1, 2009.    

Minutes

The minutes of May 1, 2008 were tabled.  

Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the minutes of May 15, 2008 as amended.  

Adjournment

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith the Board voted unanimously to close the meeting at 8:25pm.
