Regular Meeting
June 19, 2008
7:30 p.m.

The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 19th of June 2008 commencing at 7:30 p.m.

Board of Trustees Announcements by Mayor Vescio
  • The Board congratulated the Class of 2008 and wished them success with their future endeavors.
Village Managers Report by Interim Village Manager Richards
  • Work will be done by the Department of Public Works at Scarborough Station between the hours of 9am-2pm.
  • The street signs will be replaced in the Central Business District.  
  • Delivery of the community bulletin board is expected the first week in July.

Change Meeting Date

Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby change the regular meeting and work session originally scheduled for July 3, 2008 to July 2, 2008 with the work session to begin at 6:30pm and the regular meeting to begin at 7:30pm.  

Submission of a Grant Application for the Briarcliff Manor/North County Trail Access Project

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

WHEREAS the Board of Trustees of the Village of Briarcliff Manor strongly supports the Briarcliff Manor/ North County Trail Access Project as it will connect the Central Business District in the Village of Briarcliff Manor to the North County Trailway, and;

WHEREAS the Transportation Enhancement Program provides a means of funding this project which is of significant cultural, aesthetic, historic and environmental value to the Briarcliff Manor and Westchester County community, and;

WHEREAS this project qualifies under three enhancement categories, as the project provides for: facilities for pedestrians and bicyclists; safety and educational activities for pedestrians and bicyclists; and landscaping and other scenic beautification of the area, and;

WHEREAS the Village has a very capable staff who are able to support all of the procedural and professional requirements in undertaking, completing and maintaining this project, and;

WHEREAS the Village has completed a comprehensive Trails Study in June of 2006 and this project was determined to be of top priority to the Village and the Board of Trustees, and;

WHEREAS the project will have numerous benefits to the general public as it will provide an alternate transportation option for people to use, improve the local economy and also improve the environment, and;

NOW THEREFORE BE IT RESOLVED that the Board of Trustees endorses this Briarcliff Manor/North County Trail Access Project application and commits to an expenditure of $54,408 in Village funds to support the project which is projected to cost $272,040.

Appointment of Police Officer

Mayor Vescio stated with the hiring of the new officer it would be the highest level of staffing in eight years and the lowest amount of officers on 207C in twelve years.  

Mr. Clay Tiffany of Hall Road asked if any civilian complaints were lodged against the new officer.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that John Wynne of Staatsburg, New York is hereby appointed, effective July 3, 2008, to the position of Police Officer Step 3, Grade 4 to be paid at an annual salary of $70,027.  

Budget Transfer – Police Salary

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby authorize the following budget transfer:

From:   A3120.102               Police Overtime         $11,120.00

To:     A3120.101               Police Salary                   $11,120.00

Schedule Public Hearing – Amend Special Use Permit, St. Theresa’s Catholic Church

Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the request to amend a Special Use Permit for St. Theresa’s Catholic Church, which provides for an modification to the site plan that served as the basis of the Special Use Permit, to install a sign is hereby directed to the Planning Board for review and recommendation.

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for the July 17, 2008 Board of Trustees meeting to hear and consider a request from St. Theresa’s Catholic Church, to amend their Special Use Permit.

Fire Department Membership

Upon motion by Deputy Mayor Venditti, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Bill Melnychuk Jr. to the Briarcliff Manor Hook & Ladder Company.

Permission to Conduct a Sidewalk Sale

Mr. Clay Tiffany asked if anyone could sell items at the sidewalk sale.  

Village Attorney Smith stated it was the same process as the previous year and the same rules would apply.  

Mayor Vescio suggested Mr. Tiffany contact Building Inspector David Turiano for more information.  

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby grant permission to the Briarcliff Manor Merchant’s Association to conduct a sidewalk sale on Friday, June 20 from 12 noon to 6:00 p.m. and Saturday, June 21 from 10:00 a.m. to the close of business.

BE IT FURTHER RESOLVED that the Board of Trustees does hereby waive the requirement to obtain a sidewalk vending permit to place tables and items for sale on the sidewalk.

Public Comments

Mr. Tom Myers of 18 High Ridge Road in Ossining stated he was a member of the Briarcliff Congregational Church.  He further stated his purpose of speaking was to say the Garden House School was working closely with the Church and they were frustrated the fall term was quickly approaching and they were hoping to move the matter along.  

Ms. Sandy Rooney, Director of the Garden House stated they started paying rent to the Church in September 2007 and it was a significant cost to them to fix up the space.  She stated she was personally begging the Board to put them on the next work session and she hoped they could move forward.  

Mayor Vescio stated the matter was discussed at a work session many months ago and the applicant’s attorney was supposed to come up with language and the Board had a fiduciary responsibility to protect the Village.  He stated the language fell short of what they needed and directed Counsel to address the areas of concern.  

Village Attorney Smith stated the applicant presented a new proposal within the last couple of days and asked the Board to review it at their earliest convenience.  He further stated the time that passed between correspondences was more on his plate.  

Mr. Clay Tiffany stated letting cops resign wasn’t right and he requested a written response as to why he wasn’t hired by the Department of Public Works.  

Adjournment

Upon motion by Trustee Mayer, seconded by Deputy Mayor Venditti the Board voted unanimously to close the meeting at 8:05pm.
