The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 7th of February 2008 commencing at 7:30 p.m.

Upon motion by Trustee Smith, seconded by Trustee Waxenberg, the Board voted unanimously to open the public hearing.
Mr. Clay Tiffany of Hall Road stated it was an outrage they didn’t have to pay taxes and eventually the property would be sold for a tidy sum.
Upon motion by Deputy Mayor Venditti, seconded by Trustee Waxenberg, the Board voted unanimously to adjourn the public hearing to February 21, 2008.
Board of Trustees Announcements from Trustee Smith
- Seeking volunteers for the Library Board. All interested parties should contact the Village Manager’s Office.
- The Business Zone Advisory Committee “BZAC” was being formed. All interested parties should contact the Village Manager’s Office.

Public Comments
Mr. Clay Tiffany of Hall Road stated he would like an apology from Deputy Mayor Venditti for representing Jim Cronin. He asked why he wasn’t hired 20 years ago and why his qualifications weren’t good enough. He requested a response in writing. He asked when the drug symposium was being held.
Village Manager Blau stated personnel matters would not be discussed.
Election Inspectors for Village Election, March 18, 2008
Mr. Mort Berger of 2 Elizabeth Court asked if the Inspectors could park further from the polling place to allow room for voters to park closer.
Mr. Clay Tiffany asked if Dick Pruitt would be working as an inspector.
Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that Mardi Perry, Sam Papa, Emily Sack, Georgina Gualdino, Lauren Gualdino, Domenica Leggio, Joan Reynolds, William Reynolds and Donna Lilly are hereby appointed Inspectors of Election for the March 18, 2008 Village Election.
BE IT FURTHER RESOLVED that Donna Lilly is hereby designated as Inspector of Election and Chairperson.
BE IT FURTHER RESOLVED that the compensation for the Inspectors of Election is hereby fixed at Two Hundred and Twenty Five ($225) dollars per day.
BE IT FURTHER RESOLVED that the compensation for the Inspector of Election that is designated as Chairperson shall be Two Hundred Seventy-Five ($275) dollars per day.
BE IT FURTHER RESOLVED that Wayne Wheeler and Tom Murray are hereby appointed Voting Machine Technicians for the March 18, 2008 General Village Election and the compensation is hereby fixed at Seven Hundred Sixty ($760) dollars.
BE IT FURTHER RESOLVED that there shall be an additional Fifteen ($15) dollars per hour for serving in a stand-by capacity.
Appropriation of Fund Balance for Valet Parking Services
Mr. Robert Little of Scarborough commended the Board for making such a right decision. He stated Trustee Smith proposed it 3 years ago and credited her for her vision. He asked if Verizon could relocate the pay telephone for those that don’t have cellular phones.
Village Manager Blau stated he intended to request Verizon relocate the phone.
Deputy Mayor Venditti asked if the Village should look into establishing a payphone.
Village Attorney Smith stated the revenue would have to be used to pay for the phone service.
Trustee Smith stated maybe an emergency phone could be installed that goes directly to the police department.
Mr. Clay Tiffany stated he was a fan of payphones and it was imperative there be one at the station. .
Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Board of Trustees does hereby appropriate $31,574.32 of Fund Balance in the General Fund to cover the cost of the valet parking service operation through the end of the fiscal year (May 31, 2008).
Lead Agency, Full Supply Water Project
Upon motion by Trustee Smith, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:

VILLAGE OF BRIARCLIFF MANOR BOARD OF TRUSTEES
Adopted February 7, 2008
State Environmental Quality Review Act (SEQRA) Determination of Lead Agency Status and Intent to Conduct Environmental Review – Full Water Supply Project
WHEREAS, the Village of Briarcliff Manor (“Briarcliff Manor”) supplies water to residents of Briarcliff Manor as well as customers outside of the Village that purchase water from the Village; and
WHEREAS, Briarcliff Manor’s primary source of water supply is the New York City Croton Aqueduct which supplies unfiltered water; and
WHEREAS, to enable Briarcliff Manor to comply with the requirements of the United States Environmental Protection Agency (“USEPA”) Surface Water Treatment Rule, continued use of the Croton Aqueduct water supply would require the construction of filtration treatment facilities; and
WHEREAS, as an alternative to filtration, Briarcliff Manor has entered into an Agreement with the New York State Health Department to replace the Village’s existing Croton Aqueduct water supply with a water supply from New York City Catskill Aqueduct system; and
WHEREAS, a Catskill Aqueduct system connection would bring Briarcliff Manor into compliance with the Surface Water Treatment Rule; and
WHEREAS, to obtain a long term, adequate and potable supply of water from the Catskill Aqueduct system (the “Full Water Supply Project”), Briarcliff Manor entered into agreements with the Village of Tarrytown and the Village of Sleepy Hollow to jointly utilize Tarrytown and Sleepy Hollow’s existing water facilities and water connection to the Catskill Aqueduct and construct new water facilities in those communities1; and
WHEREAS, Briarcliff Manor Board of Trustees (“Board of Trustees”) has reviewed engineering plans prepared on its behalf by its engineering consultants Hazen and Sawyer for the Full Water Supply Project; and
WHEREAS, the Board of Trustees will cause the preparation of final plans, specifications and contract documents necessary for it to competitively bid the Full Water Supply Project and upon completion of such process shall thereafter execute contracts with the lowest responsible bidder(s) to construct the Full Water Supply Project at the sole cost and expense of Briarcliff Manor; and
WHEREAS, construction for the Full Water Supply Project is anticipated to commence in July 2008 and continue through November 2009, during which time building construction and stormwater management will be implemented; and
WHEREAS, improvements which will be constructed to implement the Full Water Supply Project in the Villages of Briarcliff Manor, Tarrytown and Sleepy Hollow and in the Towns of Greenburgh and Mt. Pleasant, are summarized as follows:
1. Improvements and upgrades will be made to Tarrytown and Sleepy Hollow’s existing Catskill Aqueduct tap located northeast of Executive Boulevard on NYCDEP property adjacent to the Catskill Aqueduct in the Town of Greenburgh.
2. A new tap will be constructed directly upstream of Tarrytown and Sleepy Hollow’s tap in the Town of Greenburgh.
3. Improvements and upgrades will be made to the existing Tarrytown and Sleepy Hollow Meter Building located at Executive Boulevard in the Town of Greenburgh, including excavation and construction of a connected below-grade structure to house a flow meter for Briarcliff Manor’s new tap, installation of metering equipment and replacement of the existing vacuum pumps and tanks.
4. A new Catskill Aqueduct tap will be constructed at the Catskill Aqueduct site in the Town of Greenburgh along with a new paymeter and less than 500 feet of transmission main.
5. A new Briarcliff Manor pump station will be constructed at the Tarrytown Lakes immediately adjacent and west of the existing Tarrytown and Sleepy Hollow Pump Stations.
6. Two portions of a transmission main will be constructed and installed as follows: (1) an extension of the existing water transmission line in the Village of Tarrytown to connect the proposed pump station at the site of the Tarrytown Lakes to the Executive Boulevard transmission main and (2) a new water transmission line extending through Tarrytown, Sleepy Hollow, Mount Pleasant and Briarcliff Manor between the Tarrytown Lakes to the Village of Briarcliff Manor’s Rosecliff storage tank; and
WHEREAS, the Board of Trustees has reviewed a Full Environmental Assessment Form, including Parts 1 and 2, prepared on its behalf by its engineering consultants Hazen and Sawyer, dated February 7, 2008, for environmental assessment of the Full Water Supply Project and intends to conduct a comprehensive environmental review in accordance with the New York State Environmental Quality Review Act (SEQRA) for the construction of any new water withdrawal and pumping facilities to identify potential impacts upon the natural environment in conformance with all applicable laws and regulations, including Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR) Part 617, including reviews under the National Historic Preservation Act (NHPA) of 1966 and the New York State Historic Preservation Act (SHPA)
of 1980, and will review such potential environmental issues as, but not limited to, construction impacts, operations impacts, land use
issues, architectural/visual character issues, natural resources/wetlands issues and historic resources issues; and
WHEREAS, the Board of Trustees has preliminarily identified the environmental aspects of the Full Water Supply Project in each municipality, as follows:
Town of Greenburgh
Construction is scheduled to begin in July 2008 and last approximately 6 months.
Proposed Construction Activities
A proposed Catskill Aqueduct tap will be constructed approximately 30 feet north of the existing Catskill Aqueduct tap on the south end of the Eastview site and a new vacuum priming chamber will be constructed adjacent and immediately south west of the proposed tap.
Site work will include excavation to construct a below-grade 170 square feet addition to the existing Meter Building.
A proposed 24-inch transmission main (~150 feet) will be installed between the proposed tap and the Meter Building.
A proposed 24-inch pipeline will exit the proposed Meter Building addition and run parallel to the existing 24-inch main for 360 feet until connecting to an existing transmission main at Executive Boulevard.
Potential Impacts
The proposed transmission main connecting the proposed Meter Building addition and the proposed tap will take place along a steep grade.
There is a small wetland (0.041 acres) that surrounds the Meter Building. There would be temporary disruption to the wetland vegetation, buffer and soils during construction. The wetland would be restored after construction.
There will be some minor disruption of traffic and parking in the vicinity of Executive Boulevard.
There will be some construction noise associated with installation of the main and connection.
Village of Tarrytown
Construction is scheduled to begin in July 2008 and last approximately 1.5 years.
Proposed Construction and Operation Activities
An extension of an existing 30-inch main is proposed along Neperan Road to feed the proposed pump station.
A proposed pump station will be constructed with a footprint of approximately 3,850 square feet.
A proposed emergency generator with approximately 2,000 gallons diesel fuel storage will be located on the property next to the pump station.
Town of Mt. Pleasant
Construction in Mt. Pleasant is anticipated to take approximately 3 - 4 months.
Proposed Construction Activities
The installation of a portion of the proposed transmission main.
Potential Effects
Two stream and wetland crossings within the Town of Mount Pleasant will be necessary, but the use of horizontal directional drilling would minimize effects to any watercourse.
There will be temporary traffic disruption associated with installation of the main within the utility right-of-way.
Portions of the transmission main will be installed within the boundary of the existing roadway pavement and all roadways will be restored to original condition as the installation progresses.
Potential Impacts
Site work will include construction and regrading of steep slopes.
There is a small wetland (0.056 acres) adjacent to the proposed project footprint and construction will occur within the wetland buffer area.
Construction activity may create a temporary increase in traffic along Neperan Road.
Construction and operation will take place adjacent to Tarrytown Lakes
Reservoir, a designated Critical Environmental Area.
Chemical storage and feed systems are proposed within the pump station.
There will be some construction noise associated with installation of the main and connection.
Village of Sleepy Hollow
Construction in Sleepy Hollow is anticipated to take approximately 4 -5 months.
Proposed Construction Activities
Installation of a portion of the proposed transmission main.
Potential Impacts
Traffic patterns will be temporarily diverted during the installation of the transmission main in the roadway and utility right of way.
Three stream and wetland crossings will be necessary but the use of horizontal directional drilling would minimize effects to any watercourse.
Portions of the transmission main will be installed within the boundary of the existing roadway pavement, and all roadways will be restored to original condition as the installation progresses.
There will be some construction noise associated with installation of the main and connection.
Village of Briarcliff Manor
Construction in Briarcliff Manor is anticipated to take approximately 3 months.
Proposed Construction Activities
Installation of a portion of the proposed transmission main.
Piping reconfiguration and connection to the Rosecliff storage tank.
Potential Effects
There will be temporary traffic disruption associated with installation of the main within the utility right-of-way.
There will be some construction noise associated with installation of the main and connection.
NOW, THEREFORE, BE IT RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that:
- Briarcliff Manor is funding the entire Full Water Supply Project;
- Briarcliff Manor is undertaking the design of the entire Full Water Supply Project;
- Briarcliff Manor is undertaking the construction of the entire Full Water Supply Project;
- The Full Water Supply Project will be implemented in stages in several municipalities, including the Villages of Briarcliff Manor, Sleepy Hollow and Tarrytown and the Towns of Mt. Pleasant and Greenburgh; and
- The Full Water Supply Project will provide a clean and potable water supply to residents of Briarcliff Manor and neighboring communities.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that the Full Water Supply Project will affect multiple jurisdictions and agencies; and be it further,
RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that it will have the broadest governmental powers for investigation of any impacts of the proposed action based on its control and management of the Full Water Supply Project in each jurisdiction; and be it further
RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that it has the greatest capability for providing the most thorough environmental assessment of the proposed action based on its control and management of the Full Water Supply Project in each jurisdiction; and be it further
RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that it is the appropriate agency to act as Lead Agency in a coordinated SEQRA review of the Full Water Supply Project; and be it further
RESOLVED, that the Briarcliff Manor Board of Trustees hereby finds that the Full Water Supply Project is an Unlisted Action as per Section 617 of Article 8 of SEQRA, and declares that it will assume Lead Agency status in a coordinated SEQRA review of this Project if no written objections are received within thirty (30) calendar days of transmittal of its Notice of Lead Agency and Notice of Intent to Conduct Environmental Review.
Schedule Public Hearing, Amendment to Special Use Permit, Briarcliff Manor Investors
Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that a Public Hearing is hereby scheduled for the March 20, 2008 Board of Trustees meeting to hear and consider a request from Briarcliff Manor Investors to amend the Special Use Permit initially issued to Barrington Venture, LLC and The Garlands of Briarcliff Manor, LLC, with amendments issued to CC-Briarcliff LLC and Classic Residence by Hyatt (located at the former Kings College property).
Appointment of Police Officer
Mr. Clay Tiffany wanted to know if there were any complaints about the Officer at his prior jobs.
Upon motion by Trustee Waxenberg, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that Jason P. Wollman, 59 Cumberland Road, Fishkill, New York is hereby appointed, effective February 25, 2008, to the position of Police Officer Grade 4 to be paid at an annual salary of $67,366.

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted unanimously to close the meeting at 8:30pm.
