The Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 23rd of October 2007 commencing at 7:30 p.m.

Board of Trustees Announcements
§ A public hearing is scheduled for November 1, 2007 at 7:30pm for the Comprehensive Plan
§ Volunteers are needed for the Scarborough Park Visioning Advisory Committee. Please contact the Village Manager if interested.
Village Managers Report
§ The Village paving project is ¾ complete.
§ The pipes and basins are installed for the drainage project
§ The sidewalk project will begin in November
§ The Guide Rail bids are due tomorrow.

Award of Contract for Engineering Services – Village Hall Generator
Upon motion by Trustee Waxenberg, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the Village Manager is hereby authorized and directed to execute a Professional Service Agreement with Lynstaar Engineering P.C. to provide design and construction services for the installation of a generator for the Village Hall.
Award of Bids
Sidewalks, Pleasantville Road
Upon motion by Trustee Smith, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the bid for the Sidewalks on Pleasantville Road (VM-0708-11) is hereby awarded to ELQ Industries, per their bid of $56,733.50.
BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with ELQ Industries for the replacement of sidewalks on Pleasantville Road.
Electrical Contracting Services
Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED that the bid for Electrical Contracting Services is hereby awarded to Mard Electrical Contracting Corp, per their bid of $93.94 per hour for scheduled services and associated costs for emergency services, service on holidays and Sunday service.
BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Mard Electrical Contracting Corp of Mount Kisco, New York for Electrical Contracting Services.
Authorize Village Manager to Execute Agreement with the New York State Department of Transportation, Intersection Safety Improvements, Pleasantville Road and Ingham Road
Upon motion by Trustee Waxenberg, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:
Authorizing the implementation, and funding in the first instance 100% of the federal-aid eligible costs, of a transportation federal-aid project, and appropriating funds therefore.
WHEREAS, a Project for Safety Improvements at the Pleasantville Road & Ingham Road Intersection in the Village of Briarcliff Manor, Westchester County, PIN 8758.92 (the “Project”) is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 100% Federal funds and 0% non-federal funds; and
WHEREAS, the Village of Briarcliff Manor desires to advance the Project by making a commitment to pay in the first instance 100% of the costs of preliminary engineering and right-of-way incidentals.
NOW, THEREFORE, the Briarcliff Manor Board of Trustees, duly convened does hereby
RESOLVE, that the Briarcliff Manor Board of Trustees hereby approves the above-subject project; and it is hereby further
RESOLVED, that the Briarcliff Manor Board of Trustees hereby authorizes the Village of Briarcliff Manor to pay in the first instance 100% of the federal share of the cost of preliminary engineering and right-of-way incidental work for the Project or portions thereof; and it is further
RESOLVED, that the sum of $67,000.00 is hereby appropriated from the General Fund and made available to cover the cost of participation in the above phase of the project; and it is further
RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Briarcliff Manor Board of Trustees shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Village Manager thereof and it is further
RESOLVED, that the Briarcliff Manor Village Manager be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or applicable Marchiselli Aid on behalf of the Village of Briarcliff Manor with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality’s first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further
RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is further
RESOLVED, this Resolution shall take effect immediately.
BE IT FURTHER RESOLVED, the Board approved the original Resolution, November 16, 2006.
Board Appointment – Conservation Advisory Council
Upon motion by Trustee Smith, seconded by Trustee Mayer, the Board voted unanimously to approve the following resolution:
BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby makes the following appointment:
Julius Bleiweis to the position of Conservation Advisory Council Member to fill the unexpired term of Jerome Morrissy to expire on April 1, 2008.
Certification of Fire Chief Appointment
Upon motion by Trustee Mayer, seconded by Trustee Waxenberg, the Board voted unanimously to approve the following resolution:
BE IT FURTHER RESOLVED that the Board of Trustees does hereby certify the following appointment to the Briarcliff Manor Fire Department Deputy Chiefs Association:
William P. Ventura as a Deputy Chief of the Briarcliff Manor Fire Department Deputy Chiefs Association.
Minutes
Upon motion by Trustee Mayer, seconded by Trustee Smith, and one abstention from Trustee Waxenberg the Board voted to approve the minutes of September 10, 2007 as amended.
Upon motion by Trustee Waxenberg, seconded by Trustee Smith, the Board voted unanimously to approve the minutes of September 11, 2007 as amended.
Upon motion by Trustee Smith, seconded by Trustee Mayer, the Board voted unanimously to approve the minutes of September 17, 2007 as amended.
Upon motion by Trustee Mayer, seconded by Trustee Smith, and one abstention from Trustee Waxenberg the Board voted to approve the minutes of September 20, 2007 as amended.
Upon motion by Trustee Waxenberg, seconded by Trustee Smith, the Board voted unanimously to approve the minutes of October 4, 2007 as amended.
Adjournment
Upon motion by Trustee Mayer, seconded by Trustee Smith, the Board voted unanimously to close the meeting at 8:10pm.
