Regular Meeting
September 6, 2007

A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held in the Village of Briarcliff Manor Village Hall, at 1111 Pleasantville Road, Briarcliff Manor, New York of the 6th of September commencing at 7:30 p.m.

Board of Trustees Announcements
§       Community Day will be September 8th from 2pm to 10pm
§       A mailing will be sent to all residents regarding the public hearings for the final draft of the Comprehensive Plan.  
§       The Conservation Advisory Council is sponsoring a Walk in the Woods on Saturday, September 29th at 10am at the Kate Kennard Trail
§       The striping on Route 9 is temporary and will be re-milled and repaved beginning September 9th
§       School is Open, please drive carefully

Village Managers Report
§       A pre-construction meeting for the Sleepy Hollow Drainage project was held.  
§       The annual paving in the village is scheduled to begin the first week in October.

Schedule Public Hearing, to Repeal Chapter 127 and Enact New Chapter 127 Regulating Floodplains   
Mayor Vescio explained the proposed law and stated it was to insure that residents could maintain their flood insurance.  

Village Manager Blau stated the legislation is a model from the federal government and any requests for changes needed to be approved by them.  He further stated the law needed to be adopted by September 28, 2007.  

Upon motion by Trustee Mayer, seconded by Trustee Smith, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that a Public Hearing is hereby scheduled for September 20, 2007 to hear and discuss an amendment to the Code of the Village of Briarcliff Manor to repeal Chapter 127 and enact a new Chapter 127, to regulate floodplains.  

Adoption of Policy, Installation of Pavement Markings for Village Streets and Roadways

Upon motion by Trustee Smith, seconded by Deputy Mayor Venditti, the Board voted unanimously to approve the following resolution:

BE IT RESOLVED that the Board of Trustees does hereby adopt the following Policy relating to the installation of pavement markings on Village streets and roadways:

POLICY STATEMENT

PAVEMENT MARKINGS ON STREETS AND ROADWAYS
IN THE VILAGE OF BRIARCLIFF MANOR
Adopted by the Board of Trustees –  September 6, 2007


There are a number of streets and roadways in the Village that are currently painted/striped with pavement markings to provide guidance to vehicular traffic.  There are other streets and roadways which should be considered for painting/striping for the safety of vehicular traffic, bicycles and pedestrians.  The issue has arisen concerning the addition of pavement markings on streets and roadways in the Village that did not have pavement markings prior to the development of a Policy Statement and it is the desire of the Board of Trustees to adopt a policy that will regulate the installation of pavement markings throughout the Village.  This Policy Statement shall only control pavement markings on streets and roadways not controlled and regulated by another governmental entity (New York State Department of Transportation, Westchester County Department of Public Works).

1.      Pavement markings installed on streets and roadways controlled by the Village of Briarcliff Manor shall be in compliance with the “Manual of Uniform Traffic Control Devices” developed by the New York State Department of Transportation, Traffic and Safety Division, which is in effect at the time of the installation of the pavement markings.

2.      All streets and roadways in the Village which are subject to the regulation and control of the Village and listed as a primary, secondary or collector street or roadway by the New York State Department of Transportation (NYSDOT) shall have a double yellow center line.

3.      All streets and roadways listed by the NYSDOT as a primary, secondary or collector street may have other pavement markings approved by the NYSDOT “Manual of Uniform Traffic Control Devices”.  The installation of the other pavement markings shall be based upon a determination of the Pavement Marking Committee which is hereby established by this Policy Statement.

4.      Any other street and roadway not so designated by the NYSDOT as a primary, secondary or collector street may have other pavement markings approved by the NYSDOT “Manual of Uniform Traffic Control Devices”, based upon a determination of the Pavement Marking Committee.

5.      The Pavement Marking Committee shall have complete discretion in regards to the installation of pavement markings noted in Clause 3 and 4 and the decisions of the Pavement Marking Committee shall not be subject to review or appeal.


6.      The membership of the Pavement Marking Committee shall be as follows:
o       One (1) member of the Board of Trustees.  The appointment of the first member of the committee shall extend to the first Board of Trustees annual Organizational Meeting.  Thereafter, the appointment shall be for one (1) year and shall occur annually at the Board of Trustees Organizational Meeting
o       Chief of Police
o       Superintendent of Public Works
o       Village Engineer
o       Village Manager

7.      Requests for consideration for pavement markings may be submitted to the Pavement Marking Committee from the Board of Trustees, any staff member, resident of the Village or any member of the public.
8.      The Pavement Marking Committee may consider any factor when analyzing whether pavement markings beyond that which is required pursuant to Clause 2 of this Policy Statement shall be installed.  At a minimum, the Committee shall consider the following factors:
o       Safety of vehicular traffic
o       Safety of bicycles
o       Safety of pedestrians
o       Amount of traffic on street or roadway
o       Number of residences or commercial establishments on street or roadway

Minutes

Upon motion by Deputy Mayor Venditti, seconded by Trustee Waxenberg, the Board voted to approve the minutes of August 2, 2007 as amended.  

Upon motion by Trustee Waxenberg, seconded by Trustee Smith with one abstention from Deputy Mayor Venditti, the Board voted to approve the minutes of August 17, 2007 as amended.

Adjournment

Upon motion by Trustee Waxenberg, seconded by Trustee Mayer, the Board voted unanimously to adjourn the regular meeting at 7:45pm.  

Upon motion by Deputy Mayor Venditti, seconded by Trustee Smith, the Board voted unanimously to reconvene as the Board of Police Commissioners.

Amend Procedures Manual for the Briarcliff Manor Police Department

Trustee Waxenberg asked how the Officers would be informed of a police call through the new program.  

Deputy Mayor Venditti asked what would happen during foot patrols and asked for clarification on the definitions of non-emergency calls.  He suggested tabling the matter for further clarification.  

Adjournment

Upon motion by Trustee Waxenberg, seconded by Trustee Smith, the Board voted unanimously to adjourn the meeting of the Board of Police Commissioners at 7:55pm.
