Planning Board Meeting Minutes
Tuesday, February 12, 2013

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, February 12, 2013 at 7:30pm.

Call to Order: Chairman Nolan called the meeting to order at 7:30pm.  

PB-6-2012- STAUFFER – SUBDIVISION APPROVAL: The Planning Board reviewed an application for an approval of a 4 lot subdivision for a 4.9 acre property located at 238 Chappaqua Road.

Upon motion by Member Lotter, seconded by Member Halper, the Board voted unanimously to open the public hearing.  

Village Engineer Turiano stated the Tree Replacement Plan needed to be acted on as part of the subdivision approval.  

Village Planning Consultant Yackel stated the Applicant would have to return to the Board for Steep Slopes Approval and a Mandatory Tree Planting Plan when they intended to build on the sites.  

The Board requested the footprint for the house on Lot 4 be moved back and to the right.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to continue the public hearing to March 12, 2013 at 7:30pm.  

PB-2-2013-TWIST –SIGN PERMIT APPROVAL:  The Planning Board reviewed an application for a Sign Permit.  The property is located at 1136 Pleasantville Road.

Mr. Eric Singer, representing the Applicant, presented the amended proposed signage and awning.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the application with either color presented.  

PB-7-2012-HOLLY HILL, LLC – SITE PLAN APPROVAL AND VILLAGE CODE CHAPTER 220-9.2 MANDATORY TREE PLANTING PLAN (MTPP):  The Planning Board reviewed an application for Site Plan Approval and a tree planting plan to construct an accessory structure at an existing single family dwelling.  The property is located at 298 Scarborough Road. The matter was adjourned to March 12, 2013.  

PB-9-2012-LANDMARK DINER –SITE PLAN APPROVAL:  The Planning Board reviewed an application for Site Plan Approval to modify and expand parking provisions on two properties.  The property is located at 233/265 South Highland Avenue.

Member Halper recused himself.  

The application was tabled to the next meeting due to a lack of a quorum.  

PB-5-2012 – FAITH LUTHERAN BRETHREN CHURCH –SITE PLAN APPROVAL AND VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL): The Planning Board reviewed an application for site plan approval to re-grade and fill a portion of the property at an existing Church.  The property is located at 480 Pleasantville Road.

Mr. Bill Welsh, Consultant for the Applicant, stated they addressed the comments in the last memorandum.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted in favor of the application and directed Village Counsel to draft a resolution for the Chairman’s signature.  

PB-11-2012-1245 PLEASANTVILLE, LLC –SITE PLAN APPROVAL:  The Planning Board reviewed an application for a Site Plan Approval for the installation of a retaining wall.  The property is located at 1245 Pleasantville Road.  

Mr. Gary Ramuno and Mr. Tom Baccari, owners of the property, explained their application.  

Village Engineer Turiano stated the Applicant had been working with his office regarding the site improvements and site plan approval would be required.  

The Board had general discussion regarding the condition of the site.  

Mr. Ramuno stated they would look to improve the entire site but wanted to start with installing a retaining wall.  

Upon motion by Member Lotter, seconded by Member Halper, the Board voted unanimously to grant approval for the installation of a retaining wall subject to review by the Village Engineer.  

VILLAGE ENGINEER’S REPORT:
  • Urstadt Biddle filed for their building permits and work should begin in the Spring.  
  • 445 North State Road is in compliance with their site plan and the bidding process for infrastructure will begin shortly.  
  • Please help the Fire Department and dig out the fire hydrants near your home.  Please also shovel your sidewalks or summonses will be issued.  
MINUTES:

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the minutes of January 8, 2013.  

ADJOURNMENT

Upon motion by Member Lotter, seconded by Member Halper, the Board voted unanimously to adjourn the meeting at 8:20pm.
