Planning Board Meeting Minutes
Tuesday, January 8, 2013

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, January 8, 2013 at 7:30pm.

Call to Order: Chairman Nolan called the meeting to order at 7:30pm.  

PB-6-2012- STAUFFER – SUBDIVISION APPROVAL: The Planning Board reviewed an application for an approval of a 4 lot subdivision for a 4.9 acre property located at 238 Chappaqua Road.

Mr. Harry Nichols, Engineer for the Applicant, reviewed the application and stated they’d ironed out a number of the issues and shifted the locations of the houses to avoid steep slopes.    

The Board had general discussion regarding the proposed locations for the houses, driveways and sight distances.  

Member Neveloff requested the neighbors be notified of the proposed application.  

Village Planning Consultant Yackel reviewed her memorandum and stated an erosion control plan and tree removal plan needed to be submitted.  

Mr. Nichols stated it was a heavily wooded site and they would submit those after they reviewed how many trees were damaged during Hurricane Sandy.  

Village Engineer Turiano stated the applicant needed to discuss whether or not they would abandon their well with the Health Department and requested a table be submitted showing how many square feet of steep slopes would be affected.  

Ms. Tina Weisman of 77 Burns Place stated she attended the site walk and thanked Member Neveloff for requesting the neighbors be notified.  She stated the area lost a lot of trees from the Hurricane and requested they preserve as many trees as possible to maintain privacy in the neighborhood.  She asked that the homes match the character of the neighborhood.

Upon motion by Member Neveloff, seconded by Member Halper, the Board voted unanimously to schedule a Public Hearing for February 12, 2013 at 7:30pm.  

PB-1-2013-ADVANCE AUTO PARTS –SIGN PERMIT APPROVAL:  The Planning Board reviewed an application for a Sign Permit.  The property is located at 231 South Avenue.  

Mr. Patrick Cugy, Sign Agent for the Applicant, explained the proposed sign request.

Village Engineer Turiano stated a side sign was not permitted on one of the sides but was on the other because the parcel was a corner lot.  He stated the façade sign was compliant with the Village Code and further stated the Board could waive the code requirements for the side sign if they chose to.  

The Board had general discussion regarding the surrounding businesses and their signage.  The Board requested photos of the applicant’s other locations and stated they’d like to see alternate renderings using different colors that weren’t illuminated.  

PB-2-2013-TWIST –SIGN PERMIT APPROVAL:  The Planning Board reviewed an application for a Sign Permit.  The property is located at 1136 Pleasantville Road.

Mr. Nick Rudick from Hudson Signs and Mr. Eric Singer, Architect for the Applicant explained the proposed application.  

Village Engineer Turiano stated the sign was in compliance with the Village Code.  

The Board had general discussion regarding the sign style, color and lighting type.  The Board requested a proposal be submitted with carved wood or wood type letters with gooseneck lighting.  They further requested a different color awning and façade striping be proposed and that the Applicant amend their proposal to be consistent with the Board’s comments.  

ZBA CASES:

There were no comments.  

VILLAGE ENGINEER’S REPORT:
  • All Village services are back to regular schedule after Hurricane Sandy.  
  • A lot of generator permits have been issued.  Some neighborhoods have more than others and may get noisy.
  • Urstadt Biddle filed for 2 of their building permits.  
  • The modular buildings have been installed at 445 North State Road.  The site improvements will be sent out for public bid.
MINUTES:

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the minutes of November 13, 2012 and December 11, 2012.  

ADJOURNMENT

Mr. Brett Newman of 43 Deertree Lane stated he was concerned his development was losing their privacy due to the construction at 445 North State Road and asked who was inspecting the project.  He stated the buildings appeared to be much taller than what was proposed.  

Village Engineer Turiano stated he would verify that they were installed at the correct elevation and that they were in compliance.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to adjourn the meeting at 8:55pm.
