Planning Board Meeting Minutes
Tuesday, November 13, 2012

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, November 13, 2012 at 7:30pm.

Call to Order: Chairman Nolan called the meeting to order at 7:30pm.  

PB-3-2012- ASHRIDGE REALTY: The Planning Board held a public hearing to review an application for an approval of a 3 lot subdivision for a 20 acre property located at 508 Scarborough Road.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to adjourn the hearing to the December 11, 2012 meeting.  

PB-6-2012- STAUFFER – SUBDIVISION APPROVAL: The Planning Board reviewed an application for an approval of a 4 lot subdivision for a 4.9 acre property located at 238 Chappaqua Road.  

Mr. Harry Nichols, Engineer for the Applicant, explained the proposed subdivision.  He stated they planned to renovate the existing home and build 3 others.  He showed the locations of the slopes on the site and explained the reasoning for the proposed locations of the new homes.  

The Board requested the neighboring homes be shown on future submittals and requested a site walk.  

Village Planning Consultant Yackel stated the applicant needed to establish setbacks for each lot and that they needed to submit a stormwater pollution plan and a tree removal plan.  

Member Lotter requested the sloped areas be shaded in on the drawings.  

The Board scheduled a site walk for December 1st at 10am and requested the applicant stake out the proposed locations for the new homes, property line and driveway locations.  

PB-7-2012-HOLLY HILL, LLC – SITE PLAN APPROVAL AND VILLAGE CODE CHAPTER 220-9.2 MANDATORY TREE PLANTING PLAN (MTPP):  The Planning Board reviewed an application for Site Plan Approval and a tree planting plan to construct an accessory structure at an existing single family dwelling.  The property is located at 298 Scarborough Road.

Mr. John Marwell, Attorney for the Applicant, explained the proposed application to build an outdoor pavilion and stated in addition to Planning Board approval, they’d need to acquire 2 variances from the Zoning Board of Appeals for the height of the proposed structure and to illuminate the tennis courts.  He stated it would be used for recreational and entertaining purposes.  

Village Engineer Turiano stated they were before the Planning Board for site plan approval and a Mandatory Tree Planting Plan.  

Mr. Charles Utschig, Engineer for the Applicant, explained the proposed location and stated no trees would be removed.  He stated there would be very little light spilling out of the building’s footprint and they were not proposing to have plumbing at the site.  

The Board had general discussion regarding the distance from the main house.  

Village Planning Consultant stated they were well below the maximum GFA for the site and they were required to plant an additional 84 trees and were seeking a waiver for 44 trees.  

The Board scheduled a site walk for December 1st at 9am and requested the Applicant float a balloon to show the proposed height of the structure.  

ZBA CASES:

There were no comments.  

VILLAGE ENGINEER’S REPORT:
  • Hurricane Sandy left a lot of tree damage and debris throughout the Village.  The DPW will be helping residents with removal through November 25th.  
  • The Chilmark Shopping Center is finalizing their plan with Ossining.

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the minutes of the October 9, 2012 Regular Meeting.  

ADJOURNMENT

Upon motion by Member Halper, seconded by Member Pastore, the Board voted unanimously to adjourn the meeting at 8:50pm.
