Planning Board Meeting Minutes
Tuesday, October 11, 2011
A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, October 11, 2011 at 7:30pm.

Call to Order: Chairman Nolan called the meeting to order at 7:30pm.
CONTINUED PUBLIC HEARING PB-6-2010- URSTADT BIDDLE PROPERTIES INC. CHILMARK SHOPPING CENTER – SITE PLAN AMENDMENT: The Planning Board held a Public Hearing and reviewed an application to amend a site plan. The property is located on Pleasantville Road.
Upon motion by Member Halper, seconded by Member Neveloff, the Board voted unanimously to reopen the public hearing.
Mr. William Null, Attorney for the Applicant, stated they were not able to reach an agreement with the A&P regarding the site and explained the proposed modifications.
Mr. Rob Aiello, Consultant for the Applicant, explained the proposed parking, crosswalk and sidewalk reconfiguration and proposed landscaping throughout the site.
Mr. Rich Peterson, Traffic Consultant for the Applicant, reviewed the traffic and parking study and the proposed improvements to pedestrian crossings and traffic signals.
The Board had general discussion regarding traffic flow throughout the site, pedestrian walkways, landscaping and signage.
Chairman Nolan asked if faux windows could be put on the façade.
Member Murray asked if the Applicant considered a smaller addition.
Mr. Null stated if the size of the addition was reduced the tenant would no longer be interested.
Mr. Stephen Smalley of 111 Orchard Road asked about the number of parking spaces, the type of surface used for the sidewalks and how the grade change would be addressed at the intersection at Pleasantville Road. He further asked how large trucks would be able to make turns within the site and how snow plowing would be handled.
Mr. Ken Trabine of 21 Ramapo Road stated that perhaps A&P didn’t want to be part of the plan because it could hurt their business. He asked if the parking study took the vacant space into consideration.
Mr. Charles Bradley of 103 Meadow Road stated he had been shopping at the site for over 30 years and the Board should look at the big picture. He stated the site was a hodge podge of buildings that were deteriorating. He stated the current proposal reminded him of a prison and if redevelopment was going to occur it should be done tastefully. He stated the current proposal did not suit Briarcliff Manor.
Mr. Anthony Mioki of Browning Drive stated the vast majority of parking on the site was in the “outfield”, creating a parking nightmare. He stated a large addition that couldn’t be subdivided was a mistake and left the Village open to an empty big box type store.
Mr. Elliot Cohen of 90 Orchard Road stated that if the light on Pleasantville Road was green for a longer period of time it would make it more difficult to turn in or out of Orchard Road.
Mr. Rocco Circosta of Ramapo Road stated the applicant was using the upper lot as part of their parking plan but the 1982 resolution stated that was for Shopwell employees. He stated the handicapped spaces were not ADA compliant.
Ms. Linda Edelstein of Becker Lane stated the public was lied to about A&P’s cooperation originally.
Mr. Charles Mucello of Ossining stated the proposal wasn’t any better than the current site plan and in fact was worse in his opinion. He asked the Board to turn down the proposal.
Mr. Howard Ravis of 5 Amawalk Court asked how onsite security would be enforced.
Ms. Judy Borr of Ossining, stated she was concerned about pedestrian safety on the site. She stated the site seemed crowded.
The Board requested the hours of operation for the proposed CVS.
Ms. Sophie Ravis of 5 Amawalk Court stated the building was prisonlike in appearance and not suitable for Briarcliff Manor.
Ms. Jane Torrins of 21 Pocantico Road stated she was concerned with the traffic and the size of the addition.
Upon motion by Member Lotter, seconded by Member Neveloff, the Board voted unanimously to adjourn the hearing to the November 8, 2011 meeting.
PB-8-2011 PRAEGER- SUBDIVISION APPROVAL: The Planning Board held a Public Hearing for an application for a two lot subdivision for a 5.9 acre property. The property is located at 57 Becker Lane.
Upon motion by Member Neveloff, seconded by Member Murray, the Board voted unanimously to open the public hearing.
Village Attorney Pozin noted the missing revision date on the plan.
Upon motion by Member Halper, seconded by Member Neveloff, the Board voted unanimously to approve the application.
PB-11-2011- T-MOBILE NORTHEAST LLC – SITE PLAN APPROVAL - The Planning Board will review an application for site plan approval for the installation of a cellular monopole and related equipment. The property is located at 10 Buckhout Road. Adjourned to November 8, 2011.
PB-12-2011- WILLIAM RAVEIS LEGENDS REALTY GROUP – SIGN PERMIT: The Planning Board reviewed an application for a sign permit for property located at 1197 Pleasantville Road.
The Board had general discussion regarding the proposed sign or awning.
Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the proposed sign subject to review by the Building Department.
PB-15-2011- STUART AND KIMBERLY WOODY: The Planning Board reviewed an application for a tree planting plan to construct a new single family dwelling. The property is located at 5 Tuttle Road.
Ms. Mary Scott, Architect for the Applicant, explained the proposed MTPP and requested the number of trees be reduced from 8 to 5.
Upon motion by Member Murray, seconded by Member Halper, the Board voted unanimously to approve the application as submitted with a reduction of trees from 8 to 5.
PB-16-2011 – MITCHELL DENNIS –VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL): The Planning Board reviewed an application for alterations and to construct an addition at an existing single family dwelling. The property is located at 50 Ridgecrest Road.
Village Engineer Turiano stated a steep slopes permit, MTPP and stormwater erosion control would be required for the application.
Mr. Stephan Thimme, Architect for the Applicant, explained the proposed addition and stated his client retained Mr. Ralph Mastromonaco to address the drainage.
The Board requested copies of the renderings in the next submission.
ZONING MAP AMENDMENT- The Board of Trustees has requested that the Planning Board provide comments on a proposed amendment to Chapter 220-3(B) relative to the adoption of a new Zoning Map in digitized form.
Upon motion by Member Halper, seconded by Member Murray, the Board reaffirmed their previous memorandum on the matter.
ZONING TEXT AMENDMENT- The Board of Trustees has requested that the Planning Board provide comments on a proposed amendments to Chapter 220, Zoning, of the Code of the Village of Briarcliff Manor to amend Section 220-6(C) and Section 220-6(F) and add a new Section 220-6(J)(15) for shared residence Special Use Permits.
Mr. Christopher Bogart of 50 Revolutionary Road stated there were significant planning issues with the proposed legislation and requested the Board reaffirm their opposition to the Board of Trustees.
The Board had general discussion regarding the proposed legislation and the affordable housing mandate requirements and directed Counsel to amend the previous memorandum to the Board of Trustees with their recommendations.
Ms. Maxine Olsen of Quinn Road stated the proposed legislation was not to permit SRO’s but to allow people to live together cooperatively.
Mr. Robert Little of Scarborough Circle stated the Westchester County Monitor suggested he’d reject SRO’s and the proposed amendment would not work in the Village. He stated the Pace University property would be an ideal location for affordable housing.
VILLAGE ENGINEER’S REPORT:
- The Full Water Supply Project is in its final phase.
- NY State DOT has taken over the responsibility to replace the culvert on N. State Road.
- The Scarborough Road closure will end this week and will be repaved before the end of the paving season.
The Board requested the Village Engineer contact Wells Fargo regarding changing their sign.

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the minutes of September 13, 2011.
ADJOURNMENT
Upon motion by Member Neveloff, seconded by Member Halper, the Board voted unanimously to adjourn the meeting at 10:15pm.
