Planning Board Meeting Minutes
Tuesday, July 12, 2011

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, July 12, 2011 at 7:30pm.

Call to Order: Chairman Nolan called the meeting to order at 7:30pm.  

CONTINUED PUBLIC HEARING PB-6-2010- URSTADT BIDDLE PROPERTIES INC.  CHILMARK SHOPPING CENTER – SITE PLAN AMENDMENT: The Planning Board will hold a Public Hearing and review an application to amend a site plan.  The property is located on Pleasantville Road.  ADJOURNED TO AUGUST 9, 2011.   

PUBLIC HEARING PB-10-2011- THE CLEARVIEW SCHOOL - SUBDIVISION APPROVAL: The Planning Board held a Public Hearing and review an application to subdivide the property separating the area on which the residence is currently located (4+ acres) from the remaining parcel (17+ acres).  The property is located at 550 Albany Post Road and located in the R30A Zoning District.  

Upon motion by Member Lotter, seconded by Member Neveloff, the Board voted unanimously to open the public hearing.  

Ms. Renata Goldshteyn, Attorney for the Applicant, explained the application and stated there were no changes since the last approval.   

Mr. Paul McCaffery of River Road stated the school was a great neighbor but he wanted more information.  He stated he was concerned it was part of a 2 stage process to enable them to use that portion of land for another purpose.  He asked what happened if they took a loan on that property and it didn’t fix their problem.  He stated he didn’t want the property to fall into the hands of a developer.  

Ms. Goldshteyn stated the action would release the smaller parcel from financing restrictions.  

Chairman Nolan stated the school’s economics were not in the Board’s purview.  

Village Attorney Pozin stated the property was subject to a special use permit and any modifications would require Board of Trustees approval and also site plan approval from the Planning Board.  

Ms. Goldshteyn stated the Applicant had no present intention to change anything with the property; this was to release the parcel from financing.  

Upon motion by Member Neveloff, seconded by Member Murray, the Board voted unanimously to close the public hearing.  

Upon motion by Member Neveloff, seconded by Member Lotter, the Board voted unanimously to approve the application.  

PB-11-2011- T-MOBILE NORTHEAST LLC – SITE PLAN APPROVAL - The Planning Board reviewed an application for site plan approval for the installation of a cellular monopole and related equipment.  The property is located at 10 Buckhout Road.  

Ms. Cara Bonomolo, Attorney for the Applicant, explained the proposed application.  She stated they were confirming whether or not they would be in the wetland setback.  

The Board had general discussion regarding, the monopole height, how many carriers the monopole could hold, the diameter of the monopole with carriers on it and whether or not the gap in coverage could be minimized with more than one shorter monopole.  

Village Attorney Pozin stated the Board of Trustees Public Hearing was still open and the Planning Board could provide them with additional comments.  He stated the Special Use Permit needed to be approved before the Board could move forward.  

The Board requested a memo be drafted indicating their comments and also suggesting the neighbors in view of the proposed monopole be notified of the Board of Trustees public hearing.  

PB-8-2011 PRAEGER- SUBDIVISION APPROVAL: The Planning Board reviewed an application for a two lot subdivision for a 5.9 acre property.  The property is located at 57 Becker Lane.

The application was tabled to the August meeting.  

PB-13-2011 – CHRISTOPHER RICCIARDI –VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL): The Planning Board reviewed an application to construct a swimming pool at an existing single family dwelling.  The property is located at 51 Shellbark Lane.  

Mr. Charles Uchtig, Architect for the Applicant, explained the proposed application.  He stated they had limitations as to where they could put the pool to have the least visual impact.  

Village Engineer Turiano stated the comments from the Village’s Engineering Consultant were satisfied by the Applicant.  
Upon motion by Member Murray, seconded by Member Halper, the Board voted unanimously to approve the application.  

PB-13-2011- ROBERT B. AMSTERDAM DMD – SITE PLAN AMENDMENT: The Planning Board reviewed an application for an amendment to a site plan for the installation of solar panels.  The property is located at 190 North State Road.  

Mr. Doug Hertz of Sunrise Solar Solutions explained the proposed application.  

The Board had general discussion regarding visual impacts and the height of the panels.  

Upon motion by Member Neveloff, seconded by Member Halper, the Board voted unanimously to approve the application and resolution subject to review by Chairman Nolan.

There were no comments.

An application to construct a detached two car garage to an existing single family dwelling is denied due to nonconformity with Column 8A, Front Yard Minimum Yard Dimensions and Column 9A, One Side Yard Minimum Yard Dimensions of the Code of the Village of Briarcliff Manor.

An application to construct additions and interior alterations to an existing single family dwelling is denied due to nonconformity with Column 8A, Front Yard Minimum Yard Dimensions of the Code of the Village of Briarcliff Manor.  

VILLAGE ENGINEER’S REPORT
  • The photovoltaic system for the DPW is in its final design phase.  
  • The FWSP is within weeks of being 100% operational.   
  • The June 23rd storm caused a lot of village wide damage.  Debris clogged a large pipe, flooding Law Park and the lower level of the Library.

Upon motion by Member Lotter, seconded by Alternate Member Herbst, the Board voted unanimously to adjourn the meeting at 8:50pm.
