Planning Board Meeting Minutes
Tuesday, January 11, 2011

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, January 11, 2011 at 8:00pm.

Members Present:        Edward Nolan, Chairman

Call to Order: Chairman Nolan called the meeting to order at 8:00pm.  

PB-1-2011- JESSICA AND STEVEN VESCIO: The Planning Board reviewed an application for a tree planting plan to construct a new single family dwelling.  The property is located at 136 Old Briarcliff Road.

Mr. Steven Vescio explained the proposed application and planting plan.  

Village Consultant Yackel stated there weren’t any concerns and they proposed more plantings than required for more screening.  She further stated it was exempt under SEQRA.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to approve the application as presented.  

PB-2-2011 – RICHARD BIRNBAUM –VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL): The Planning Board reviewed an application to construct a two-story addition to an existing single family dwelling.  The property is located at 416 Elm Road.

Mr. Jay Hibbs, Architect for the Applicant, explained the proposed addition to the home.  

Mr. Michael Stein, Engineer for the Applicant, explained the storm water management plan.  

The Board had general discussion regarding the grades of the slopes and which areas would be affected and the Board’s jurisdiction in sloped areas over 25%.  

Village Attorney Wagner stated she would review the Village Code’s criteria and legal requirements.  

Village Engineer Turiano stated the drainage should be moved to a less sloped area.  

The Board requested the drawings show what existed and what was proposed and to minimize the disturbances to the sloped areas are much as possible and tabled the matter the next meeting.  

PB-3-2011 - TRUMP –SPECIAL PERMIT REVIEW AND RECOMMENDATION AND SITE PLAN AMENDMENT:  The Planning Board provided a recommendation to the Board of Trustees for a Special Use Permit and review an application to amend a site plan and on an existing golf course.  The property is located at 339 Pine Road.

Mr. John Sullivan, Architect for the Applicant, explained the proposed application and stated the current Pro Shop was willfully too small and didn’t serve the needs of the Club.  He stated the guest rooms would be open 8 months out of the year and would only be used by Members and their guests.  

The Board had general discussion regarding the visibility of the proposed structure and requested photographs be taken from various neighboring properties.  

Upon motion by Member Murray, seconded by Alternate Member Herbst, the Board voted unanimously to make a positive recommendation to the Board of Trustees with the request the space only be used when the Club is open.  

ZONING TEXT AMENDMENT- The Board of Trustees requested that the Planning Board provide comments on proposed amendments to Chapter 220-3 Zoning, and the Zoning Map thereunder, to modify the boundaries of the existing B1 Retail Business District and establish a new B1A Retail Business and Residential District.   

Village Consultant Yackel explained the proposed legislation.  

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to recommend the text as proposed to the Board of Trustees.  

ZBA CASES

The Board had no comments regarding the Zoning Board of Appeals applications.  

MINUTES

Upon motion by Alternate Member Herbst, seconded by Member Halper, the Board voted unanimously to approve the minutes of the November 9, 2010 Regular Meeting.  

VILLAGE ENGINEER’S REPORT
  • Resident’s are reminded to shovel their sidewalks within 12 hours of a snow storm.  
ADJOURNMENT

Upon motion by Member Halper, seconded by Alternate Member Herbst, the Board voted unanimously to adjourn the meeting at 9:00pm.
