Planning Board Meeting Minutes
Tuesday, July 13, 2010

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, July 13, 2010 at 8:00pm.

Call to Order: Chairman Nolan called the meeting to order at 8:00pm.  

ZONING TEXT AMENDMENT- The Board of Trustees requested that the Planning Board provide comments on proposed amendments to Chapter 220 Zoning, with respect to establishing a new Special Permit Use in a retail business district to be listed as Chapter 220-6K (4).  

PB-6-2010- URSTADT BIDDLE PROPERTIES INC.  CHILMARK SHOPPING CENTER – SITE PLAN AMENDMENT AND PROPOSED SPECIAL USE PERMIT RECOMMENDATION: The Planning Board reviewed an application to amend a site plan and provide a recommendation to the Board of Trustees for a proposed Special Use Permit.  The property is located on Pleasantville Road.  

Chairman Nolan stated items 1 and 2 on the agenda would be addressed jointly.  

Mr. William Null of Cuddy and Feder, Attorney for the Applicant, explained the proposed amendments to the site plan and the proposed Zoning Text Amendment.  

Mr. Norman DiChiara, Architect for the Applicant, explained the proposed architecture.  

The Board had general discussion regarding parking and traffic circulation at the site.  

Village Planning Consultant Yackel stated they supported the concept for the Special Use Permit approach for shopping centers.  She further stated the Board of Trustees was lead agency for SEQRA but a coordinated review was in order.  

Ms. Maria Anella, Manager of Prescription Plus, stated they made no agreement with CVS and they were being terribly mistreated.  

Mr. Sayid Raman, owner of Prescription Plus, stated his business had been in the Village for over 30 years and the landlord was trying to push him out.  

Mr. Eliot Cohen stated there were other CVS’s around and adding a new one would create more traffic.  

Mr. William Null stated several levels of discussion were needed regarding the Zoning Text Amendment, Site Plan, Special Use Permit and tenant issues.  He stated they would look to work out the tenant issues privately.  

The Board had general discussion regarding blasting at the site and whether other shopping centers would be grandfathered in.  They requested the other shopping center owners be notified.  They stated they had no objection to the Board of Trustees being lead agency for SEQRA.  

Upon motion by Member Lotter, seconded by Alternate Member Herbst, the Board requested Counsel draft a letter in support of the Zoning Text Amendment with respect to parking and special permit uses in retail business districts.

PB-7-2010-  CONGREGATION SONS OF ISRAEL – SITE PLAN AMENDMENT- The Planning Board reviewed an application to amend a site plan for the installation of a solar electric system and a steel entrance canopy.  The property is located at 1666 Pleasantville Road.

Member Halper recused himself from the application.  

Mr. William Null of Cuddy and Feder, Attorney for the Applicant, explained the application.  

The Board made minor amendments to the proposed resolution.  

Upon motion by Member Murray, seconded by Alternate Member Halper, the Board voted unanimously to approve the application.  

PB-5-2010- KAREN LAU – SITE PLAN APPROVAL: The Planning Board reviewed an application for a site plan approval. ~The property is located at 640 Albany Post Road. ~

Ms. Karen Lau, Applicant, explained the proposal to install ground mounted solar panels on her property.  

Village Planning Consultant Yackel stated there were minor technical issues that needed to be cleaned up but they could be addressed during the building permit process.  

Upon motion by Member Lotter, seconded by Member Halper, the Board voted unanimously to approve the application.

The Board had no comments on the Zoning Board of Appeals applications.

MINUTES

Upon motion by Member Halper, seconded by Member Murray, the Board voted to approve the minutes of June 8, 2010.

VILLAGE ENGINEER’S REPORT
  • Proposed B1 Mixed Use Zoning Amendment
Zoning Inspector Quartucio explained there was a preliminary request for a mixed use zone on North State Road.  

Village Planning Consultant Yackel stated she was drafting language at the Board of Trustees request.

Ms. Linda Whitehead, Attorney for the Applicant, explained the proposal for fair and affordable housing at their site.    

Mr. Eric Abraham, owner of 445 North State Road, showed the renderings of the proposed housing and office units.  

The Board had general discussion regarding parking, access to the site and the potential costs per unit.  

Zoning Inspector Quartucio requested the Board send a letter to the Board of Trustees to address the vacancies on the Architectural Review Advisory Committee.  

ADJOURNMENT

Upon motion by Member Halper, seconded by Member Lotter, the Board voted unanimously to adjourn the meeting at 9:35pm.
