Planning Board Meeting Minutes
Tuesday, May 12, 2009

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, May 12, 2009 at 8:00pm.

Call to Order: Chairman Nolan called the meeting to order at 8:00pm.  

PB-3-2009- EMIGRANT BANK – SITE PLAN AMENDMENT: The Planning Board reviewed an application to amend a site plan to modify existing parking lot striping and the entrance walkway for purposes of accessibility and compliance with the Americans with Disabilities Act.  The property is located at 320 Old Briarcliff Road.  

Member Neveloff recused himself from the application.  

Mr. David Steinmentz, Attorney for the Applicant, reviewed the draft resolution and asked about the field inspection requirement.  

Village Attorney Pozin stated it was standard procedure for site plan approvals and he anticipated Village Engineer Turiano doing the inspection and if he felt something needed attention he would notify the Board.  He further stated Village Engineer Turiano would notify the Applicant if he had any concerns.  

Mr. Steinmetz stated the Applicant was extremely appreciative of the work of the Building Department and the Board.  

Village Engineer Turiano encouraged the Applicant to start the landscaping and removal of the dead trees as soon as possible   

The Board reviewed the resolution and made minor modifications.  

Upon motion by Alternate Member Herbst, seconded by Member Murray, the Board voted unanimously to approve the resolution.  

PB-4-2009-JOSEPH SHAIN, VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL) AND CHAPTER 220-9.2 MANDATORY TREE PLANTING PLAN (MTPP):  The Planning Board reviewed an application for a steep slopes permit and a tree planting plan to construct a new single family dwelling.  The property is located at 225 Central Drive.

Mr. William Null, Attorney for the Applicant, explained the application.  He stated the proposal was fully zoning compliant and worked well with the adjacent homes.  He stated there was a common driveway to preserve some of the trees.  

Mr. Rudy Petrucelli, Engineer for the Applicant, explained the steep slopes disturbance areas and the drainage plan.  

Village Engineer Turiano stated with less than an acre of disturbance, they were in accordance with the Stormwater Management Law.  

Mr. Ralph Belanco, Landscape Architect for the Applicant, reviewed the planting plan and explained the placement of the trees throughout the site.  

Chairman Nolan asked if the Building Department verified the 1 year maintenance of the trees planted.  

Village Engineer Turiano stated they inspected the site after a year to make sure the trees are maintained.  

Village Attorney Pozin stated it could be made a condition in the resolution.  

Upon motion by Member Murray, seconded by Member Neveloff, the Board voted unanimously to approve the resolution with the added condition.  

PB-8-2009-SCARBOROUGH_FIREHOUSE-REVIEW_AND RECOMMENDATION ON SITE PLAN:  The Village Engineer provided a status update on the Scarborough Firehouse.  The property is located at 591 Scarborough Rd.  

Village Engineer Turiano and Captain Steven Vescio reviewed the proposed plan for the Scarborough Fire House addition.     

Member Neveloff asked if the exterior lighting will be pointed down.  

Village Engineer Turiano stated the night lighting will be very limited and mostly on motion sensors.  

Chairman Nolan asked if the addition complied with national fire standards.  He also inquired about the smashed up cars in the parking lot.  

Village Engineer Turiano stated it did comply and that the smashed up cars were used for training.    

Captain Vescio stated the building will be more environmentally friendly.  He further stated Village Engineer Turiano was incredibly helpful during the process.

Village Engineer Turiano explained the requested variance.  

MINUTES

Upon motion by Member Lotter, seconded by Alternate Member Herbst, with two abstentions from Members Murray and Neveloff the Board voted to approve the minutes of April 14, 2009.  

VILLAGE ENGINEER’S REPORT

  • The full water supply project will go out to bid May 15th and bids will be opened on June 15th.   
  • Wustof-Trident has vacated their building and a high tech data center will be looking to move in there.  It will be mostly equipment and will have very little impact.  
  • The Scarborough Fire House bid will be available May 18th and bids will be opened on June 12th.  
ADJOURNMENT

Upon motion by Member Murray, seconded by Alternate Member Herbst, the Board voted unanimously to adjourn the meeting at 9:00pm.
